Advantage Of Mediation In Divorce When there are issues and disputes between two parties, the best thing to do is not to bring the action right away to the court of law. Instead, the parties must try to settle the same amicably or without court intervention. It may be done with or without the assistance of their respective legal counsels. They can agree on any matter provided that the provisions of their agreement must not be contrary to law, public policy, good customs and morals.
If the parties are divorced from each other, it is highly recommended that they discuss all matters related to the divorce without court intervention. It is the most inexpensive way of settling all their disputes and issues. If they are unable to agree, then they may ask for a mediator to help them find a solution. Below is a list of three advantages of hiring a mediator.
1. A mediator can help the parties think properly. When a couple decides to get a divorce, they are too emotional to the point that they cannot think about things thoroughly. They may start to act irrational which is why having a mediator can be a big help to make them see the bigger picture of their situation. During divorce, things can turn pretty complicated between the spouses. Hence, having a mediator can really offer a big help to both the husband and wife who have decided to end their marriage.
2. During mediation, the divorce case will be suspended. Suspension of a divorce proceeding may be beneficial especially if a particular spouse is trying to re-think the divorce. It could be a big help to suspend the case for the meantime in order to check whether reconciliation is possible between the couple. It must be noted that the policy of the state is to protect the sanctity of marriage and the family.
3. The mediator can help the couple make better judgments or decisions. As already pointed above, spouses can become too emotional when undergoing through the process of divorce. They cannot think properly and can be too sensitive. With the assistance of a mediator, they can start to make better judgments since they can see the pros and cons of every provision that will be agreed between the two of them. At the same time, the said mediator can also help come up with certain arrangements that are beneficial not only for one party but to both the spouses.
