Son killed in collision with semitruck in ’21; final judgment to come

An upcoming hearing could decide whether a Dallas County jury’s award of nearly $4 million for the family of a motorist killed after hitting an 18-wheeler stopped on an interstate will be upheld.

Jurors in June awarded the family of a man killed in the 2021 crash $3.6 million, after the jury found the negligence of a North Texas-based trucking company and a truck driver primarily caused the collision.

According to court records, Robert Buntyn, 24, was killed just after 10 p.m. Sept. 2, 2021, while driving home from his family’s business.

His vehicle crashed into the back of a tractor-trailer on Interstate 635, near the State Highway 121 interchange.

A mechanical issue caused the truck to stop in the middle of the highway, and the driver did not deploy any flares or triangles to warn oncoming drivers, a lawsuit filed on behalf of Buntyn’s family alleges.

Dara Harris, Buntyn’s mother, told The Dallas Morning News on Wednesday that the years following Buntyn’s death have been devastating for her family.

She described her son as a person who loved traveling and living life to the fullest.

Harris said Buntyn, a graduate of Central High School in Keller, enjoyed playing multiple sports and had many friends from school.

“He loved people, he loved life,�� Harris said in a phone interview. “He was a great person. Very missed by friends and family.”

Despite the trial and jury verdict, a final judgment has not been entered in the case, according to court records.

Attorneys for the trucking company have motioned for a judgment non obstante verdicto — or “notwithstanding the veridict,” per Cornell Law — to be entered, which could negate the jury verdict.

Attorneys for Buntyn’s parents have motioned for the jury verdict to be entered as the final judgment.

Few initial details

A final hearing in the case has been scheduled for Aug. 16.

The wrongful death lawsuit was first filed in December 2021 by Buntyn’s parents and asked for damages no less than $1 million.

The petition was filed against Newkirk Logistics, a Grapevine-based trucking and transportation company, and Desiree Boyd, a former Newkirk employee who was driving the semitrailer involved in the fatal crash.

Harris said she and her ex-husband decided to file after initially getting few details about the collision.

She said she wanted to know the full story about what happened to her son, especially after she heard the semi truck had been stopped on the highway for several minutes prior to the collision.

The lawsuit alleged Boyd allowed the tractor-trailer to stop in the middle of the highway and did not deploy flares or triangles to warn oncoming vehicles.

The suit alleged that Newkirk did not properly nor adequately train Boyd on safe practices for stopping the truck on a highway.

Court documents show Boyd testified that the air brake system in the 18-wheeler began losing pressure, and that she stopped in a middle lane on the highway.

A photo submitted as evidence in the trial showed a disconnected brake line on the tractor-trailer.

Fired after accident

According to Boyd’s testimony, the crash occurred roughly five minutes after the truck stopped, while Boyd was on the phone with her boss trying to figure out what to do.

Boyd said she did not have flares in the truck and did have triangle cones, but did not have enough time to deploy them before the crash, according to court documents.

Boyd testified she was fired from Newkirk the same month as the accident.

In a jury charge submitted June 13, the jury found Newkirk 50% liable for the crash, Boyd 40% responsible and Buntyn 10% responsible.

The jury awarded Buntyn’s parents a total of $3.6 million, court documents show.

Harris described the trial process as “torturous.”

She said the family first tried to mediate the case and settle out of court, but was only given an offer of $17,000, far less than the $1 million the family first asked for.

Despite the hard trial process, Harris said she is glad she and her ex-husband fought through the trial and said she is thankful it will soon be coming to a close.

“They ran across the wrong family,” Harris said.

Buntyn’s parents were represented by Malorie Peacock, a San Antonio-based attorney who specializes in trucking accident lawsuits.

Attorneys representing Newkirk and Boyd did not respond to an emailed request for comment.

Boyd declined comment when contacted by The Dallas Morning News .

Under the Brookshire Brothers framework, “to find that spoliation occurred, the trial court must make affirmative determinations as to two elements.

• First, the party who failed to produce evidence must have had a duty to preserve the evidence.” Id. (citing Brookshz're, 438 S.W.3d at 20).

• “Second, the nonproducing party must have breached its duty to reasonably preserve material and relevant evidence.” Id. (citing Brookshire, 438 S.W.3d at 20-21 & n.8).

If there is a finding of spoliation, “the trial court must exercise its discretion in imposing a remedy. In determining what remedy, if any, is appropriate, the court should weigh the spoliating party’s culpability and the prejudice to the non-spoliating party.” Id. at 488-89.

“[C]ourts generally follow a two-part test in determining whether a particular sanction for discovery abuse is just.” Petroleum Solutions, 454 S.W.3d at 489.

• “First, a direct relationship must exist between the offensive conduct, the offender, and the sanction imposed. To meet this requirement, a sanction must be directed against the wrongful conduct and toward remedying the prejudice suffered by the innocent party.” Id. (internal citations omitted).

• “Second, a sanction must not be excessive, which means it should be no more severe than necessary to satisfy its legitimate purpose. Id. (internal citations and quotation omitted).

Spoliation of Evidence

Plaintiffs met their burden of establishing that the individual defendants intentionally destroyed or failed to preserve potentially relevant evidence despite being aware of either actual litigation or the possibility of future litigation.

We granted plaintiffs’ Motion for adverse inference.

This case involved a hotly litigated series of disputes between an insurance agency, one of its competitors, and a group of employees who left the agency to join its competitor.

In a nutshell, the agency primarily contended that its former employees unlawfully used its confidential information and trade secrets to solicit employees and clients for the benefit of the competitor—their new employer.

In addition, the agency asserted that the former employees intentionally destroyed evidence relevant to this lawsuit.

The former employees, in turn, claimed that the agency failed to pay them the correct amount of wages they had earned.

Among other things, plaintiffs asserted the following claims:

four breach of contract claims—one against the former employees for breach of confidentiality provisions in their employment agreements;

two against the Former Employees for breach of non-solicitation clauses in their employment agreements;

and one against the Pilot Defendants for breach of a Settlement Agreement;

two misappropriation of trade secrets claims against all defendants—one under the Federal Defend Trade Secrets Act, and one under the North Carolina Trade Secrets Protection Act;

and an unjust enrichment claim against all defendants.

Plaintiffs argued that each individual defendant spoliated evidence and, as a result, “an adverse inference should be drawn against defendants when considering their motion for summary judgment and at trial.”

The evidence supports plaintiff insurer’s contention that the individual defendants intentionally destroyed or failed to preserve potentially relevant materials while aware of the possibility of future litigation.

Therefore, given the mass of deleted text messages and emails, as well as the circumstances in which such deletions occurred, it may be inferred that the deleted documents were harmful to defendants.

Accordingly, plaintiffs met their burden of establishing that the individual defendants intentionally destroyed or failed to preserve potentially relevant evidence despite being aware of either actual litigation or the possibility of future litigation.

Defendants argued that summary judgment in their favor is appropriate on all claims brought against them by plaintiff insurer, which claimed that each defendant misappropriated its trade secrets in violation of both the federal Defend Trade Secrets Act and the North Carolina Trade Secrets Protection Act.

We held that plaintiff has put forth sufficient evidence from which a jury could find that its security measures were reasonable and adequate to protect its trade secrets.

Next, defendants contended that, even if any of the documents at issue could be properly classified as trade secrets, plaintiffs have put forth no actual evidence of misappropriation.

Plaintiff insurer failed to put forth sufficient evidence from which a jury could reasonably find misappropriation on the part of individual defendant Crooker.

Nor is there adequate evidence of any other individual defendant’s misappropriation of Crooker’s Production Analysis. Therefore, defendants’ motion for partial summary judgment regarding plaintiff’s trade secrets claim is granted in part and denied in part.

Summary judgment on this claim is granted as to all of the former employees, except for King, Lancaster, and Linthicum.

As to those three, summary judgment is denied.

The four documents that the jury may consider at trial as potential trade secrets are King’s Carrier Contact List, Linthicum’s Net Rate Calculations Spreadsheet, Lancaster’s Production Analysis, and Lancaster’s Production Report.

Finally, the former employees sought summary judgment on plaintiff’s claims for breach of the non-solicitation provisions in their respective employment agreements, arguing that the “unenforceability of the Non-Solicitation provisions is established as a matter of law” because the provisions are “legally overbroad.”

We held that the Non-Solicitation Clauses in the Employment Agreements here are unenforceable as a matter of law.

Therefore, defendants are entitled to summary judgment on plaintiff’s claims for breach of the Non-Solicitation Clauses contained in the former employees’ Employment Agreements.

Granted in part and denied in part.
