In the book Bilbo says that Gandalf “was responsible for so many quiet lads and lasses going off into the Blue for mad adventures.” The book goes on to imply that Gandalf was Adventure Buddies with Bilbo’s grandfather. But since Gandalf took “lasses” on adventures too, I added that Gandalf was ALSO Adventure Buddies with Belladonna. because why not!
Also: the idea behind the comic is that it’s being written/drawn by Bilbo as a bedtime story for a younger Frodo (who he’s either babysitting or has already adopted, take your pick!) This means that all the drawing mistakes are actually Bilbo making drawing mistakes. I am struggling to draw in order to be faithful to the fact that Bilbo is struggling to draw. Don’t worry, Bilbo will get better at drawing if he continues to make these comics

Habitica ideas for students
I’ve been using Habitica for a while now and I love it. The reason I love it so much is that I can use it to track pretty much everything, even apart from the normal productivity stuff, if I’m a little creative. 
As for setting all of this up, I highly recommend doing that on desktop. The mobile app is great for on the go but I wouldn’t recommend it for putting an entire new system in place (maybe that’s just me, though).
So here are some maybe a little more unconventional ideas for Habitica usage: 
HABITS
My habits are mostly positive with few exceptions because it’s much easier to reward yourself for doing something than to punish yourself for not doing something, in my opinion. Plus, I feel like it works out, too, because after all, you do usually want to feed your pets or buy equipment or buy quests.
Water tracker: Drinking water is important, yo. The way I go about this is I have a positive habit called “1l of water” and I just hit the + for every liter I drink. I’ve set it to reset daily so I can see at how many liters I roughly am at for the day. If you struggle with drinking water more, you can also just put “drink a glass of water” and set the difficulty to hard instead of easy, as I have it set because at this point I’m pretty used to drinking a shit ton of water, I just like to keep an overview in case I’m busy and forget. That’s the beauty of Habitica vs other apps, you can modify it to your needs! 
Meet friends: This one I have set to reset every week so that I can see at a glance whether I’m having a social life. Having “high density” fun (as Thomas Frank frequently puts it) is crucial to my mental health, yet I tend to do it too little especially when I’m stressed and instead sit there on my phone wondering where the hours went and feeling generally very blah. I only have this as a positive habit because I don’t want to and need to force myself to do something with friends every single day (what’s up fellow introverts), but I’m aiming for at least once a week of my own accord, so not counting when I see them in a uni context or at fixed activities. I have this set on hard to motivate myself to actually do it, too, since I have to leave the house to fulfill it.
Color: As you may have noticed (X, X) coloring is a bit of a hobby of mine so the habit isn’t really necessary right now while I’m still technically on break and have more time to do it, but I like to keep it in there anyway. I usually color while listening to podcasts because that goes hand in hand, and many podcasts I listen to are also somewhat educational (hmu with your favorites, I’d love to discover some new ones!) while still expanding my horizons beyond what I learn at uni. This one I have set to medium, because while it is a hobby that I like to do, there’s definitely some resistance because you have to be very focused and can’t really do other stuff except listen to podcasts simultaneously. Coloring is very therapeutic to me, and I’m not an artsy person, so maybe give it a shot! You can also replace coloring with any artistic habit, obviously.
Read or listen to podcast instead of watching TV: I love doing both of these things yet they start to get infinitely harder when you’re at uni and running around town trying to stay alive during the semester. Reading especially is very beneficial to my mental health and I love doing it, but it’s just so much harder to pick up a book than to hit play on Netflix. I should probably split these two habits up now that I think about it, because I do tend to read much less than I listen to podcasts. Either way, the difficulty setting here is hard with a daily reset although it doesn’t really matter that much as both daily and weekly resets are equally suited for the purpose in my opinion. 
One book per week: Ah yes, my reading goal. I am terrible at reading slowly and steadily during the year which leads me to binge read on vacation. Now, while I love doing that and I don’t perceive it as a stressful, I would prefer to also read during the year. This habit is set to hard with a weekly reset, and it is both a positive and a negative (which means I probably have to hit the - today, siiiiigh). 
Work out: During the school year, I weirdly don’t struggle with working out a lot because I see it as a study break and I’m one of those people who actually looks forward to working out and hitting some goals. This one also has a weekly reset, hard difficulty and is both a positive and a negative habit, however, I only hit the - when I was supposed to work out and didn’t. This is partly the reason why I don’t want my workout as a daily, I don’t like having fixed days because sometimes you gotta move your schedule around a bit and I simply aim to work out 4-5 times a week. I’m looking into starting an exercise class for swimming next semester, though, so if I do join that one, I will absolutely make it a daily. 
Meal not eaten at desk: Kind of a weird one. I started developing this terrible habit of constantly doing everything at my desk last year, especially eating. Now, if you don’t have a ton of space and roommates, it makes sense for your desk to be basically where you spend your entire day, but I want my desk to be as much of a work only, no play space as it can be, even with limited space, and eating at it is a very bad idea to keep that mental separation in place. Also, I want to be focus on what I’m eating as much as possible and not do five things simultaneously. So, in order to motivate myself to eat my food at the dining room table, I’ve made this a simply positive habit with a medium difficulty and a daily reset as I usually eat three meals a day.
Cook: If you follow me, you probably already know I’m a big proponent of home-cooked meals. But cooking is time consuming, exhausting and hard sometimes when all you want after a long day at uni is some sushi. I aim to cook at a proper meal at least two or three times a week and try to avoid takeout as much as possible. To motivate me, I have this as a positive habit, at a hard difficulty and a weekly reset. 
Go to bed before midnight: I struggle with this. A lot. However, I do need my sleep - when I don’t sleep at least seven hours, I’m unfocused, cranky and tired. Plus, it’s really bad for athletic recovery. Getting to bed before midnight at least ensures I’ll be getting seven hours (since I try to get up at 7:00), ideally I’d get eight or nine, but I’m trying to stay realistic here. I have this as a positive habit with a weekly reset and at a hard difficulty. I don’t see the point in making it a daily because I know I won’t do it (I could, however, maybe make “get to bed before 1:00 a daily, to get brownie points for getting to bed even earlier than I needed to, I might yet do that).
EDIT: It’s been brought to my attention by the lovely @gold-n-mind​ that mobile doesn’t show the counter, something I didn’t really think of because I only use Habitica of my phone when I can’t avoid it but mostly use it on desktop. You can still set up everything how I mention it, but you will have to check the count on desktop, as of right now there doesn’t seem to be another way for mobile users. For potential mobile only users, this is what I’m referring to:

DAILIES
These, just like the habits, will be very personal. My dailies tend to change a lot because when I’m back home at my parent’s I don’t really need cleaning dailies for example. But here are some ideas nevertheless:
Get up within 15 minutes of waking up: I suck at this. I tend to waste away time in my bed, staying on my phone for 30 minutes before I even think about getting up. But a quick jumpstart to my day is extremely beneficial for my productivity, so I’m trying to work on it. This is due every day since lounging about in bed makes me tired and cranky and consumes time I could be using to eat breakfast while watching youtube.
Morning skincare/evening skincare: Pretty self-explanatory. Due every day.
Open window: Due every day. I try to always open my window before I start studying, as I don’t really leave it open over night and fresh air is obviously very helpful for da brain. Also, the cold air tends to help me wake up. 
Make bed: I never used to do this. But then I read “Unfuck your habitat” and I saw the merit in starting your day on a positive, structured note while making your room seem more tidy. Also, these easy dailies give me something to check off before getting started on my harder to dos, which is a concept known as momentum. Due every day.
Do a 20/10 of cleaning somewhere: Another lesson from UFYH. It means you do 20 minutes of tidying somewhere, then take a 10 minute break. I have found I rarely really need more than 20 minutes, and you can easily integrate one 20/10 somewhere in your daily schedule. It’s not fun, but constantly chipping away at messes means you don’t have to do huge binge-cleans. Due every day, but usually not needed every day.
Take out trash if needed: Tasks like these (this one is exemplary because I have a lot of these when I’m in my apartment during the semester) are great because they get you check if you have to do something every day and if they’re due, you do them right away since you’re already there checking! If they’re not due, you can easily check something off your dailies without actually doing work. Of course, the difficulty setting on these is usually trivial, but taking out the trash is a very trivial task, you just tend to put if off forever. Other ideas for this are put on laundry, check the mail, etc.
Week review/weekly planning: This is due every Sunday. I suck at following through and do need to get better at it, but actually looking at your week in advance and knowing what’s gonna happen when as well as getting into the mindset for Monday does help. 
Study dailies: These will vary wildly depending on what kind of study system and schedule you have! I have a general study daily with a checklist that says “x pages” and “flashcards”. I also now have a separate flashcard daily with a checklist for every set of flashcards I’m trying to get done. Like I said, it will vary - for some of you having a daily with a certain goal of pomodoros may work (I don’t really utilize the pomodoro method a lot, though), some of you just need a push so “study for 30 minutes” may be enough to set you on a productive course. I change up my study dailies most frequently of all of them because they change a lot depending on what subject I’m focusing on, but most of the time I’ll only have them due during the week, sometimes also on Saturdays. 
Go to class: I don’t really struggle with this because I literally cannot skip more often than once or they fail me, but why not reward yourself for leaving your comfy flat and braving the real world? These are also easy to set up because classes generally take place on a weekly basis, just set them as due on the weekday when the class is, and if you don’t struggle with going to class like me, you can always set the difficulty to trivial.
TO DOS
I won’t really go in depth on the to dos, because I feel like they’re pretty self-explanatory. I will explain a couple, but apart from that it’s pretty personal and whatever you have going on, just throw it on there. 
Grocery list: This is the only more “unconventional” use I have for to dos. I like to make one to do that says “grocery shop” and then put everything I need as a separate sub-point. This works really well and I like to do it this way mainly so I don’t have my shit spread out over five list apps. The only drawback is that you can’t share that list with friends (unless you shell out €€ and get a group plan), so if you have a joint shopping list with a roommate, you might not be able to use this.
University readings: I like to make huge tasks of my required reading with tons of sub-points so that the reward is proportional to the pain (lol). The drawback to this method is that you don’t get the instant gratification of being able to check off a task at the end of the day, but I use dailies to work like this so my to dos are kind of a more long-term overview of where I want to be by what date. You can be as detailed with this as you want, but I just kind of use the big chapter headings. You could also divide it by pages, though. Whatever floats your boat.

Google’s latest user-hostile design change makes ads and search results look identical
Did you notice a recent change to how Google search results are displayed on the desktop?
I noticed something last week — thinking there must be some kind of weird bug messing up the browser’s page rendering because suddenly everything looked similar: A homogenous sea of blue text links and favicons that, on such a large expanse of screen, come across as one block of background noise.
I found myself clicking on an ad link — rather than the organic search result I was looking for.
Here, for example, are the top two results for a Google search for flight search engine ‘Kayak’ — with just a tiny ‘Ad’ label to distinguish the click that will make Google money from the click that won’t…
Turns out this is Google’s latest dark pattern: The adtech giant has made organic results even more closely resemble the ads it serves against keyword searches, as writer Craig Mod was quick to highlight in a tweet this week.

Last week, in its own breezy tweet, Google sought to spin the shift as quite the opposite — saying the “new look” presents “site domain names and brand icons prominently, along with a bolded ‘Ad’ label for ads”:

But Google’s explainer is almost a dark pattern in itself.
If you read the text quickly you’d likely come away with the impression that it has made organic search results easier to spot since it’s claiming components of these results now appear more “prominently” in results.
Yet, read it again, and Google is essentially admitting that a parallel emphasis is being placed — one which, when you actually look at the thing, has the effect of flattening the visual distinction between organic search results (which consumers are looking for) and ads (which Google monetizes).
Another eagle-eyed user Twitter, going by the name Luca Masters, chipped into the discussion generated by Mod’s tweet — to point out that the tech giant is “finally coming at this from the other direction”.
‘This’ being deceptive changes to ad labelling; and ‘other direction’ being a reference to how now it’s organic search results being visually tweaked to shrink their difference vs ads.
Google previously laid the groundwork for this latest visual trickery by spending earlier years amending the look of ads to bring them closer in line with the steadfast, cleaner appearance of genuine search results.
Except now it’s fiddling with those too. Hence ‘other direction’.
Masters helpfully quote-tweeted this vintage tweet (from 2016), by journalist Ginny Marvin — which presents a visual history of Google ad labelling in search results that’s aptly titled “color fade”; a reference to the gradual demise of the color-shaded box Google used to apply to clearly distinguish ads in search results.
Those days are long gone now, though.
Now a user of Google’s search engine has — essentially — only a favicon between them and an unintended ad click. Squint or you’ll click it.
This visual trickery may be fractionally less confusing in a small screen mobile environment — where Google debuted the change last year. But on a desktop screen these favicons are truly minuscule. And where to click to get actual information starts to feel like a total lottery.
A lottery that’s being stacked in Google’s favor because confused users are likely to end up clicking more ad links than they otherwise would, meaning it cashes in at the expense of web users’ time and energy.
Back in May, when Google pushed this change on mobile users, it touted the tweaks as a way for sites to showcase their own branding, instead of looking like every other blue link on a search result page. But it did so while simultaneously erasing a box-out that it had previously displayed around the label ‘Ad’ to make it stand out.
That made it “harder to differentiate ads and search results,” as we wrote then — predicting it will “likely lead to outcry”.
There were certainly complaints. And there will likely be more now — given the visual flattening of the gap between ad clicks and organic links looks even more confusing for users of Google search on desktop. (Albeit, the slow drip of design change updates also works against mass user outcry.)
We reached out to Google to ask for a response to the latest criticism that the new design for search results makes it almost impossible to distinguish between organic results and ads. But the company ignored repeat requests for comment.
Of course it’s true that plenty of UX design changes face backlash, especially early on. Change in the digital realm is rarely instantly popular. It’s usually more ‘slow burn’ acceptance.
But there’s no consumer-friendly logic to this one. (And the slow burn going on here involves the user being cast in the role of the metaphorical frog.)
Instead, Google is just making it harder for web users to click on the page they’re actually looking for — because, from a revenue-generating perspective, it prefers them to click an ad.
It’s the visual equivalent of a supermarket putting a similarly packaged own-brand right next to some fancy branded shampoo on the shelf — in the hopes a rushed shopper will pluck the wrong one. (Real life dark patterns are indeed a thing.)
It’s also a handy illustration of quite how far away from the user Google’s priorities have shifted, and continue to drift.
“When Google introduced ads, they were clearly marked with a label and a brightly tinted box,” says UX specialist Harry Brignull. “This was in stark contrast to all the other search engines at the time, who were trying to blend paid listings in amongst the organic ones, in an effort to drive clicks and revenue. In those days, Google came across as the most honest search engine on the planet.”
Brignull is well qualified to comment on dark patterns — having been calling out deceptive design since 2010 when he founded darkpatterns.org.
“I first learned about Google in the late 1990s. In those days you learned about the web by reading print magazines, which is charmingly quaint to look back on. I picked up a copy of Wired Magazine and there it was – a sidebar talking about a new search engine called ‘Google’,” he recalled. “Google was amazing. In an era of portals, flash banners and link directories, it went in the opposite direction. It didn’t care about the daft games the other search engines were playing. It didn’t even seem to acknowledge they existed. It didn’t even seem to want to be a business. It was a feat of engineering, and it felt like a public utility.
“The original Google homepage was recognised a guiding light of purism in digital design. Search was provided by an unstyled text field and button. There was nothing else on the homepage. Just the logo. Search results were near-instant and they were just a page of links and summaries – perfection with nothing to add or take away. The back-propagation algorithm they introduced had never been used to index the web before, and it instantly left the competition in the dust. It was proof that engineers could disrupt the rules of the web without needing any suit-wearing executives. Strip out all the crap. Do one thing and do it well.”
“As Google’s ambitions changed, the tinted box started to fade. It’s completely gone now,” Brignull added.
The one thing Google very clearly wants to do well now is serve more ads. It’s chosen to do that deceptively, by steadily — and consistently — degrading the user experience. So a far cry from “public utility”.
And that user-friendly Google of old? Yep, also completely gone.

i have a chinese movie recommendation in case you want something to cry over. i still love its ost and it's been months since i watched it. i'm not sure if you watched it already but more than blue. i've never cried over a movie as much as i cried for that one. the angst *chef's kiss*. i'd do anything to wipe my memory of it and watch it again for the first time.
also sungchan is mc-ing in inkigayo every sunday! and honestly, what the hell is nct hollywood :D but a part of me thinks it's just going to be a bunch of asians living in america like johnny that'll be a part of it. just a hunch tho. imagine having all 4 units coming back in a year with like 1 unit per quarter of the year. i'm not sure if sm even has the money to do this, especially when they filed bankruptcy recently.

the mall didn't burn down entirely (like from the outside it looked fine). the ventilation system caught fire so it was more internal—ceilings and all that. covered things with soot(?) and ashes so the entire mall was closed for nearly 2 years. and hey, i've experienced a school fire too back when i was younger. i, too, thought it was nothing but a fire drill until i saw the charred remains of the buildings behind our school : D thankfully, no one died.
the new nct track is for a samsung commercial AHAHA it's funny because nearly everyone uses apple TT_TT and the mv screams neo culture tech tho (well as it should lmao). yes, i was talking about that part in hot sauce but yes, it grew on me too.
ateez really know how to do a performance. they put the standard so high for me when it came to performing. their facial expressions and overall stage presence just impresses me. it's been a while since i've seen idols draw me to them by those standards.

YES, A PATTERN IN THE BIASES (if you count an analysis of two ppl as a pattern, that is.) because it's the same pattern i have for my biaswreckers :D jake & seungmin, not only do they have the same animal to represent them, they have the same 'golden retriever' type of personality that just makes you go all soft. ygwim ;n; i wish i could elaborate but both boys just devastate me in the same level and my friends pointed out that they were quite similar in some aspects.

ugh omg yeah shotaros talent is seriously being wasted in the basement right now. as for fires, scary T-T i wasnt that fazed by them until the australia wildfires happened, and i learned about the consequences of fire and got really scared. its good that the entire mall didnt burn down though! although its weird that no one is opening it :( schools really need to tell us the difference between drills though, it might be dangerous for those rebellious kids.

oh yeah im not an atiny but i have acknowledged since 2020 that they have one of the best, if not the best stage presence and expressions on stage for 4th gen. i think their only worthy competitor would be stray kids actually. theyre truly one of a kind and all of them are cute especially that yeosang guy. i will definitely check out your song recommendations though!
oof the pd48 scandal is extremely complicated. to condense it in a few statements: all of the girls' rankings have been rigged since the very beginning and it was rumored that they already had their end group before the show even started. it was like this for pf48 and pdx101 (group x1) which was why x1 disbanded within a month of debuting, and izone were on hiatus for like 4 months. im not the best at explaining stuff like this haha, but i think you get it. you can check out yt or search up 'pd48 scandal', a ton of articles and videos. as for new groups, nothing has been made clear yet. theyve only made instagram handles for now and appeared on variety shows haha. as for acting career, hyewon was supposed to do acting but was forced to join pd48 so maybe she'll continue acting afterwards? nothing is confirmed yet!

Most EU cookie ‘consent’ notices are meaningless or manipulative, study finds
New research into how European consumers interact with the cookie consent mechanisms which have proliferated since a major update to the bloc’s online privacy rules last year casts an unflattering light on widespread manipulation of a system that’s supposed to protect consumer rights.
As Europe’s General Data Protection Regulation (GDPR) came into force in May 2018, bringing in a tough new regime of fines for non-compliance, websites responded by popping up legal disclaimers which signpost visitor tracking activities. Some of these cookie notices even ask for consent to track you.
But many don’t — even now, more than a year later.
The study, which looked at how consumers interact with different designs of cookie pop-ups and how various design choices can nudge and influence people’s privacy choices, also suggests consumers are suffering a degree of confusion about how cookies function, as well as being generally mistrustful of the term ‘cookie’ itself. (With such baked in tricks, who can blame them?)
The researchers conclude that if consent to drop cookies was being collected in a way that’s compliant with the EU’s existing privacy laws only a tiny fraction of consumers would agree to be tracked.
The paper, which we’ve reviewed in draft ahead of publication, is co-authored by academics at Ruhr-University Bochum, Germany, and the University of Michigan in the US — and entitled: (Un)informed Consent: Studying GDPR Consent Notices in the Field.
The researchers ran a number of studies, gathering ~5,000 of cookie notices from screengrabs of leading websites to compile a snapshot (derived from a random sub-sample of 1,000) of the different cookie consent mechanisms in play in order to paint a picture of current implementations.
They also worked with a German ecommerce website over a period of four months to study how more than 82,000 unique visitors to the site interacted with various cookie consent designs which the researchers’ tweaked in order to explore how different defaults and design choices affected individuals’ privacy choices.
Their industry snapshot of cookie consent notices found that the majority are placed at the bottom of the screen (58%); not blocking the interaction with the website (93%); and offering no options other than a confirmation button that does not do anything (86%). So no choice at all then.
A majority also try to nudge users towards consenting (57%) — such as by using ‘dark pattern’ techniques like using a color to highlight the ‘agree’ button (which if clicked accepts privacy-unfriendly defaults) vs displaying a much less visible link to ‘more options’ so that pro-privacy choices are buried off screen.
And while they found that nearly all cookie notices (92%) contained a link to the site’s privacy policy, only a third (39%) mention the specific purpose of the data collection or who can access the data (21%).
The GDPR updated the EU’s long-standing digital privacy framework, with key additions including tightening the rules around consent as a legal basis for processing people’s data — which the regulation says must be specific (purpose limited), informed and freely given for consent to be valid.
Even so, since May last year there has been an outgrown in cookie ‘consent’ mechanisms popping up or sliding atop websites that still don’t offer EU visitors the necessary privacy choices, per the research.
“Given the legal requirements for explicit, informed consent, it is obvious that the vast majority of cookie consent notices are not compliant with European privacy law,” the researchers argue.
“Our results show that a reasonable amount of users are willing to engage with consent notices, especially those who want to opt out or do not want to opt in. Unfortunately, current implementations do not respect this and the large majority offers no meaningful choice.”
The researchers also record a large differential in interaction rates with consent notices — of between 5 and 55% — generated by tweaking positions, options, and presets on cookie notices.
This is where consent gets manipulated — to flip visitors’ preference for privacy.
They found that the more choices offered in a cookie notice, the more likely visitors were to decline the use of cookies. (Which is an interesting finding in light of the vendor laundry lists frequently baked into the so-called “transparency and consent framework” which the industry association, the Internet Advertising Bureau (IAB), has pushed as the standard for its members to use to gather GDPR consents.)
“The results show that nudges and pre-selection had a high impact on user decisions, confirming previous work,” the researchers write. “It also shows that the GDPR requirement of privacy by default should be enforced to make sure that consent notices collect explicit consent.”
Here’s a section from the paper discussing what they describe as “the strong impact of nudges and pre-selections”:
Overall the effect size between nudging (as a binary factor) and choice was CV=0.50. For example, in the rather simple case of notices that only asked users to confirm that they will be tracked, more users clicked the “Accept” button in the nudge condition, where it was highlighted (50.8% on mobile, 26.9% on desktop), than in the non-nudging condition where “Accept” was displayed as a text link (39.2% m, 21.1% d). The effect was most visible for the category-and vendor-based notices, where all checkboxes were pre-selected in the nudging condition, while they were not in the privacy-by-default version. On the one hand, the pre-selected versions led around 30% of mobile users and 10% of desktop users to accept all third parties. On the other hand, only a small fraction (< 0.1%) allowed all third parties when given the opt-in choice and around 1 to 4 percent allowed one or more third parties (labeled “other” in 4). None of the visitors with a desktop allowed all categories. Interestingly, the number of non-interacting users was highest on average for the vendor-based condition, although it took up the largest part of any screen since it offered six options to choose from.
The key implication is that just 0.1% of site visitors would freely choose to enable all cookie categories/vendors — i.e. when not being forced to do so by a lack of choice or via nudging with manipulative dark patterns (such as pre-selections).
Rising a fraction, to between 1-4%, who would enable some cookie categories in the same privacy-by-default scenario.
“Our results… indicate that the privacy-by-default and purposed-based consent requirements put forth by the GDPR would require websites to use consent notices that would actually lead to less than 0.1 % of active consent for the use of third parties,” they write in conclusion.
They do flag some limitations with the study, pointing out that the dataset they used that arrived at the 0.1% figure is biased — given the nationality of visitors is not generally representative of public Internet users, as well as the data being generated from a single retail site. But they supplemented their findings with data from a company (Cookiebot) which provides cookie notices as a SaaS — saying its data indicated a higher accept all clicks rate but still only marginally higher: Just 5.6%.
Hence the conclusion that if European web users were given an honest and genuine choice over whether or not they get tracked around the Internet, the overwhelming majority would choose to protect their privacy by rejecting tracking cookies.
This is an important finding because GDPR is unambiguous in stating that if an Internet service is relying on consent as a legal basis to process visitors’ personal data it must obtain consent before processing data (so before a tracking cookie is dropped) — and that consent must be specific, informed and freely given.
Yet, as the study confirms, it really doesn’t take much clicking around the regional Internet to find a gaslighting cookie notice that pops up with a mocking message saying by using this website you’re consenting to your data being processed how the site sees fit — with just a single ‘Ok’ button to affirm your lack of say in the matter.
It’s also all too common to see sites that nudge visitors towards a big brightly colored ‘click here’ button to accept data processing — squirrelling any opt outs into complex sub-menus that can sometimes require hundreds of individual clicks to deny consent per vendor.
You can even find websites that gate their content entirely unless or until a user clicks ‘accept’ — aka a cookie wall. (A practice that has recently attracted regulatory intervention.)
Nor can the current mess of cookie notices be blamed on a lack of specific guidance on what a valid and therefore legal cookie consent looks like. At least not any more. Here, for example, is a myth-busting blog which the UK’s Information Commissioner’s Office (ICO) published last month that’s pretty clear on what can and can’t be done with cookies.
For instance on cookie walls the ICO writes: “Using a blanket approach such as this is unlikely to represent valid consent. Statements such as ‘by continuing to use this website you are agreeing to cookies’ is not valid consent under the higher GDPR standard.” (The regulator goes into more detailed advice here.)
While France’s data watchdog, the CNIL, also published its own detailed guidance last month — if you prefer to digest cookie guidance in the language of love and diplomacy.
(Those of you reading TechCrunch back in January 2018 may also remember this sage plain english advice from our GDPR explainer: “Consent requirements for processing personal data are also considerably strengthened under GDPR — meaning lengthy, inscrutable, pre-ticked T&Cs are likely to be unworkable.” So don’t say we didn’t warn you.)
Nor are Europe’s data protection watchdogs lacking in complaints about improper applications of ‘consent’ to justify processing people’s data.
Indeed, ‘forced consent’ was the substance of a series of linked complaints by the pro-privacy NGO noyb, which targeted T&Cs used by Facebook, WhatsApp, Instagram and Google Android immediately GDPR started being applied in May last year.
While not cookie notice specific, this set of complaints speaks to the same underlying principle — i.e. that EU users must be provided with a specific, informed and free choice when asked to consent to their data being processed. Otherwise the ‘consent’ isn’t valid.
So far Google is the only company to be hit with a penalty as a result of that first wave of consent-related GDPR complaints; France’s data watchdog issued it a $57M fine in January.
But the Irish DPC confirmed to us that three of the 11 open investigations it has into Facebook and its subsidiaries were opened after noyb’s consent-related complaints. (“Each of these investigations are at an advanced stage and we can’t comment any further as these investigations are ongoing,” a spokeswoman told us. So, er, watch that space.)
The problem, where EU cookie consent compliance is concerned, looks to be both a failure of enforcement and a lack of regulatory alignment — the latter as a consequence of the ePrivacy Directive (which most directly concerns cookies) still not being updated, generating confusion (if not outright conflict) with the shiny new GDPR.
However the ICO’s advice on cookies directly addresses claimed inconsistencies between ePrivacy and GDPR, stating plainly that Recital 25 of the former (which states: “Access to specific website content may be made conditional on the well-informed acceptance of a cookie or similar device, if it is used for a legitimate purpose”) does not, in fact, sanction gating your entire website behind an ‘accept or leave’ cookie wall.
Here’s what the ICO says on Recital 25 of the ePrivacy Directive:
‘specific website content’ means that you should not make ‘general access’ subject to conditions requiring users to accept non-essential cookies – you can only limit certain content if the user does not consent;
the term ‘legitimate purpose’ refers to facilitating the provision of an information society service – ie, a service the user explicitly requests. This does not include third parties such as analytics services or online advertising;
So no cookie wall; and no partial walls that force a user to agree to ad targeting in order to access the content.
It’s worth point out that other types of privacy-friendly online advertising are available with which to monetize visits to a website. (And research suggests targeted ads offer only a tiny premium over non-targeted ads, even as publishers choosing a privacy-hostile ads path must now factor in the costs of data protection compliance to their calculations — as well as the cost and risk of massive GDPR fines if their security fails or they’re found to have violated the law.)
Negotiations to replace the now very long-in-the-tooth ePrivacy Directive — with an up-to-date ePrivacy Regulation which properly takes account of the proliferation of Internet messaging and all the ad tracking techs that have sprung up in the interim — are the subject of very intense lobbying, including from the adtech industry desperate to keep a hold of cookie data. But EU privacy law is clear.
“[Cookie consent]’s definitely broken (and has been for a while). But the GDPR is only partly to blame, it was not intended to fix this specific problem. The uncertainty of the current situation is caused the delay of the ePrivacy regulation that was put on hold (thanks to lobbying),” says Martin Degeling, one of the research paper’s co-authors, when we suggest European Internet users are being subject to a lot of ‘consent theatre’ (ie noisy yet non-compliant cookie notices) — which in turn is causing knock-on problems of consumer mistrust and consent fatigue for all these useless pop-ups. Which work against the core aims of the EU’s data protection framework.
“Consent fatigue and mistrust is definitely a problem,” he agrees. “Users that have experienced that clicking ‘decline’ will likely prevent them from using a site are likely to click ‘accept’ on any other site just because of one bad experience and regardless of what they actually want (which is in most cases: not be tracked).”
“We don’t have strong statistical evidence for that but users reported this in the survey,” he adds, citing a poll the researchers also ran asking site visitors about their privacy choices and general views on cookies. 
Degeling says he and his co-authors are in favor of a consent mechanism that would enable web users to specify their choice at a browser level — rather than the current mess and chaos of perpetual, confusing and often non-compliant per site pop-ups. Although he points out some caveats.
“DNT [Do Not Track] is probably also not GDPR compliant as it only knows one purpose. Nevertheless  something similar would be great,” he tells us. “But I’m not sure if shifting the responsibility to browser vendors to design an interface through which they can obtain consent will lead to the best results for users — the interfaces that we see now, e.g. with regard to cookies, are not a good solution either.
“And the conflict of interest for Google with Chrome are obvious.”
The EU’s unfortunate regulatory snafu around privacy — in that it now has one modernized, world-class privacy regulation butting up against an outdated directive (whose progress keeps being blocked by vested interests intent on being able to continue steamrollering consumer privacy) — likely goes some way to explaining why Member States’ data watchdogs have generally been loath, so far, to show their teeth where the specific issue of cookie consent is concerned.
At least for an initial period the hope among data protection agencies (DPAs) was likely that ePrivacy would be updated and so they should wait and see.
They have also undoubtedly been providing data processors with time to get their data houses and cookie consents in order. But the frictionless interregnum while GDPR was allowed to ‘bed in’ looks unlikely to last much longer.
Firstly because a law that’s not enforced isn’t worth the paper it’s written on (and EU fundamental rights are a lot older than the GDPR). Secondly, with the ePrivacy update still blocked DPAs have demonstrated they’re not just going to sit on their hands and watch privacy rights be rolled back — hence them putting out guidance that clarifies what GDPR means for cookies. They’re drawing lines in the sand, rather than waiting for ePrivacy to do it (which also guards against the latter being used by lobbyists as a vehicle to try to attack and water down GDPR).
And, thirdly, Europe’s political institutions and policymakers have been dining out on the geopolitical attention their shiny privacy framework (GDPR) has attained.
Much has been made at the highest levels in Europe of being able to point to US counterparts, caught on the hop by ongoing tech privacy and security scandals, while EU policymakers savor the schadenfreude of seeing their US counterparts being forced to ask publicly whether it’s time for America to have its own GDPR.
With its extraterritorial scope, GDPR was always intended to stamp Europe’s rule-making prowess on the global map. EU lawmakers will feel they can comfortably check that box.
However they are also aware the world is watching closely and critically — which makes enforcement a very key piece. It must slot in too. They need the GDPR to work on paper and be seen to be working in practice.
So the current cookie mess is a problematic signal which risks signposting regulatory failure — and that simply isn’t sustainable.
A spokesperson for the European Commission told us it cannot comment on specific research but said: “The protection of personal data is a fundamental right in the European Union and a topic the Juncker commission takes very seriously.”
“The GDPR strengthens the rights of individuals to be in control of the processing of personal data, it reinforces the transparency requirements in particular on the information that is crucial for the individual to make a choice, so that consent is given freely, specific and informed,” the spokesperson added. 
“Cookies, insofar as they are used to identify users, qualify as personal data and are therefore subject to the GDPR. Companies do have a right to process their users’ data as long as they receive consent or if they have a legitimate interest.”
All of which suggests that the movement, when it comes, must come from a reforming adtech industry.
With robust privacy regulation in place the writing is now on the wall for unfettered tracking of Internet users for the kind of high velocity, real-time trading of people’s eyeballs that the ad industry engineered for itself when no one knew what was being done with people’s data.
GDPR has already brought greater transparency. Once Europeans are no longer forced to trade away their privacy it’s clear they’ll vote with their clicks not to be ad-stalked around the Internet too.
The current chaos of non-compliant cookie notices is thus a signpost pointing at an underlying privacy lag — and likely also the last gasp signage of digital business models well past their sell-by-date.
