i was just wondering what your favourite tropes and dynamics are to explore in fic? either to write yourself or to read!

Oooh, that’s a hard one to answer because I like so many! Uhhh...Let me think.

Well, one of my favorite tropes is definitely Found Family. What is really more satisfying and worthwhile than a group of damaged people coming together and slowly building trust and love until they are inseparably bonded and full of love and have found things they never thought they would?

I am extremely weak to memory loss both because I have some myself, and the American Dragon Jake Long episode Homecoming ripped out my heart as a kid and left me suffering, then Code Geass stepped on it twice with Shirley the same way. So I really like memory loss centered tragedy tropes bc I am 3x weak to them. I am also weak to that trope where one person is trapped in a room with a bomb, or going to drown, or for whatever reason cannot be saved from dying, so a loved one goes and stays and dies with them too just so they don’t have to die alone. Frkn /shatters/ my heart.

I love hurt comfort a lot. I think my favorite scenes to write and read are often one person is completely at the mercy of person 2, who they have no reason to think will help them and are terrified of being hurt by, but instead of person 2 doing anything bad at all, they are kind and look after them and save them. I die for that. It is the lifeblood of my soul.

I also like big character arcs and well done redemption arcs (bad ones make me rage tho. If I was a card in a tarot deck, I’d be Justice). Personal growth, finding hope again, learning to trust or love yourself. I really like character studies, and I like in-depth looks at serious issues and complex and messed up situations. I also am a big fan of deeply important and lasting platonic relationships, be it familial or best friends or whatever, and like romances where the two in question (or more if poly) just try really hard to be good to each other and communicate well and are full of love and would die for each other.

Love pets being a big element of story. Love language barriers, and like writing them/communication barriers. I am usually not very interested in stories (writing or reading) that don’t have good rep in a number of ways. Like writing disabled characters well because I see them get written very grossly so much (I like writing tons of groups this is just the one I did most recently, so it’s on my mind rn. I am disabled, but I’m also a lot of other things to & def don’t only focus on/be interested by my own stuff). I am kinda branching out from tropes to just elements now tho. Uhhhhh, tropes, tropes. I love the opposite of that stupid “If you kill an evil person you’re just as bad”--I am here to see people end the people who murdered their friends or abused them. It’s what they deserve. Not here for a woobie redemption arc for an abuser. Very tired of those & angy.

I love humor in the midst of intense drama or horror or sadness. I’m big into massive sacrifices, but especially if it’s something other than death bc those tend to be more well thought out.

I adore characters who have been through awful things and suffered and been abused getting to actually heal and live happy lives instead of just dying the second they start to taste happiness. I love themes and tropes about the value and lasting nature of human connection and how important and lasting it is.

Uhhh, I am obsessed with free will > fate and choice, and I really like humanity and things about what it means to be human, and ethics, but like, in an interesting way? Like, Terry Pratchett’s stuff really appeals to me. Like “What have I always believed? That on the whole, and by and large, if a man lived properly, not according to what any priests said, but according to what seemed decent and honest inside, then it would, at the end, more or less, turn out all right.” “Just because you can explain it doesn't mean it's not still a miracle.” “The figures looked more or less human. And they were engaged in religion. You could tell by the knives (it's not murder if you do it for a god).” “There are hardly any excesses of the most crazed psychopath that cannot easily be duplicated by a normal kindly family man who just comes in to work every day and has a job to do.” “There’s no point in believing in things that exist.” “You couldn’t put off the inevitable. A cornucopia? Can I have a look? Thanks.” Om emptied some of the fruit out. Then he nudged the Newt God. “If I was you, friend, I'd find something long and hefty,” he said. “Is one less than fifty-one?” said P'Tang-P'Tang. “It's the same,” said Om, firmly. He eyed the back of the Tsortean God's head. “But you have thousands,” said the Newt God. “You fight for thousands.” Om rubbed his forehead. I spent too long down there, he thought. I can't stop thinking at ground level. “I think,” he said, “I think, if you want thousands, you have to fight for one.” He tapped the Solar God on the shoulder. “Hey, sunshine?” When the God looked around, Om broke the cornucopia over his head.

Are all just from Small Gods, and like, boy is that my kinda good shit. Love history and sociology and anthropology.

I love people fighting to do something they know is doomed to fail just because they know it’s the right thing. I also die for characters who are loyal undyingly, and characters admitting they were wrong and trying to do better, and that trope where someone says something but the exact opposite is happening in the background or happens immediately after. Love that trope where someone should be dead but they just. keep. getting. back. up. to defend someone they love. Love the trope where character A dies and character B takes something of theirs like a bracelet or a necklace or a headband or something and wears it forever after. : (((

I know there’s a ton more but ima swap to dynamics.

Let’s see. I adore familial relationships so much? Blood family, adopted, doesn’t matter, it’s exactly the same. I am huge on one character becoming team mom or dad or parent, or adopting some of the others. I love parent-kid relationships, even with adults and older adults, because it’s just as important. I adore small children being cared for by gruff war-hardened people, or selfish dicks who have to be better for the kid, or kind people who always wanted a kid and lost their own or never had one, or who are happy to add one more, or big sisters Clemtine style stepping into parenthood. Live for that, and I seek out video games that let me play it. Very excited to be trying out Plague’s Tale Innocence, because you play as a big sis taking care of your little brother (he’s like 6? 5-8? I’m not sure). But it’s such a neat idea for a sibling dynamic to explore, because while they’re siblings and know each other’s name and have like, a familial bond, it’s also all kind of awkward and new, because he’s been sick for years and in quarantine with just their mom, so even though they’re siblings and love each other and like, baby brother trusts you, they don’t really know each other at all, and that is just fascinating and so cool to explore to me! I also love someone adopting someone else as their new sibling(s) and dragging them into the family. I love siblings where one starts to go evil or mess up, and the other sibling fights with everything they have to save them/bring them back/help them become good again, because it breaks my heart and sibling relationships are /so/ important to me.

I also love shit like Jeff in dbd, where one character adopts younger characters who just /super/ don’t deserve it, because as much as they’ve fucked up, they love them anyway, they just do, and they want to be there to give them support and a chance to keep trying if they’ll take it. And like, I love all of Legion’s relationships with him, but especially Joey, because it’s /so/ sweet, and Joey is just a scared kid hurting and alone and he wants /so bad/ just to be loved and thought well of and okay, but he’s terrified of getting hurt or killed, and confused, and guilty and afraid of what will happen because of all the bad shit he did, and Jeff is just so warm and forgiving and full of nothing but unconditional love and kindness, and in the sincerest of ways, and they’re such good friends, which is like, not optional to a good parent-child relationship. Or way older brother filling in for parent-kid, there’s a lot of overlap. Anyway! Also just cute shit where someone falls in love with the idea of getting to look out for and stay close to someone younger they want to protect and parent, and there’s this kind of hopeful and almost fragile unsureness that the other person will want or need them in that capacity, like Ace adopting Nea, and not just picking looking out for someone who needs it over former life of thrill, but like, never regretting that choice, and just being truly happy and fulfilled in the adventure they now are on.

For friendships, god. I like so much shit, I don’t know what to say. I am so sorry I am giving you a novel for an answer to this short ask, rip. But I just love all kinds! I like groups with an established rhetoric between them, who are just so comfortable in each others’ presence, and people you know love and value each other so much they’re going to be together forever just as much as the two other characters getting married. I love one is a nice person, and the other is an asshole, but they make an amazing team and balance each other out, and the asshole stops the kind one from dying doing shit for other people, and the kind one helps the asshole be just a little more in love with their friends and things other than themself, and they’re great together. I love idiot friends who riff off each other and do bits all the time, and ones who turn into the “Holy shit there’s two of them” whenever they hang out, and ones who are just so on the same wavelength they’re totally comfortable in silence together and seek it out and would die for the other. I like wingman to person who is dying of embarrassment dynamic, and hardcore fighty person protecting either small and easily hurt person, or just as great, protecting dedicatedly person who is ironically either just as tough as them or even more, but it’s still really sweet and kind of double soft and sweet because tough friend never gets cared for.

God, what don’t I like? ...People being toxic assholes together?

I like super opposites that mesh well, but look hilarious next to each other, and goofy best friends who shamelessly sing loud to the most embarrassing karaoke track they could find. Lesbian and himbo is pretty great. As is the opposite, gay dude and stupid amazing slut or bimbo. (Fkn Mateo and Cheyanne kill me). Sweetest person you will ever know surrounded by 20 people who would die for them. Person who thinks they’re unlovable and takes a long time to notice like all their friends already love them, and then they get to be happy. Person who has never once had a good relationship is dragged into a healthy friendship and /super/ suspicious at every turn because they just aren’t used to being loved and treated well, but eventually softens and probably straight up breaks down at some point.

Person who was formerly bad or did something super fucked up is forgiven and welcomed into a group which they can barely even understand, and they are full of guilt but their loved ones reassure them and help them heal and just accept them and support them. Friends who are super mean to other friend but like, in a loving way, and would also take a bullet for the friend.

Uhhh, for romances, my fave is characters who just fucking love each other. I am real tired of relationship drama. Like pining and issues and star crossed lovers are all great (I think of those, star-crossed lovers is my fave), but I mean like, the shit where people keep having misunderstandings or not talking or cheating on each other just so there can be drama--that I am sick of. I love it when person A does something super badass and probably a little unexpected and person B is like “That’s my wife!!!” or just goes : O with love in their eyes, and this happens constantly. I love gushy mushy sweet displays of affection. I love relationships where the people who are dating were best friends first and still are after, all the way, and tease and rib and are so in love.

I like it when one person thinks they don’t deserve the other, but clearly their partner feels none of this and is always just like “Babe...” and hugs them and is just as in love, and helps them begin to love themself more.

Uhhhh, I like it when there’s someone who doesn’t think they’re in love and there’s that trope where they suddenly get it and you get the Oh or the Wait in italics as it drops internally. I like ships where the characters balance each other out well or provide good support and get better together than they were apart, triple points if they’re super aware of that and comment on it. Also whatever the fuck Maureen Robinson and John Robinson in the Lost in Space reboot have going on. That’s like, goals. She’s chaotic evil living lawful good by sheer force of will, and he’s a himbo too in love to realize any of that and never questions what she thinks they should do beyond the physical logistics of it and would die for her and not think twice about it or the fact that she moves really fast to the pragmatic “Okay,”--not because she doesn’t love him, she does--but because someone does need to be alive for their kids and she’s just wired too practical for him to have to pry her off sobbing to not stay and die with him. (This happens verbatim in like episode 6, but it’s not a mega spoiler bc he doesn’t actually die--he just almost does. She figures out a way to save them both right before committing to it.)

I also like “two fools both in love but really nervous about asking the other if they are because of their past, or situation, or because this is the first time or first time with that kind of relationship, so there’s just intense romantic tension all the time where they pause mid-sentence to just stare into eachothers’ eyes and forget what they were saying, but they’re both too ineffective to just fucking go “Do you like me?” for such a long time. Hurt/comfort paired with pining. Uhhh, but Star Crossed Lovers is up there for sure. I love the pain of two people wanting to be together but it’s just /impossible/ and they know it but that doesn’t make the feelings go away, and it’s miserable, and maybe they’re upset, because they shouldn’t feel this way, but they can’t not, and it’s confused, and it hurts, but they’re also so /happy/ when they see each other. I like that good shit in any romance where the characters can just look at each other and they know, and you know. That’s the choice shit, I tell you that.

Jeeze I’m sure I missed stuff but this is already so long. Uhhh, I like so much I don’t really know how to answer. But my favorite like, vibe/....flavor genre? Is Hope Punk. Uhhh, and mostly I dig any relationships that end up healthy and sweet. I really like second-chances, and characters confronting and moving on past their bad or complicated pasts, or trauma, and healing. Hurt comfort is love, and so is angst with a happy ending. I like a good villain or a wonderful asshole, but I feel like characters that are just good and doing their best really get overlooked and undervalued a lot, and I am here for them. Like Sam Gamgee? One of the /best/ characters in LOTR. So is Bob Newby--and I do get the irony in them both being played by Sean Astin. But uh, anyway, I really like to explore how decent people try to act when confronted with terrible situations and choices, because I really value people who stayed sweet and kind and merciful and full of love even after all the awful shit life has put them through, and I really like writing about how /hard/ that is, and what it looks like, along with the other stuff. I also like characters who are very flawed and very medium being given something to lose and something to gain that go in opposite directions, and being forced to confront their reality and make hard choices. I like people being given intense opportunities to grow or to rot, and seeing which they’ll chose and why and if they’ll make it to the end. Mostly I just really love characters who try, even if they fail, because that can be a lot harder to do than it seems. I like dynamics where one character is very flawed, or in a bad place, but they love someone they think is amazing, and so they’re working hard to catch up to them, or to get close enough they can reach out and hold their hand, and are fighting to make it to a person themselves who can do that someday. I’m sure I forgot a lot and that this was super rambly, but I hope you at least enjoyed some of it! Thanks for asking! ^u^

Some things that happened this week, no order; TLDR at the end!

TW: brief mention of bodily functions at some points

I think my coworker might be lesbian, go her!

I volunteered with my sweetie, as we do once a week. We played with playdough.

I got told this week by my nephrologist that she wants to try to get me down to once a week for dialysis. (And then eventually all together) but this is still kind of a trial, I might still need to do it twice but she has a lot of faith. She said this is one of her favorite parts of the job. I can imagine.. everyone at my center is basically waiting on a transplant or to pass cause some of the patients are very old. So I feel lucky I don't need a transplant. I would be low on the list (pretty sure anyways) cause of my chronic illness and near death experiences and I'm not accepting a kidney from most of my relatives, especially not my brothers.

I've been vomitting at least every other day, but I think it's cause I forgot a certain medicine and ever since I took it I feel better.

A kid got shit on the floor, dead ass. My manager a real one for getting it cause I didn't even smell or see it and I was gagging.

One of my coworkers last day was Friday so I brought breakfast, my manager did too. 😂

I spontaneously bought one of my friends who is so good at makeup a colorpop palette cause she wanted it so bad and I'm like hey, I can afford that. I texted her give me your address asap. Then I messaged her a pic of my receipt. I told her it was a late Christmas gift. It felt so good to be able to buy that for her. She really deserved it. I was scared at first she mightve already got it for herself. But she was surprised. ❤ (And this is irrelevant and certainly not why I bought her that but for Christmas she got me a hello kitty treat yourself spa kit) me and her are in a group chat with our other close friend and I sent the sc of my receipt to her privately 😂 I'm not getting the third friend anything. I might draw her a pic and mail it in a envelope but that's about it and depending on how long the pic takes that's still a lot of effort/care. I love my friend don't get me wrong but she can be fake sometimes. And my other friend deadass works 10 hour days and still has time to speak to me. It also helped satisfy my need to shop. I don't wanna buy anything unless I really want it and don't own anything like it. So it felt good to shop, and for someone else, and for something she really wanted.

Another thing happened but it's not happy, I'm sad about it and I don't know where to direct my anger/hurt, if I even should. I feel like one of my close friends is slowly distancing herself away from me but I could be wrong. I talked to her other friend and said hey let's do something nice for her, so he said she wants a tattoo I'm like ok let's split it. (If you know me you KNOW I do not have a lot of money.. at all. I maybe make around 300$ a month. I can't work too many hours cause I am medically disabled. For those who don't know, medically disabled means there is no physical or mental disability (I do have a problem with one of my legs but not to the point I need aid like walker or chair. Maybe the chair if I'm going to a festival just cause its so much waking) but there is something in your body that prevents you from being able to work regularly. At least this was how it was explained to me) but anyways they went without me.. even though it was my idea to do halfsies on the tattoo.. I don't wanna be like

So are we not friends? Cause she's going through a lot of tough things and if she isn't feeling that way about our friendship I don't wanna make things worse for her.

On a positive note my friend who swore to never get married still says he would marry me to get me healthcare, but not only that he said he has zero hesitation in doing so. Me: not even a smidge? Him: no.

I like to make sick/death jokes as they help me cope and I have learned to not do it around him, he doesn't find it funny.

I still remember him saying "if you did die though, it would genuinely break my heart" I told him today I care about him very much. I no longer use to L word with my male friends cause they take it as a romantic way. I did like this guy at one point but I think it was period hormones however if he did confess anything to me, I'd probably give it a swing.

Wish I could've wrote it in my journal but typing is much quicker! Basically life is okay. Nothing more, nothing less. Which I do not mind cause being depressed fucking sucks. The one extremely happy thing though is my dialysis is getting cut to once a week (started at 3x a week) cause my kidneys are improving 🙂 so exciting and what a blessing.

Day 8-10

The first few days on my own, yet last few days in Queenstown, have been occupied with hiking, exploring the town, and probably too much ice cream (Zach, I am 2 days ice cream free). It’s been nice to relax a bit and go my own way before I get to work in Samoa.

Yesterday’s hike was probably my favorite. After the couple I am staying with gave me a few directions on a map, I still managed to get a little turned around 2-3 times before making it to the start of the track. I started up the track at the same time as this older gentleman. Thanks to some encouragement from my Dad a few days prior, I reached out to this man and started up a conversation. His name was Denny, he was 76 years old, and he was from Dunedin. He walked this track 3x/week for many years but was frustrated that he couldn’t make it up as fast as he used to nor that he could keep up with his 90 year-old neighbor who walks it 5 days a week for exercise. I walked with Denny for about the first 15 minutes. He told me he was a retired teacher and asked me what I do at home, why i’m here, and what’s so special about Minnesota. The obvious answer: the summers on the lakes. However, after making the mistake of looking at the news from home that morning, I explained that the absolute best part about my state are the people. A diverse group of individuals from various cultures, beliefs, abilities/disabilities, and lifestyles. That may have been my way of assuring myself that my home and my community were more accepting than the specific things you see and read on social media or one-sided news reports. It’s pretty overwhelming how everyone else in the world keeps up with what’s going on in the US and I honestly do have anxiety sometimes saying where I am from out of the fear of someone going off on me. I have started to learn that the rest of the world is fairly accepting and kind, and they don’t judge based on someone’s opinions. They just like to have genuine conversations about things, including Denny.

After a few more stories, he told me to move along without him, because he needed to rest. Part way up the track there is a split and you can go right (the easy path) or left (the hard/steep path). The couple I am staying with said to go right. Denny said to go left. I went with Denny. It was really steep, more than I expected. I didn’t want to take a break so I just tried to hold on and attempted to slow down my breathing; although I was quickly reminded I wasn’t near sea level so easier said than done. As always, the view was worth it.

I spent some time at the top relaxing and taking pictures. There was one other girl at the top. Again, hearing my Dad’s voice, I started talking to her a little, too. Her name was Annika and she was from Germany. She had 5 months off and was traveling around before starting school again so she was exploring while trying to figure out what she wanted to study. I told her not to think about it too much, it was likely going to change at some point again.

I spent some time just relaxing at the top by myself when all of sudden Denny comes up from around the corner. He was pretty out of breath but just walked right up to me, said “we did it!”, and gave me a big hug. Denny gave me a little geography lesson about the names and heights of all of the mountains, pointing each one out to me and also telling me how they got their names. He then told me he couldn’t stay long because he told his wife he’d be home by a certain time. He had to go to a doctor’s appointment, because he shared he has cancer. He explained how fatigued he’s been feeling and how much it frustrates him that it takes about 25 more minutes to get up the track compared to 10 years ago (he times himself). Being trained in Cancer Rehab my mind went into PT mode, but I simply decided to just turn that off and listen, letting him vent. Before he left he said he needed to find two rocks: one for him and one for his wife. Every time he comes up he takes a rock back down to her. He said someone once asked how many times he’s walked this hill and he decided he would just go home and count the number of rocks. He couldn’t find the bucket so he asked his wife where it went. She said she dumped it out. HA! Moral of the story is: Mom, don’t throw away all those sand dollars Dad brought home for you from the ocean.

I’m going to cut away for a second and just say thank you to my parents. I am so lucky to have grown up with Mom’s gentle soul and Dad’s passion for building relationships with those around you. You both have sacrificed everything from time, money, and you’re own wants or needs to fulfill mine. Mom, your unconditional support, patience, and unselfish holds or changes to your own life are so appreciated. Your entire life has been for your family. I honestly don’t know how you juggled everything you did, with as much grace as you had. I truly hope I can be the same amazing mother you have been to us. Dad, thank you for giving me space when I need to explore life on my own, yet drawing close when I need support. Thank you for being the one man who has always been and will forever be truly constant in my life. Thank you for sitting on the other end of the phone for hours without saying any words or asking questions, but just simply being there when I need comfort. Even from hundreds to thousands of miles away you always seem to know how to be close. Over and over you have told me that life isn’t about the things you have or the things you do, but about the people you meet and the relationships you make. You taught me to listen. Listen to other’s stories, learn the real facts, understand their lifestyle, and find the beauty in their culture. It doesn’t have to ever be my way of life and I don’t have to share the same opinions, but have some empathy and be open to learning. In the end, you learn that every human simply wants the same things in life: love, to be accepted for who they are, and to be respected.

I told Dad about my bungee jumping and hiking, and he responded by asking for pictures of the people I meet. It took me a little bit to realize it, but he’s right. The scenery is gorgeous and activities are amazing, but the people I have met are what I remember and appreciate the most. They give you perspective. You quickly realize that everyone is going through a battle of their own, whatever that may me. Denny has cancer, Annika is struggling to figure out her career and purpose, some people lost their home or family to war, and some are looking for love. So be gentle, be kind, practice empathy and humility, show sympathy, and focus of being a better you because that’s all you can change in this world. We’re all human and fear is natural. However, if you let fear run your thoughts and mind you miss out on everything that has the potential to change your life in the most beautiful ways: that job or school you didn’t think you were qualified for, the chance to travel the world, bungee jumping or sky-diving, falling in love, opening up your life and helping those in need, and gaining perspective by listening and walking in someone else’s shoes.

I laugh as I look back in my personal journal I have been keeping. I wasn’t planning on sharing any of this but anyway here we go. The day I left, while sitting in the San Fran airport on 1/20 I wrote a list of this I wanted or hoped for from this trip and 3 out of the first 6 were: meet new people and hear their stories, learn and gain perspective, and be quicker to understand by standing in another’s shoes. Hah, apparently I am right on track…

Medical kidnapping of senior citizens occurs when a doctor, usually a psychiatrist, deems that the senior can no longer take care of themselves, and gets a judge to sign an order of “guardianship” or “conservatorship” to someone working for the State.

This state-appointed guardian then comes in and seizes all of their assets, and keeps them a prisoner locked up in a mental facility, most of the time against the wishes of their family members.

This epidemic in the U.S. is even a larger problem than child medical kidnapping, as state-appointed guardians currently have 1.3 million elderly people nationwide under their control. See:

Protect Yourself from America's Corrupt Guardianship System

John Oliver is hardly a libertarian, but his Last Week Tonight show on HBO regularly highlights how US citizens are royally screwed by Uncle Sam and his minions. Over the years, he's tackled subjects ranging from civil forfeiture to abuses in forensic science.

Recently, Oliver turned his attention to the guardianship system and how it can abuse senior citizens. Nearly 50 million Americans are 65 or older, and more than one million of them are under guardianship. Nearly 500,000 other disabled adults are part of the guardianship system as well.

State courts appoint guardians to make personal and financial decisions on behalf of adults found to be legally incompetent. A guardian is supposed to ensure that their “wards” have safe housing and help them negotiate a legal and medical system they may be incapable of dealing with on their own. According to an auditor for the Palm Beach County (Florida) guardianship fraud program, guardians control assets valued at $273 billion.

A ward loses nearly all civil rights once a judge approves a guardianship. The guardian has complete control over the ward's personal and financial affairs. All of a ward's money can be transferred to a guardian's own account. A ward can also be forcibly relocated to any residential facility the guardian sees fit. Family members may lose the right to obtain information about the ward's finances or medical conditions. Indeed, family members may even lose the right to visit the ward, because the guardian can forbid it.

As Judge Steve King of Tarrant County, Texas said on Oliver's program: “Guardianship is a massive intrusion into a person's life… they lose more rights than someone who goes to prison.”

The powers that guardians wield are rife with abuse. In a series of cases from Las Vegas described last year in The New Yorker, a guardian in Las Vegas named April Parks targeted elderly individuals with substantial assets. Parks persuaded doctors to declare these individuals incompetent and place them under her guardianship. She would then acquire control over their assets and charge outrageously high fees to arrange for their care. When her wards' estates were depleted to the point where they qualified for Medicaid, she would place them in nursing homes at government expense. In virtually all cases, this happened without a formal cognitive assessment to determine if the ward could continue living independently.

Two of Parks' victims were Rudy and Rennie North. In the summer of 2013, Rudy, then in his mid-70s, answered the door to their home in an active adult community in Las Vegas. He was confronted by Parks and three colleagues. Parks informed him that she had a court order to immediately remove both Rudy and Rennie from their home and commit them to an assisted-living facility. When Rudy objected, one of Parks' co-workers threatened to call the police to have them forcibly removed.

Under the laws of Nevada and many other states, a guardian can file an emergency petition before a local court to impose an immediate guardianship. Parks had filed such a petition, claiming that the Norths posed a “substantial risk for mismanagement of medications, financial loss and physical harm.” The petition was backed up by a statement from a physician's assistant and one of Rudy's doctors, who claimed he was “confused and agitated.” However, no formal cognitive assessment of the Norths was required before they were placed under Parks' care.

As a court-appointed guardian, Parks had complete control over the Norths' finances. Once they'd been whisked away to the assisted-living facility, she arranged for their belongings to be removed from their home and sold at an estate sale. She also transferred the Norths' savings account to an account in her name.

Like most guardians, Parks billed her wards' estates for the time she spent on their case. Nevada law places no limits on these fees, so long as they are “reasonable.” A month later, Parks filed a petition before the Clark County Family Court to make the guardianship permanent. Like most such petitions, it was granted. The entire proceeding lasted 10 minutes.

When Judy Belshe, the Norths' daughter, discovered her parents hadn't been at their home in several days, she suspected they had been kidnapped. But on one of her visits, Belshe found a note taped to the door with Parks' contact information.

Belshe called Parks and demanded to know where her parents were being held. Parks gave her the name and location of the assisted-living facility. When Belshe contested the guardianship, Parks claimed that Belshe was a “reported addict” who “has no contact with the proposed ward.”

Once the Norths' estate had been depleted, Parks moved them to a less-expensive assisted living facility. When Belshe arrived at the new facility to visit her parents, Parks informed her she would not be allowed to do so. When Belshe persisted, Parks ordered a receptionist to contact the police. Belshe was given a trespassing citation and ordered to leave the premises.

Finally, more than two years later, Belshe was able to wrestle control over her parents away from Parks. But by then, they had lost their home, their savings, and of course, their dignity. The Norths filed a lawsuit against Parks, and in 2017, were awarded an $8.5 million judgment. It's unlikely they'll ever be able to collect on it, but the judgment confirmed their belief that they had been unwitting victims of a corrupt system.

In the meantime, Parks, her lawyer, and her office manager were indicted for racketeering, theft, perjury, and exploitation of their wards. Their trial is scheduled to begin in September.

The horror story surrounding the North guardianship is not an isolated case. I've come across abusive guardianship cases in many other states, including Arizona, California, Colorado, Florida, Georgia, Indiana, Maine, Massachusetts, Michigan, Missouri, New Jersey, New Mexico, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, Tennessee, Texas, and Washington. And while I suspect the vast majority of guardians exercise their authority ethically and with discretion, if only 1% of guardianship cases are abusive, that means 15,000 Americans are victims of this system.

Since it's extremely difficult to escape from a guardianship once you're in the system, plan ahead to avoid it. Getting your legal documents in order is the best way to avoid becoming the next victim. We insist that all Nestmann clients execute durable powers of attorney and health care proxies and record them in public records.

These documents should name someone you trust – generally your children or grandchildren – to step in if you become incapacitated. Whomever you name should not be someone in financial difficulty who might use your assets to satisfy their own financial obligations. The document should also be revocable unless a formal cognitive assessment performed by a licensed physician (ideally two licensed physicians) determines you are incompetent.

Another precaution is to build a safety mechanism into your planning. If the agent you name steps in to assist you if you're incapacitated, your documents should require the agent meet periodically with an independent party – your accountant, for instance – to ensure your assets truly are being used for your benefit.

The guardianship system is one of the biggest rackets in the US today. Don't be the next victim of this corrupt system.
