As national legislation on deepfake pornography crawls its way through Congress, states across the country are trying to take matters into their own hands. Thirty-nine states have introduced a hodgepodge of laws designed to deter the creation of nonconsensual deepfakes and punish those who make and share them.

Earlier this year, Democratic congresswoman Alexandria Ocasio-Cortez, herself a victim of nonconsensual deepfakes, introduced the Disrupt Explicit Forged Images and Non-Consensual Edits Act, or Defiance Act. If passed, the bill would allow victims of deepfake pornography to sue as long as they could prove the deepfakes had been made without their consent. In June, Republican senator Ted Cruz introduced the Take It Down Act, which would require platforms to remove both revenge porn and nonconsensual deepfake porn.

Though there’s bilateral support for many of these measures, federal legislation can take years to make it through both houses of Congress before being signed into law. But state legislatures and local politicians can move faster—and they’re trying to.

Last month, San Francisco City Attorney David Chiu’s office announced a lawsuit against 16 of the most visited websites that allow users to create AI-generated pornography. “Generative AI has enormous promise, but as with all new technologies, there are unintended consequences and criminals seeking to exploit the new technology. We have to be very clear that this is not innovation—this is sexual abuse,” Chiu said in a statement released by his office at the time.

The suit was just the latest attempt to try to curtail the ever-growing issue of nonconsensual deepfake pornography.

“I think there's a misconception that it's just celebrities that are being affected by this,” says Ilana Beller, organizing manager at Public Citizen, which has been tracking nonconsensual deepfake legislation and shared their findings with WIRED. “It's a lot of everyday people who are having this experience.”

Data from Public Citizen shows that 23 states have passed some form of nonconsensual deepfake law. “This is such a pervasive issue, and so state legislators are seeing this as a problem,” says Beller. “I also think that legislators are interested in passing AI legislation right now because we are seeing how fast the technology is developing.”

Last year, WIRED reported that deepfake pornography is only increasing, and researchers estimate that 90 percent of deepfake videos are of porn, the vast majority of which is nonconsensual porn of women. But despite how pervasive the issue is, Kaylee Williams, a researcher at Columbia University who has been tracking nonconsensual deepfake legislation, says she has seen legislators more focused on political deepfakes.

“More states are interested in protecting electoral integrity in that way than they are in dealing with the intimate image question,” she says.

Matthew Bierlein, a Republican state representative in Michigan, who cosponsored the state’s package of nonconsensual deepfake bills, says that he initially came to the issue after exploring legislation on political deepfakes. “Our plan was to make [political deepfakes] a campaign finance violation if you didn’t put disclaimers on them to notify the public.” Through his work on political deepfakes, Bierlein says, he began working with Democratic representative Penelope Tsernoglou, who helped spearhead the nonconsensual deepfake bills.

At the time in January, nonconsensual deepfakes of Taylor Swift had just gone viral, and the subject was widely covered in the news. “We thought that the opportunity was the right time to be able to do something,” Beirlein says. And Beirlein says that he felt Michigan was in the position to be a regional leader in the Midwest, because, unlike some of its neighbors, it has a full-time legislature with well-paid staffers (most states don’t). “We understand that it's a bigger issue than just a Michigan issue. But a lot of things can start at the state level,” he says. “If we get this done, then maybe Ohio adopts this in their legislative session, maybe Indiana adopts something similar, or Illinois, and that can make enforcement easier.”

But what the penalties for creating and sharing nonconsensual deepfakes are—and who is protected—can vary widely from state to state. “The US landscape is just wildly inconsistent on this issue,” says Williams. “I think there's been this misconception lately that all these laws are being passed all over the country. I think what people are seeing is that there have been a lot of laws proposed.”

Some states allow for civil and criminal cases to be brought against perpetrators, while others might only provide for one of the two. Laws like the one that recently took effect in Mississippi, for instance, focus on minors. Over the past year or so, there have been a spate of instances of middle and high schoolers using generative AI to make explicit images and videos of classmates, particularly girls. Other laws focus on adults, with legislators essentially updating existing laws banning revenge porn.

Unlike laws that focus on nonconsensual deepfakes of minors, on which Williams says there is a broad consensus that there they are an “inherent moral wrong,” legislation around what is “ethical” when it comes to nonconsensual deepfakes of adults is “squishier.” In many cases, laws and proposed legislation require proving intent, that the goal of the person making and sharing the nonconsensual deepfake was to harm its subject.

But online, says Sara Jodka, an attorney who specializes in privacy and cybersecurity, this patchwork of state-based legislation can be particularly difficult. “If you can't find a person behind an IP address, how can you prove who the person is, let alone show their intent?”

Williams also notes that in the case of nonconsensual deepfakes of celebrities or other public figures, many of the creators don’t necessarily see themselves as doing harm. “They’ll say, ‘This is fan content,’ that they admire this person and are attracted to them,” she says.

State laws, Jobka says, while a good start, are likely to have limited power to actually deal with the issue, and only a federal law against nonconsensual deepfakes would allow for the kind of interstate investigations and prosecutions that could really force justice and accountability. “States don't really have a lot of ability to track down across state lines internationally,” she says. “So it's going to be very rare, and it's going to be very specific scenarios where the laws are going to be able to even be enforced.”

But Michigan’s Bierlein says that many state representatives are not content to wait for the federal government to address the issue. Bierlein expressed particular concern about the role nonconsensual deepfakes could play in sextortion scams, which the FBI says have been on the rise. In 2023, a Michigan teen died by suicide after scammers threatened to post his (real) intimate photos online. “Things move really slow on a federal level, and if we waited for them to do something, we could be waiting a lot longer,” he says.

In the following days, as Kalli seems to disappear from the face of the earth, Cass and Ari’s bond grows, unearthing Cass’ long repressed memories of their own tumultuous childhood. In advance of the film’s SXSW premiere, we connected with cinematographer Lucia Zavarcikova, ASK, to discuss the process of making “Outerlands,” from how to best manage stress on set, to shooting over 35 locations on an indie budget.

"Outerlands" was filmed with the Sony Venice and Rialto. What drew you to this combination and camera platform? I was looking for a camera that can perform well in low light scenarios and can be versatile when it comes to mounting it various places. With over 35 locations in 'Outerlands,' San Francisco itself became a character in the film, and I knew I wouldn’t always have full control over lighting conditions. The Venice allowed us to capture our characters authentically in the streets, where our schedule didn’t permit extensive lighting setups. Rialto on the other hand, gave us the ability to achieve specific shots we planned in tight spaces. One instance that stands out is a handheld sequence set in a bathroom stall at an arcade—a pivotal and vulnerable scene. The Rialto allowed my camera operator, Dae Hyun Kim, to stay engaged with the performances while giving the actors freedom to move naturally.

You shot with the GL Optics Canon FD primes. What led you to choose these lenses specifically? I needed lenses that cover a large sensor, are fast and have a certain “nostalgic” quality —something that was an essential visual component of our film. That, in combination with some budget restraints meant that FDs were a clear winner after many rounds of testing.

When it comes to your experience making "Outerlands" in particular, how did working with Keslow Camera help bring the film to life? Were there any challenges during the production that Keslow was able to alleviate? Working with Keslow Camera is always a fantastic experience, and 'Outerlands' was no exception. Given our tight budget and the need for extensive testing before shooting, Keslow provided us with the camera package nearly two weeks in advance. This was crucial for fine-tuning our approach. A great example of this was the period-accurate CRT TV, an important visual element reflecting the protagonist’s childhood video game, Outerlands. Having the camera early allowed us to test how it would be captured on screen. Additionally, our main apartment set was a mix of a real location and a build, requiring careful consideration of color and texture. Having access to the Venice and the FDs early on helped our production design team, led by Jamie Mayne, refine elements like wall colors and curtain types, ensuring they looked in sync with the emotional arc of the main character on camera.

Is there anything about the experience of making "Outerlands" that has impacted your creative process going forward? Absolutely. Every movie has been a huge lesson learning experience for me so I’m grateful for the diversity of problems I’ve faced that has allowed me to improve. The biggest challenge was the sheer number of locations we had to cover in a limited timeframe. To stay efficient, we had to refine our setup and pack-up process significantly. My incredible camera team—Steadicam/camera operator Dae Hyun Kim, 1st AC Lawrence Ma, 2nd AC Leo Lopez, and DIT Alex Zajicek—was instrumental in keeping everything running smoothly and ensuring we were always ready to go very fast.

What advice would you give to aspiring cinematographers who are inspired by your work? When it comes to things that would have been helpful to hear earlier in my career, I always like to think of my long time mentor and friend Steve Condiotti, who’s many pieces of advice helped me to embrace difficult situations and focus on what’s really important. One day I called him on the way to set for my first bigger commercial job that I was very stressed about and felt myself teetering on the edge of panic because of everything that could go wrong. I started rapid firing my thoughts and he stopped me and said “Lucy, this is our job.” It might seem a bit silly but that one sentence has literally changed my approach from thinking “if I had more time” or “if I had better gear” to adapting to the limitations and focusing on what’s in front of me. So if I had to distill it to one sentence, it would be to embrace the circumstances and focus on what’s important - the images we create.

Are there any members of the "Outerlands" camera department or production team in general you’d like to acknowledge for their contributions to the project? I’m very grateful that Elena Oxman, the writer/director of 'Outerlands' invited me to help bring this beautiful story to life. Ever since I first read the script, I knew that I had something very special in my hands and I couldn’t be more excited that I got to work with Elena. I’d also love to give a huge thank you to my long term collaborators and friends, gaffer Matthew Barauskas and "A" steadicam/camera operator Dae Hyun Kim, who always bring their expertise, creative approach and upbeat energy to any project we do together. People say that the DP is only as strong as their team and I couldn’t agree more, none of this would be possible without the great team that poured their heart and energy into creating 'Outerlands.'

A group of Northern California residents has filed a class-action lawsuit against their congressional representatives, Democrats Mike Thompson and Jared Huffman, accusing them of causing harm to local communities and to Palestinians in Gaza by voting to send billions in U.S. military aid to Israel.

The lawsuit, filed Thursday in San Francisco federal court, claims the lawmakers caused “moral and emotional/psychic injury” to taxpayers by voting for aid that, the plaintiffs allege, contributes to genocide in Gaza. Both Israel and the Biden administration reject that Israel is committing genocide in its war against Hamas in Gaza.

The lawsuit is the latest example of how debates over Israel and Gaza have moved to the courts since the outbreak of the war following Hamas’ Oct. 7, 2023, attack. Several months ago, federal courts dismissed a lawsuit by pro-Palestinian groups, also filed in the Bay Area, accusing the Biden administration of complicity in a genocide. A federal appeals court panel confirmed a ruling by a lower court that the judiciary cannot intervene to change the government’s foreign policy.

Survivors of the Oct. 7 attack and Jewish groups have filed a series of suits over the attack against pro-Palestinian nonprofits, the United Nations’ Palestinian aid agency UNRWA and foreign governments allied with Hamas. In addition, Jewish students have filed suit against multiple universities accusing them of not taking sufficient measures against antisemitism on campus. 

The Bay Area case seeks to bar Thompson and Huffman from approving future military aid to Israel and demands damages for the emotional distress caused by war, including “uncontrollable weeping, inability to sleep, distractions from work, despair for the future of their children and humanity.”

At a press conference outside the courthouse where the lawsuit was filed, Linda Helland, a Mendocino County resident and plaintiff, said the representatives’ votes make her and other constituents “complicit” in the violence. Another plaintiff, Palestinian American Tarik Kanaana of Sonoma County, said Thompson’s actions amounted to aiding in “the killing of my own people.”

Twenty one plaintiffs are named in the lawsuit but organizers are aiming to add as many as 1,000 participants if the court allows the lawsuit to proceed. A lawyer for the plaintiffs said the lawsuit, with its focus on the rights of taxpayers, was designed differently than the one that was tossed out.

“We’re not asking the court to tell Congress to make policy,” attorney Dean Royer told the Chronicle. “We’re asking the court to say taxpayer dollars cannot be used to fund genocide.”

The positions of Thompson and Huffman reflect those of many Democratic lawmakers who back Israel’s right to defend itself from Hamas, but have called for minimizing civilian casualties. In April, they voted in favor of a $26.4 billion military aid package for Israel. Thompson and Huffman have also expressed support for a ceasefire and long-term solutions, including a two-state framework that would see a Palestinian state established alongside Israel. 

“Congressman Thompson understands that it has been the civilian population that has paid the cost of Hamas’ terrorist attack on Israel and he remains gravely concerned about the scale of civilian loss in this war,” read a statement from the congressman’s office to local media. “That’s why he has advocated and continues to advocate for the Biden Administration to work with the State Department and our allies to help secure a negotiated bilateral ceasefire, the immediate release of all hostages, and the establishment of a two-state solution to ensure peace and self-determination for the Palestinian and Israeli people.”

Countries shore up their digital defenses as global tensions raise the threat of cyberwarfare (AP) Hackers linked to Russia’s government launched a cyberattack last spring against municipal water plants in rural Texas. At one plant in Muleshoe, population 5,000, water began to overflow. Officials had to unplug the system and run the plant manually. The hackers weren’t trying to taint the water supply. They didn’t ask for a ransom. Authorities determined the intrusion was designed to test the vulnerabilities of America’s public infrastructure. It was also a warning: In the 21st century, it takes more than oceans and an army to keep the United States safe. A year later, countries around the world are preparing for greater digital conflict as increasing global tensions and a looming trade war have raised the stakes—and the chances that a cyberattack could cause significant economic damage, disrupt vital public systems, reveal sensitive business or government secrets, or even escalate into military confrontation.

U.S. intelligence contradicts justification for mass deportations (Washington Post) The National Intelligence Council, drawing on the acumen of the United States’ 18 intelligence agencies, determined in a secret assessment early this month that the Venezuelan government is not directing an invasion of the United States by the prison gang Tren de Aragua, a judgment that contradicts President Donald Trump’s public statements, according to people familiar with the matter. The determination is the U.S. government’s most comprehensive assessment to date undercutting Trump’s rationale for deporting suspected gang members without due process under the Alien Enemies Act, the 1798 law last used during World War II that laid the foundation for the incarceration of more than 110,000 Japanese Americans.

Drones pose increasing risk to airliners near major US airports (AP) A commercial airliner was on final approach to San Francisco’s international airport in November when the crew spotted a drone outside the cockpit window. By then it was too late “to take evasive action,” the pilots reported, and the quadcopter passed by their windshield, not 300 feet away. A month earlier, a jetliner was flying at an altitude of 4,000 feet near Miami’s international airport when its pilots reported a “close encounter” with a drone. In August, a drone came within 50 feet of clipping the left wing of a passenger jet as it departed Newark International Airport. An Associated Press analysis of an aviation safety database reveals that drones last year accounted for nearly two-thirds of reported near midair collisions involving commercial passenger planes taking off and landing at the country’s top 30 busiest airports. The FAA estimates that Americans are operating more than a million drones for recreational and commercial purposes.
