Cars bricked by bankrupt EV company will stay bricked

There are few phrases in the modern lexicon more accursed than "software-based car," and yet, this is how the failed EV maker Fisker billed its products, which retailed for $40-70k in the few short years before the company collapsed, shut down its servers, and degraded all those "software-based cars":

Fisker billed itself as a "capital light" manufacturer, meaning that it didn't particularly make anything – rather, it "designed" cars that other companies built, allowing Fisker to focus on "experience," which is where the "software-based car" comes in. Virtually every subsystem in a Fisker car needs (or rather, needed) to periodically connect with its servers, either for regular operations or diagnostics and repair, creating frequent problems with brakes, airbags, shifting, battery management, locking and unlocking the doors:

Since Fisker's bankruptcy, people with even minor problems with their Fisker EVs have found themselves owning expensive, inert lumps of conflict minerals and auto-loan debt; as one Fisker owner described it, "It's literally a lawn ornament right now":

This is, in many ways, typical Internet-of-Shit nonsense, but it's compounded by Fisker's capital light, all-outsource model, which led to extremely unreliable vehicles that have been plagued by recalls. The bankrupt company has proposed that vehicle owners should have to pay cash for these recalls, in order to reserve the company's capital for its creditors – a plan that is clearly illegal:

This isn't even the first time Fisker has done this! Ten years ago, founder Henrik Fisker started another EV company called Fisker Automotive, which went bankrupt in 2014, leaving the company's "Karma" (no, really) long-range EVs (which were unreliable and prone to bursting into flames) in limbo:

Which raises the question: why did investors reward Fisker's initial incompetence by piling in for a second attempt? I think the answer lies in the very factor that has made Fisker's failure so hard on its customers: the "software-based car." Investors love the sound of a "software-based car" because they understand that a gadget that is connected to the cloud is ripe for rent-extraction, because with software comes a bundle of "IP rights" that let the company control its customers, critics and competitors:

A "software-based car" gets to mobilize the state to enforce its "IP," which allows it to force its customers to use authorized mechanics (who can, in turn, be price-gouged for licensing and diagnostic tools). "IP" can be used to shut down manufacturers of third party parts. "IP" allows manufacturers to revoke features that came with your car and charge you a monthly subscription fee for them. All sorts of features can be sold as downloadable content, and clawed back when title to the car changes hands, so that the new owners have to buy them again. "Software based cars" are easier to repo, making them perfect for the subprime auto-lending industry. And of course, "software-based cars" can gather much more surveillance data on drivers, which can be sold to sleazy, unregulated data-brokers:

Unsurprisingly, there's a large number of Fisker cars that never sold, which the bankruptcy estate is seeking a buyer for. For a minute there, it looked like they'd found one: American Lease, which was looking to acquire the deadstock Fiskers for use as leased fleet cars. But now that deal seems dead, because no one can figure out how to restart Fisker's servers, and these vehicles are bricks without server access:

It's hard to say why the company's servers are so intransigent, but there's a clue in the chaotic way that the company wound down its affairs. The company's final days sound like a scene from the last days of the German Democratic Republic, with apparats from the failing state charging about in chaos, without any plans for keeping things running:

As it imploded, Fisker cycled through a string of Chief Financial officers, losing track of millions of dollars at a time:

When Fisker's landlord regained possession of its HQ, they found "complete disarray," including improperly stored drums of toxic waste:

And while Fisker's implosion is particularly messy, the fact that it landed in bankruptcy is entirely unexceptional. Most businesses fail (eventually) and most startups fail (quickly). Despite this, businesses – even those in heavily regulated sectors like automotive regulation – are allowed to design products and undertake operations that are not designed to outlast the (likely short-lived) company.
After the 2008 crisis and the collapse of financial institutions like Lehman Brothers, finance regulators acquired a renewed interest in succession planning. Lehman consisted of over 6,000 separate corporate entities, each one representing a bid to evade regulation and/or taxation. Unwinding that complex hairball took years, during which the entities that entrusted Lehman with their funds – pensions, charitable institutions, etc – were unable to access their money.
To avoid repeats of this catastrophe, regulators began to insist that banks produce "living wills" – plans for unwinding their affairs in the event of catastrophe. They had to undertake "stress tests" that simulated a wind-down as planned, both to make sure the plan worked and to estimate how long it would take to execute. Then banks were required to set aside sufficient capital to keep the lights on while the plan ran on.
This regulation has been indifferently enforced. Banks spent the intervening years insisting that they are capable of prudently self-regulating without all this interference, something they continue to insist upon even after the Silicon Valley Bank collapse:

The fact that the rules haven't been enforced tells us nothing about whether the rules would work if they were enforced. A string of high-profile bankruptcies of companies who had no succession plans and whose collapse stands to materially harm large numbers of people tells us that something has to be done about this.
Take 23andme, the creepy genomics company that enticed millions of people into sending them their genetic material (even if you aren't a 23andme customer, they probably have most of your genome, thanks to relatives who sent in cheek-swabs). 23andme is now bankrupt, and its bankruptcy estate is shopping for a buyer who'd like to commercially exploit all that juicy genetic data, even if that is to the detriment of the people it came from. What's more, the bankruptcy estate is refusing to destroy samples from people who want to opt out of this future sale:

On a smaller scale, there's Juicebox, a company that makes EV chargers, who are exiting the North American market and shutting down their servers, killing the advanced functionality that customers paid extra for when they chose a Juicebox product:

I actually owned a Juicebox, which ultimately caught fire and melted down, either due to a manufacturing defect or to the criminal ineptitude of Treeium, the worst solar installers in Southern California (or both):

Projects like Juice Rescue are trying to reverse-engineer the Juicebox server infrastructure and build an alternative:

This would be much simpler if Juicebox's manufacturer, Enel X Way, had been required to file a living will that explained how its customers would go on enjoying their property when and if the company discontinued support, exited the market, or went bankrupt.
That might be a big lift for every little tech startup (though it would be superior than trying to get justice after the company fails). But in regulated sectors like automotive manufacture or genomic analysis, a regulation that says, "Either design your products and services to fail safely, or escrow enough cash to keep the lights on for the duration of an orderly wind-down in the event that you shut down" would be perfectly reasonable. Companies could make "software based cars" but the more "software based" the car was, the more funds they'd have to escrow to transition their servers when they shut down (and the lest capital they'd have to build the car).
Such a rule should be in addition to more muscular rules simply banning the most abusive practices, like the Oregon state Right to Repair bill, which bans the "parts pairing" that makes repairing a Fisker car so onerous:

Failing to take action on these abusive practices is dangerous – and not just to the people who get burned by them. Every time a genomics research project turns into a privacy nightmare, that salts the earth for future medical research, making it much harder to conduct population-scale research, which can be carried out in privacy-preserving ways, and which pays huge scientific dividends that we all benefit from:

Hi! What’s a citizen scientist and how did you get involved with a group that does that? This is the first time I’ve heard of any of that and it sounds so cool
Hi there!
I'd say there's two answers to that, but I'll start with the more relevant kind. There's "layperson recruited by scientist to help with science work" and there's "amateur, self-taught scientist". The overlap is large, but the project I was talking about is one of the world's largest laypersons-scientists collaborative projects.
It's called iNaturalist (getting started page here).
They have a website, apps for iOS and Android, and several layers of help for the new or confused. (*their new app is available on iOS, you want iNat Next. I'm an android user tho). There may even be a dedicated localization team for your country, if you're outside the USA.
I've gladly sunk thousands of hours into iNaturalist between time in nature and time online.
iNaturalist's primary goal is to get people connected with nature, but the core loop for most people is like this:
take a photo (or other recording) of an organism - a bird, a plant, mold, etc. Ideally a wild one, not a pet or garden plant.
upload it to the app. it will have fields asking for additional info, but most of those should auto-fill from the photo metadata.
technically optional but PLEASE fill in "what do you think this is" / the Identification field. give it your best guess. the Computer Vision will give suggestions, or you can say, "I know this is a rose" or "I know this is a mouse".
wait a little. there are a dozen staff to millions of users. everyone else who ever helps you on iNat is an unpaid volunteer so be nice to them.
whoa! someone else has offered their own identification. If you're lucky, they even know what exact species you've found.
Once at least two people have given a specific ID, and over 2/3s of identifiers (including you) are in agreement, the observation has been given an official community ID. Now (given a few other qualifiers - eg is it wild, did you provide a date) your submission can be used for research!
within a few days, your new Research Grade observation will be uploaded to Serious Scientific Databases! Hundreds of papers cite iNaturalist data.
Now if you're freaky and/or already know a decent amount about organisms, you can also be an identifier! The app's interface for adding IDs to observations on mobile kind of stinks tbh. Maybe the new iOS app makes it good, but I haven't had the chance to try that. In any case, if you want to help be the person certifying observations, you'll be best off on the website.
So as an identifier the core loop is like this:
Open up a page of the dedicated Identify modal.
Add your filters: what species? where? when? Do you want to work with audio files, do you want to help a specific user? by oldest, by newest, random order? We have so many filters.
Open up those observations one at a time and give your best, informed guess as to the organism's identity. You might be the first identifier there, you might be double-checking someone else's hypothesis.
Use the 'more info' tabs, or the awesome built in keyboard shortcuts, to add more information, if you want. iNaturalist allows you to add phenology information or additional notes and tags.
You'll get notifications on observations you've added IDs to, to let you know if there are conflicting opinions or comments etc.

I use various IP geolocation resources a lot for work. I feel like people know this by now but you really can't reliably track down a Person or even a single Address from an IP address. There's so many variables that can affect the address someone gets when they connect to the internet, and how accurate the location is. A person using mobile data fucks it up pretty frequently, because you basically have no idea which cell tower they're going to be hitting. And of course one's location can be purposefully obfuscated with use of a VPN. I remember reading an article a while ago, something generally about how some law enforcement agency kept harassing one person in Kansas because the exact geographic center of the US happens to be within their property, and sometimes if IP geolocation can't figure out anything specific, it just defaults to dead center. Below the cut is the details of iNARiOS 1.0 and it's functional applications until further updates, these are the only apps and functions of the communication system Cyan has set up in Huntsville. (5/6/23)
REQUIREMENTS: A wired home computer or laptop wired into the system Cyan has set up. Phones, tablets, and other mobile devices still do not work, as they cannot be connected to the wired network that makes up the entirety of the computers Cyan was given access to. Game consoles can also make use of this functionality to play 'local' games together but remotely. THERE IS NO WAY TO USE THIS FUNCTIONALITY ON THE GO, YOU ARE REQUIRED TO HAVE A WIRED CONNECTION, PHONES AND TABLETS CAN BE SIDELOADED WITH THE INFORMATION, BUT ARE NOT ON THE NETWORK. Each computer must also load into the secondary OS, iNARIiOS, to access the network as a whole, though this is simple enough, as Cyan has left a desktop shortcut for this- a neon blue and purple fox clutching a scroll in it's mouth.
MESSAGING APPLICATION: YATAGARASU aka "CarrierCrow"
A Chatroom system with usernames, profile images, status messages, and 'group' options, CarrierCrow is the IM service of iNARiOS. stylized with the presence of a 3 legged crow and a sleek black and gold theming, it takes a lot of functionality similarities from discord, just heavily stunted, a basic text display in the center of the screen with messages tagged by usernames. This also contains the email system, allowing users to send messages in real time and into a holding inbox as well. There's cute little emoticons too- themed after the animal gods used in the applications.
DOCUMENT SHARING/CALENDAR WORKSPACES: KOMAINU aka "LionShare"
The workspace app themed after komainu statues, LionShare is where document writing and sharing, calendars, spreadsheets, and other file sharing is carried out, each user has their own specific key, and folders and documents can be set to be accessed by only specific keys, or the entire town, depending on the wants of those making the documents/calendars/sheets/etc. It carries over the usernames from within CarrierCrow, for ease of access, and Cyan has made a handful of public tutorial documents for the applications in iNARiOS, as well as an auto-updating spreadsheet including the screen names and contact information of the people around town, just in case you need to get in touch- but you'll still need their permission to send messages.
GAMES AND ENTERTAINMENT: KIRIN
KIRIN is a small-scale entertainment launcher containing games created by K1TSUN3 CO, a brightly colored, friendly logo of a scaled unicorn greeting users. It currently contains both games for PC, and ones that can be sideloaded onto compatible smart phones.
-Pocket Inari: A virtual pet akin to Tamagotchi featuring the animal characters of the OS itself in many colors, patterns, and pre-programmed personalities, it's simplistic, but with over 60 collectable characters and a charming, plinky set of chiptunes of modern songs, it's a solid distraction.
-K1TSUN3 KHA0S: A slash-em-up dungeon crawler featuring a fox-masked cyberpunk protagonist fighting their way through a neon lit, monster infested future, it features around 40 levels and a in-built progression system and a surprisingly capable story, for something a handful of criminals wrote to steal data, initially. It's known for being quite difficult- at least it's cross-progression between the PC and mobile versions.
-Turnibs: A cute farming sim game akin to stardew valley or story of seasons, once again you take the role of one of the handful of animal gods (a Fox, a Crow, A stone Lion, a moon-rabbit, or a dragon-like Unicorn) in a cutesy pixel style, running a small farm outside of a town populated by similar creatures. it's rather bare bones, but is cozy, peaceful, with lots of customization of the farm, farmhouse, and player character. It's multiplayer too- just have to enter the code on the main screen to become a turnip capitalist together!
-Megalophobia: a text based horror RPG, placing the player in the shoes of a survivor of a zombie apocalypse- Cyan considered not adding this one, but given it's 70+ hours of play time through multiple endings and builds, he included it anyway- The rangers at the stations tend to like it, though.
-Moon Bunny's Cafe: the only appearance of Moon Bunny as a large theme and not an emote/player character, Moon Bunny Cafe is a match-4 puzzle game like candy crush, with a cooking mama-like set of mini games as well. Collect your ingredients by solving puzzles, then help moon bunny run her cafe by slicing, baking, and decorating various cakes, sweets, and making teas and coffee.

it's super rare that I see a random ad that actually makes me want to pursue what it's selling. most of the time, it's just annoying and in my way, or some distracting flashing thing on the side or top or bottom of my screen.
do you know when ads are actually "good?" when I'm deliberately shopping for something new that I don't really know much about, or am looking to buy or replace something useful or important. then, after I see an ad that catches my eye, I can look up reviews for the product.
I just recently did this with trying to find a pet safe bug repellant. got an ad (sponsored search result) and found something I liked and had good reviews on the company website itself, not bots on Amazon. a negative one here and there to prove it's reliable and they don't delete bad reviews.
subtle ads that don't flash in your face, ads that don't have some random long intro or annoying song, ads that frankly have zero sound at all, ads I can click the x on right away without waiting for a skip and then waiting for an x and then waiting for a second x, ads that are relevant to what I'm doing, not because they're spying my data, but because of simple relevancy, ads that don't take up insane amounts of space... all decent to me.
if an ad can't sell me what they want in a single still image, they aren't doing it right. shoving ads in people's faces and forcing them to look at it for at least 5 seconds only makes people hate them and even spite them. the most effective ads to date were children's commercials because they'd show you a cool toy or whatever and go "look how cool and fun this is, look how much you can do with it, here's footage and pictures of kids actually using it, all for this price" and those types of commercials still work on me! BETTY CROCKER DOUBLE MELT POTS AND MOON SHOES MY BELOVED! TIGER POSTER!
that, and genuine offers from companies selling genuine products when I'm searching for them, not some shady Amazon-Temu fake brand looking company with some crazy generic name, not some high end brand trying to get me to pay for their brand name instead of a good honest product.
the grossest thing I've seen ad-wise: had a mobile puzzle game I liked to play. ads were annoying me bc they were so persistent. turned off data and wifi to not get ads. GOT THEM ANYWAY because they freaking were just videos that would auto play anyway regardless of internet connection. lost my mind. Uninstalled.
