Australian Conveyancing: An Overview of Real Estate Deals
In Australia, the process of purchasing or selling real estate can be intimidating and complicated. Conveyancing in Australia, the legal procedure used to transfer property ownership is one of the most important phases in this process. Understanding conveyancing is crucial for a safe and easy transaction, regardless of whether you're a first-time buyer, an experienced investor, or someone selling a home.
"Do I need a conveyancer to sell a house?" is one of the most common queries posed by homeowners getting ready to sell. Although selling a house may be done without a conveyancer, doing so can streamline the procedure, save time, and safeguard your legal interests.

Creating and Examining the Sales Contract
Outlining the conditions of the real estate transaction, the Contract of Sale is a legally enforceable agreement. Essential information like the agreed-upon sale price, the date of settlement, the terms of the sale, and any specific provisions (such as inclusions or exclusions, repairs, or faults) are all included.
A conveyancer will create or evaluate the contract to make sure it conforms with state or territory regulations and contains all relevant information. Additionally, they will confirm the property's legitimate ownership and make sure the title is free of problems. For instance, the conveyancer will make sure the buyer is informed of any easements or limitations on the property to avoid any disagreements later.
Creating the Disclosure Statement for the Vendor
A vendor's disclosure statement must be provided by sellers in the majority of Australian states. This declaration lists all known problems with the property, such as environmental concerns, planning permissions, and structural flaws. A conveyancer will guarantee that this statement is properly produced and compliant with the law. It's important to have an expert manage this phase since failing to reveal pertinent problems might result in legal troubles.
In conclusion, while though it is legally possible to sell a home without a conveyancer, it is strongly advised that you get professional assistance to help you navigate the process. A conveyancer makes certain that all legal requirements are fulfilled and that the sale goes smoothly by preparing, revising, and organising the contract of sale and settlement.

And The Gods Do Play
Chapter Four – The Thinking Hero
They spent most of the evening kissing and cuddling. Kissing was a revelation to Jake, he could not get enough of it. A fact that Tru digested with some amusement but helped him all she could. She put a lot of passion in those kisses and both were groping with abandon at times. She slept in his bed, nude and this too was a revelation to Jake, the first naked woman he had even seen.
In one corner of the bedroom was a new table and on it a statue of Quaid the blacksmith god. Beside it a tiny hammer and a book. The book was a detailed instruction manual on how to worship Quaid as your personal god.
In the bathroom of all places was a similar table, this time with a statue to the God of Prosperity, the symbol beside the statue was a bronze coin, square edged. Also on the table was another manual of divine instruction.
The next day he told her his plans but first he worshipped at each altar, longer for the God of All Blacksmiths and Assorted Smiths. She asked him why he did not serve Lavinia as a subject. The answer was simple, she had never asked.
He had to meet with the conveyancer at some point this afternoon, probably meeting her at the bank to get the financial side of the buying of property out of the way. Hopefully she could set him up with a removals company that gets the keys and goes in and moves the lot. Packs it and moves it all. He had money now, he could expect all sorts of special service. This morning though he had to deliver a letter.
It had been sat on the hall carpet in the middle of that room, with a note beside it showing an address. Cooper’s Automotive Design, Farring Street. He knew that street, it was just off the main road that was on Burchill Street.
“I will come with you!” Tru decided.
“You can’t come with me. Kaelin has let it be known that I will have to deliver the letter in a place of dubious men. That probably means hardmen, at least working the doors. They could be drug dealers, fences, you know those who sell stolen goods, armed robbers, ram-raiders . . . basically, crooks!”
“I can look after myself.” She said adamantly. Although he doubted it, he did not say this as he ate a bit of cold spring roll. She was tough yes, she had lived in the wilds for long periods at a time, usually sleeping rough so she was tough. But handling hardmen was something he was not sure he could do, let alone her. These men were professionals not someone tough from the pub. These sorts of men could beat him up with one arm behind their backs. He was sure of that. For these people violence was part of the job description.
He told her they were walking. It was not too far, closer than the north end of the park. In return she asked him why he did not have a car? Jake laughed and said they were too costly. You bought a car, fair enough if you could get an honest deal. Then you had the tax and insurance, repairs, petrol, yearly MOT, maybe a service once a year to keep it going well. Cars leeched money. All his money went into renting the house and the occasional takeaway from Mr Han, maybe a pizza now and then from Bob’s Fair Deal Pizza Delivery.
“But you are rich now, you can have any car you like.” Well, not any car but certainly a luxury car like a Jag. He had always wanted a Jag but did not like the rear wheel drive. Now however Jaguars made their cars with four-wheel drive. True, the designs were not as good as the old ones. They looked too much like other cars. “Or you could lease one through your company.” She giggled. “You could even lease a Bently.”
That would be a laugh. For a Bently though, what you really needed was a chauffeur.
“I will look into leasing a car.” He told her. His consultant would know where he could get a reasonable deal for whatever car he named.
They reached the address without incident only to find it looked like a shop, now closed. He knocked. A bulky man answered.
“I am here to see Mr Saunders.” Jake told the bulky man.
“Got an appointment? Asked the man surlily.
   “No.”
   “Didn’t think so. Mr S don’t see no-one nowhen.”
“But I do have a letter for him.”
   “Give it here then.”
“It has to be delivered in person. I have to give him the letter. He might want to reply.” Jake has made the last bit up but he was going to make sure the letter was delivered and the only way to do that was to hand it to him in person.
“Show me.” Jake showed him the letter, blank at the front and sealed in green wax on the back. The seal showed a snake wrapped around the branch of an apple tree. Jake knew the branch was of an apple tree because at the end of the branch at the edge of the seal was dangling an apple.
“See. This is a personal letter. I have to deliver it by hand, so to speak.”
The bulky man tried to snatch the letter but Jake was ready for that. His senses had been alerted when the man asked to see the letter. He had been coiled like a spring and now he let loose. A twist of the body and a fierce elbow to the nose.
It was as if his body had reacted, his new body, but Jake knew it was not that. It was that he had seen the move before on the telly and wanted to use it but never had the perfect opportunity. He was surprised by the effect though. It had not only busted the man’s nose like Jake had expected, he had knocked him into the room behind and the man was flat out, unconscious.
   Jake had no sympathy.
“Turn away!” He told Tru but she did not. He grabbed the man’s leg, twisted it so it was fully extended and let loose a kick to the knee. There was a loud crack that seemed too loud for one kick and one broken bone.
He then pushed past the prone man and walked to the back of the shop, only to find a man rushing in.
“He is not in a good mood.” Tru warned the man. “That last bloke took a kicking. Broken nose, broken leg. He is well fucked.”
The truth was, it had been a surprise attack. It had surprised Jake as well, how well it had come off. His attacks were often instinct and he was always ready to fight around larger men. Larger than he had been anyway.
“You did Big John?” Asked the skinny man. Jake was not fooled though. He knew little guys that were just as tough as the big ones. One bloke, Marty Holden, was only 5 foot 2 but he was the area karate champion. Even the professional hardmen left Marty alone. Mr Han was barely the same height as Marty and he too was reputed to be devilishly tough. What’s more to Jake’s mind Mr Han was olddddddd. He was in his late forties, early fifties.
“He was a very naughty boy and got a spanking.” Jake said with a smile that could have curdled butter. “I always fight. I don’t always win but I always break bones. You might beat me . . .” Here he swept a hand up and down himself to show off his new size. “But you would be spending a week or two in hospital even if you won.”
“What’s your trade “? Asked the skinny man.
“I ain’t here to trade. I am here to give over a letter by hand to Mr Saunders.”
“Hand it over, I will see he gets it.”
   Tru giggled.
“That was what the big man said before he tried to snatch the note. Bad move on his part.”
The skinny man seemed more unnerved about Tru’s behaviour than he did the situation.
“Can’t let you in to see Mr S. He don’t accept no visitors.”
“Look!” Jake showed him the back of the letter. “Just tell him it has a wax seal with a serpent wrapped around an apple branch. He will see me then. I will wait. You can get someone to wait with me if you want. Tru, if the fat man starts to wake, bang his head on the floor.” Tru giggled some more.
“Righto!” And she went to stand beside the bulky man.
“Just wait here. Come no further or there will be hell to pay, broken bones or not.” The man left through the rear door to the shop. He was back within the minute. “You can come in, she can’t. I will wait with her. She is safe.”
Whether that was a question or a statement Jake did not know as he went through the rear door. There was a tiny passageway and two doors off, one open. He went to that.
In there was a man reclining in an armchair, his legs draped over one arm, a book in his hand.
“You have a letter for me?” He drawled lazily. Which was odd. This man looked to be the boss but he did not seem to have enough energy to stand.
Jake went over and put the letter in his hand. The man saw the blank front and turned it. He was startled when he saw the seal, that was for sure. His skin had gone white and he was sweating.
“Is this from him or one of his . . . servants?”
“I think it is direct from Mr Kaelin himself, if you know what I mean. I am a messenger. I pick up and drop things off for various . . . persons of greatness.”
The sweating man felt in his pocket and extracted a multi-knife, one like a Swiss Army Knife with all the tools and attachments. He used the blade from this to slice open the top of the letter leaving the seal untouched. He took out a small note on red paper.
Suddenly a huge burst of sweat from his body and then a look of relief.
“He is happy with me. Give him this.” He patted his pockets until he found what he was looking for. It was a large round coin, obviously ancient by the looks of it. Its pattern had faded slightly.
Jake took the coin, his body seemed to become transparent, bit by bit, his feet first and then his legs, then his waist and then . . .
He was then in the coffee place where he had met the God of Prosperity. Kaelin, the god of happiness was sat at a larger table than before. Next to him was Lavinia, God of Nature. Beside Jake was Tru . . . and she bent over, retching and throwing up.
“It is shock! She realises where she is and who we are.” Lavinia told Jake. “It is not a normal thing to suddenly find yourself in the land of the Gods. And Britannia is one of the better lands.”
Jake shrugged. He had been almost kidnapped to get him here.
Another man appeared, sitting at one of the other seats. He was tiny, less than five feet by a few inches and of incredibly small build.
“May I introduce Mathos, God of War. I do not think you have met him before. This is Sapient, our hero for all.” Kaelin did the introductions.
This was the God of War, thought Jake. War-Gods were normally huge well-built men looking more like the blacksmith or like Jake’s new form than this tiny little runt.
“This tiny little runt made us the supreme nation many times. It is because of him and the God of Prosperity that once the British had an empire.” Lavinia commented and he remembered she could read his thoughts. Mathos, the tiny little runt, just laughed.
   “I may be only a little one but . . .”
“But he is a master of war.” Cut in Lavinia. “His Second World War African Campaign was brilliant. He also, despite his size, is the most dangerous being in the world in anything to do with violence. He is the best hand to hand fighter . . . although Ares, the Greek God of War disputes this. He actually invented some of the martial art styles, together with counterparts from China, Japan, Israel, etc. No-one can beat him in a fair fight, or even an unfair fight come to that. He is a master of weaponry. From handguns up to spy planes to artillery.”
“She is only saying that because once she courted me.” Laughed the jovial little God of War. “Unfortunately, I was busy with the campaign against China. Yes, we beat the mighty China in two wars. Marriage for me is really not an option. I am always busy, you see. Mortals do like war and I have to be ready to help them.”
Jake was surprised. The stunningly beautiful Lavinia wanting this tiny little man.
“This tiny little man has more tricks up his sleeve than a conjurer on his best day. Plus, he is a happy little soul. He is more joyful than Kaelin and he is the god of happiness.” Lavinia commented, obviously reading his mind again. Jake wished she would not do that. Mortals liked to be able to think without eavesdroppers stealing their thoughts.
“Sit down so we can converse.” Said the little man.
Jake sat and just after, Tru, now only retching sat down next to him. Cups of coffee appeared before them. Gratefully Jake took a sip. Oh, how good coffee of the Gods was.
“Bloody hell, this is good coffee.” Tru said in appreciation of the taste. “Does he get a reward for delivering that letter? He had to break bones to get it.” She giggled. “Actually, he did one gratuitously but he got the job done.”
Jake placed the ancient coin on the table and Kaelin took it and smiled.
“We were watching.” Said the tiny god of war. “He did not smash the man’s kneecap gratuitously. He had a reason. It was to put the man out of action, so his enemy could render no more violence. Even if that man woke, he would not be in any condition to fight. It was not only fair in my opinion, it was a good decision. Maybe better than killing him which was the other option.”
“I have never killed.” Jake told them. “And I do not get a prize for this. That goes to . . .”
“Yes, yes.” Lavinia said, almost annoyed by the sound of it. “She is to get the prize. You chose for her to get the boon.” Lavinia touched Tru. She then leant across and whispered in Tru’s ear. Tru giggled, a lot. It seemed the boon was one of quality and maybe mischief. Lavinia then addressed Jake. “You may not know the gift until she tells you.”
Jake shrugged. All he had wanted had been accomplished. For the prize to be given it seemed probable that Tru would have to be summoned to the Land of the Gods. That had been the idea for his present.
“Ah, you outwitted me and I able to read minds.” Lavinia told him but she did not seem displeased. She then put a finger to her lips to show the others that was not a matter to be discussed.
“I have a favour to ask of you, young mortal.” Spoke the God of War.
“I gathered that. I am not as green as I am cabbage looking. You arrived at the table. It was fairly obvious you were going to ask me to be your agent in some matter.”
“‘Green as I am cabbage looking’. A quote from the emperor Augustus himself, very good.” Smiled the God of Happiness.
“It is good your woman is here.” Mathos, God of War cut in. “She knows of the person I am going to speak of. This however is your mission and she should have little to do with it. Lavinia . . .”
“Keep your nose out. This is your goddess telling you that.” Lavinia said to Tru. “Defy the gods and expect to be cursed.”
“Yes, your holiness.” Tru said deferentially but there was a glint in her eyes. Lavinia just laughed. So did Jake.
“She can read your mind Tru.” He explained and Tru blushed.
“I wish you to bring a certain person to see me. I will be in mortal guise in your home town. You will escort the person and be his bodyguard.”
Jake was about to protest he was no bodyguard but tiny Mathos continued.
“The person’s name is Mr Han. I wish to meet him. I want his help in a delicate matter.”
“He cannot be a bodyguard.” Lavinia told Mathos. “He can fight, he has had to, after the gods cursed him. But he has no skill. He just fights to scare people. He is a bone-breaker. Bodyguards are trained men, men with skills.”
Lavinia was telling Mathos what was running through Jake’s mind. For once Jake did not care. The words came better from her. She was, after all, a goddess.
“I know that.” Mathos made a girlish giggle. “I can see a mortal and know how well they fight just by looking at them.”
Mathos now had a ball of steam in his hands.
“I am going to give you a martial art to help you with this task. Succeed and get more skills, one of your own choosing as long as it is in my purview.”
Jake caught on. Do this and gain a warrior’s talent. It could be a martial art, weapons training or even strategic ability. All were in this god’s range.
“I don’t know jack about martial arts. What I need is an unarmed combat skill. One that has bits and bobs of everything. So, I can just use my skills the best way at the time of trouble.”
The steam in Mathos hand changed to a ball of red gas.
“Attacking or defending. Judo is more of a defensive martial art than say karate. Offensive or defensive.”
“That is what I am on about. It has to be a mix of everything. Sometimes it is better to defend than to spark the bloke out and get others attacking you. Sometimes you take the biggest one down and the rest are cowed.”
“Well put.” Mathos commented with no sign of humour. The ball of red gas changed to a green mist. He blew on this and it flowed to surround Jake and then closed in on him. His body seemed to absorb it. It was slightly painful but somehow pleasurable all at the same time Jake thought.
“You sure of the person? Let me make it clear. You want the owner of a Chinese takeaway for a sit-down meeting?” Jake could not work out what use a middle-aged takeaway owner would be for a God of War.
“Mr Han, yes. Here is a gift to persuade him.” Now in Mathos hand was a good-sized ruby, luxuriously red. “He will get this if he agrees to accompany you to meet me. I will be called Mr Temple.”
“No.” Lavinia said to answer Jake’s thought. “Mathos will not be taking over a human body. He can materialise anywhere on Earth in human guise. He is the best one at that. Most of us are restricted to England or Britain. He can go anywhere in the world. It is to do with his work.”
   “My friends call me Matty!”
“I am sure they do.” Jake replied with just a touch of sarcasm.
The idea of calling a God by a nickname appalled Jake.
“Oh my, how quaint. He does not believe a god could ever befriend a mortal. He is actually quite shaken by the idea. He thinks you are trying to play him. Not bad thinking. Most of the time we do not actually even like our worshippers. We just like the fact that they worship us …” Lavinia let all know Jakes secret thoughts.
“Get out of my head!” Jake shouted at her and then was scared.
Mathos just waved a hand loosely at Lavinia.
“Just lock the door.” He told Jake.
Jake pictured in his mind a long stone wall, impossibly high. In that wall was set a steel door. He barred that door. He threw the two bolts across. He carefully turned the keys in both locks.
“Spoilsport!” Lavinia said, though Jake did not know whether the comment was for him or the God of War.
“He is actually quite wrong.” The tiny man said to the Goddess of Nature. “He has a violence in him that if controlled would make him very dangerous indeed. And he has what most other warriors do not, a mind. A true capable working mind. He will see I can be his friend after he has delivered Mr Han to me. It was not that he knew Mr Han that he was picked. I have other followers in Burchill, each of them know Mr Han, each of them could bring him to me. It is not even that he is a hero for the Gods. It is the viciousness in him, something you other Gods bred into him. Something dark, something dangerous, something intangible. That is why he is picked for this job. I wish to know more about him.”
   Jake picked up the ruby.
“I like Mr Han. He probably just sees me as another customer but I like Mr Han.”
“Oh no harm will come to Mr Han. You are to be his bodyguard after all. Even against me. It is just a meeting. One that he will be amply rewarded for. That ruby in your hand is worth ten thousand dollars American. Something like . . .” He cocked his head for a second. “. . . Eight thousand pounds. Oh, how the exchange rate has changed. I remember when you could get four dollars to the pound.”
“Trust him.” Tru said. “What do you have to lose? You will make sure Mr Han is safe. If this one wanted to kill Mr Han, he would be dead. Same with maimed. It is only humans that could try it and you have skills now, so does Mr Han. We have all heard the stories.”
“You are to stay out of this!” Lavinia reminded Tru who tried to look innocent. The Goddess of Nature just laughed, that mirth sounded like a melody of tiny bells. Jake knew why she was laughing, he was stifling a laugh himself. He had a way of keeping Lavinia out of his mind now, maybe. Obviously, because of the goddess’s reaction Tru had not used the same trick.
They then were back on Earth, back in Burchill, outside of Mr Han’s takeaway shop. It was much too early for the takeaway to be open however. Its opening hours were from five to midnight. It was still morning.

Why we wait
A guest blog by Sukhi ...
Tumblr media
Created with Bing Image Creator, 10th December 2024
So much waiting!
Maybe it's been an unlucky month, but I'm noticing more and more how much I simply have to wait around for other people to do things.
It's not like this in 'Space Ace'. I guess that's one of the reasons why I like gaming - no waiting around for other people.
We British are stereotyped for our love of queueing (the 'national sport') but if that were ever true, those days are certainly long-gone. Now, I think most of us thoroughly dislike waiting—especially for something simple. I know Vanessa feels the same way, although she's a bit more patient than I am.
So why are we seeing more of this all the time? It's pretty ironic, in this digital age, when so many things seem to move so much faster.
Well, we've got increasing strain on public services like healthcare. So that's a factor. But there's something more insidious going on. Something that seems to apply equally well across healthcare, and higher education, ... in fact across all industries. We're all trying to do too many things at once. We're caught-up in the drive for efficiency.
Colin told me a couple of years ago that the main reason houses sell so slowly in the UK is because conveyancers (the lawyers handling moves) each run over 100 cases at the same time. That's mind-blowing if it's true. But even if the number is half that, I find it almost impossible to image how they stay focused. And with so much context-switching, it's hard to imagine how they would ever complete even one case. Certainly it would explain why so much chasing is needed on both sides of the sale.
We might expect that efficiency and speed come together, but I've been polling opinion in the Digital and CTO communities, and interestingly efficiency is often at odds with speed.
When we seek to maximise efficiency, blinkered to other objectives, we often home-in on spare cycles and fill them with extra work. But putting more load into a system tends to create more queues (see Little's Law). It can easily overload other parts of the system, but also makes the focus part less tolerant of any unplanned load.
In fact, graphing the implications of the law shows that wait times increase dramatically once any part of a system is busy more than 80% of the time. If we want speed in any unscheduled system, we need lower utilisation.
And if we're waiting for someone else to do something, but still measured on utilisation, how do we react? Instead of waiting patiently, we go off and do something else, meaning others are now more likely to be waiting for us! There's a compound effect here that's often overlooked.
Turns-out that the whole world is caught-up in this outmoded mindset.
On the bright side though, it's a great argument for digital transformation. If we can automate work, we can speed it up, and allow one human to self-serve at their own pace.
And it's a great argument for Agile too. At Ridgemoor we're always keen to 'unspecialise' our teams, creating fast-moving, multi-skilled squads so that (even with work we can't codify in advance) we can get stuff done without sitting in a succession of queues. Every time an unfamiliar task comes along, we just get on with it, instead of looking around for the cavalry to come.
So that's my message of hope. And another reason I'll be advocating for Agile everywhere I go! Looks like Carla is inspired to take-up the cause, and I'll be first in the queue to help her!
The views expressed in this article are Sukhi's alone, and don't necessarily reflect those of anyone in the real world ... except perhaps Jeremy's.

Can you sell a house without a gas safety certificate?
Selling a house means you’ll need to navigate various legal requirements and ensure that the transaction is compliant with all necessary regulations. One crucial aspect of selling a house is the gas safety certificate. What exactly does this mean for sellers and buyers?
What is a gas safety certificate?
A gas safety certificate, also known as a Gas Safety Record, is a legal requirement for landlords. It ensures that all gas appliances, fittings, and flues are safe for use. This certificate must be issued by a Gas Safe registered engineer and renewed annually. Landlords must provide a copy to tenants within 28 days of the check and to new tenants before they move in.
Related: What are title deeds and what happens if you lose them?
Legal obligations
If you’re selling a house with gas appliances (such as boilers, ovens, or heaters), you are not legally required to provide a gas safety certificate to the buyer. However, you must ensure that all gas appliances are safe for use. It’s advisable to have a recent gas safety certificate or a record of recent checks to assure potential buyers that the property meets safety standards.
Implications for sellers
While not mandatory, having a valid gas safety certificate can expedite the selling process and build trust with buyers. It demonstrates that you have maintained the property adequately and can provide peace of mind regarding the safety of gas appliances.

From a buyer’s perspective
As a buyer, it could be useful to inquire about the gas safety certificate during the conveyancing process. Although not a legal requirement for the seller to provide one, you can request recent gas safety records or consider arranging an inspection yourself. This ensures that you’re aware of any potential gas safety issues before completing the purchase.
What certificates do I need to sell a house?
There’s an abundance of documents involved in selling a house, including:
Identification – As a seller, you’ll need proof of your identity and address. This could either be a driver’s license or a passport.
Proof of ownership – You must provide a legal document which proves your ownership of the property you’re selling. Your title deeds are stored digitally by the HM Land Registry and provide details about the home’s ownership history. You can obtain these documents through the Land Registry website.
Building regulations certificate – If the electrical work on a house was changed after 2005, you need a Building Regulations Certificate for Electrical Work in order to sell it.
Energy Performance Certificate (EPC) – Your home’s EPC rating shows your home’s energy efficiency score. You’ll need a valid and up-to-date EPC to sell your home.
Planning permissions – If you have made any alterations to your property, a planning permission certificate will be required to prove that the works were carried out legally.
While you can technically sell a house without a gas safety certificate in the UK, it’s in the best interest of both parties to prioritise safety and transparency. Sellers should ensure that gas appliances are regularly maintained and consider obtaining a gas safety certificate to facilitate a smoother sale. Buyers should also be proactive in verifying the safety of gas appliances to protect themselves and their investment.

One of the most crucial aspects of the home-buying process is navigating the complex legalities of property transactions. However, whether you need a conveyancer to buy a house in Australia often arises.
It is the property lawyer who is an expert in house buying. They act as your translator and an adviser to guide you through complex property buying and selling processes.
Let's explore the role of conveyancers and whether their expertise is essential for a smooth property purchase.

Understanding the basics
Before delving into the need for a conveyancer, it's essential to understand their role in the real estate process. A conveyancer is a licensed professional responsible for handling the legal aspects of property transactions.

Contract To Completion: The Journey With A Skilled Conveyancer

"Simplify Your Property Transactions: Trusted Conveyancer Melbourne, Making Conveyancing Hassle-Free". So, when you buy a house, the first thing that comes to mind is ‘when can I move in?’. However, buying a house is a process that involves many steps and it isn’t as simple as signing on the dotted line. You need to get all your finances in order and ensure that you have everything ready before you go ahead with the purchase of your new home. To make this process easier for you, here are some tips on how to find the right conveyancer:
What is a conveyancer?
A conveyancer is a person who deals with the transfer of property. They are legal professionals and not lawyers, although they may work alongside lawyers in their practice.
A conveyancer deals with different aspects of buying or selling a property including:
Preparing contracts for sale or purchase.
Advising on title searches and searches for encumbrances (such as mortgages) on land titles.
Preparing deeds and mortgages that are needed to secure finance
How to choose the right conveyancer?
When choosing a conveyancer, you should look for someone who is experienced in the area where you are buying.
They will be able to guide you through all of the local regulations and requirements, as well as help with negotiations with other parties involved in your purchase.
Make sure that they are members of professional organisations such as the National Association of Conveyancers (NAC). This means that they have met specific standards set out by NAC and that their work has been reviewed by other professionals within this field.
You can then ask them for references from previous clients so that you can see how satisfied they were. With their service before deciding whether or not one particular person meets all your needs perfectly.
Things to consider before engaging a conveyancer
When you're looking to engage a conveyancer Melbourne, there are certain things you should consider. These include:
How long they have been in business?
How many conveyancers they have?
What states do they operate in?
Their reputation among clients and peers. If you need help finding out more about someone's reputation, check out their Google reviews. You can also ask other people who might have used this service before if they were happy with it and why or why not (and if so, how much did it cost).
A good reputation is another important factor when choosing a conveyancer and you want something who is professional.
It is important to find a conveyancer who you can trust and who can help you get through the process smoothly.
A skilled conveyancer will have an in-depth knowledge of all aspects of the transaction, including:
The market and what it takes to sell your property in that area.
The legal requirements for buying and selling real estate .
Tax implications around purchasing or selling property, as well as stamp duty payable on sale contracts.
Conclusion
It's important to note that the conveyancing process is not always a smooth one. There are many pitfalls for buyers, sellers and conveyancer Melbourne alike. However, with the right knowledge and experience of what to expect, you can make sure that your property transaction runs smoothly from start to finish.

House Stuff
People over on my twitter are very aware that I'm currently in the process of selling one house and buying another one.
It Is So Stressful, and so much of it is like.... fake stress. It's stupid stress, because the house I'm buying is a new build* and they have set an exchange deadline for one month from now.
Which means they want us to exchange contracts by then,or the house we have reserved will be given to another buyer. APPARENTLY.
Now, selling and/or buying a house is a HUGE legal hassle. So huge. Bigly, even. There's like, searches and deeds and environmental reports and surveys and all sorts of crap. It's not the kind of thing you can do in a month unless you're a cash buyer, meaning you don't need a mortgage to buy. You're just rockin' up with hundreds of thousands of pounds/dollars/whatever and going "yep I want that house."
I am, sadly, not that kind of person. I have to sell the house I'm in, which means exchanging contracts wtih my buyer so that they have to actually buy the place, and then exchange contracts with my new place after that.
In a month.
My conveyancing solicitor is like "As long as there is momentum, they'll extend the deadline." Meanwhile, the sales team for the new build is being... pushy, adn not acting like they'll extend the deadline at all.
So if I seem like a bitty ball of angry exhaustion with the creative abilities of a dust bunny in this next little bit, that is why.
* New builds have their issues. They're overpriced and often not the best, environmentally speaking. Unfortunately, the way the housing market is right now means that there is very little choice in our local area, so we're going for what's available.

How to Buy Property in Melbourne ?
Buy Property in Melbourne whiling doing proper research. Melbourne is the capital and most populous city of the Australian state of Victoria. Also, the second-most populous city in Australia and Oceania. Melbourne consistently ranks highly in worldwide surveys for buying property in Melbourne, and it's easy to see why. Everyone loves to buy property in Melbourne, both locals and tourists, because of its international atmosphere, the thriving cultural sector, and welcoming café culture. In addition to the Yarra River and one of the world's largest tram networks. Buy property in Melbourne because Melbourne is Victoria's administrative, recreation, cultural, and commercial centre.
Tumblr media
You also have a lively mix that appeals to long-term residents and visitors to Australia's second-largest city, including St Kilda, Brighton, Elwood, Port Melbourne, and Docklands. Residents of the city have access to various recreational opportunities, including greenery and marked walking and cycling trails. Municipalities like Melbourne City Council have made sustainability commitments that include greenhouse gas reduction, reduced water usage and sustainable construction. An exciting part of buying a house in Melbourne is exploring what's available on the market and starting to build a new life for you and your family.
To find the perfect home for you and your family and buy property in Melbourne, you'll need to do some research and think carefully. If you're looking for a home in Melbourne, you'll want to make sure it's the right size and price for your lifestyle. To get started, check out the information provided here. Great if you've already decided where you want to buy a property in Melbourne. When in doubt, however, it's a good idea to look in a variety of areas. The prices of properties in neighbouring suburbs and within a single suburb can be vastly different. Research past sale prices in the localities and streets you're interested in, as well as current market conditions.
To get the price you want, you'll need a top-notch real estate agent in Melbourne to buy property in Melbourne, no matter what your real estate needs are. However, there are top real estate agents in Melbourne who have a track record of delivering better results for their clients to buy property in Melbourne.
Know your potential agent's experience and expertise before hiring them. As a result, you must inquire about a real estate agent's sales and closings in the last six months.
- Do you have any recommendations for me?
Where do you stand in terms of your marketing and negotiation strategy?
If so, do you work in a group?
- On average, how long does it take for your listings to sell?
One of these questions should raise red flags for any real estate agent.
A private sale or an auction is the most common method of selling a home.
You have the option of paying the advertised price or negotiating a price with the seller. Commonly, real estate agents handle the coordination of private sales. In an open forum, you can compete with others to buy property in Melbourne.
Auctions have a "selling range" provided by the real estate agent, but properties often sell for more than that. The vendor can accept or reject an offer in both types of sales (before the auction). Until you and the seller have signed a Contract of Sale or Contract Note, your written bid is not legally binding.
1. Identify your goals.
Like everything else in life, you need to decide what you want to buy property in Melbourne and where you want to live for a long time. Is it more vital for you to buy a 1-bedroom apartment in the city centre or a 3-bed detached house out in the suburbs? It's best to know what you're looking for because they may be the same in terms of price. Consider the impact on your life. You're worried that the commute will be too much for you? List a few negotiables and non-negotiables that you're willing to compromise. Then make a decision.
2. Go to auctions and bid on items.
If you're participating in the auction, it may seem tedious, but observing the auction proceedings has a lot of value. By attending auctions, you can learn strategies and know how much the market is willing to buy property in Melbourne
that checks various boxes for you. You can also understand real estate jargon such as pass in, reserved price, etc., and observe people who could potentially be your competitors for another property or even neighbours.
3) You must keep a copy of everything.
I can't emphasise this point enough. There's a good chance you have at least 20 percent of the property's value, but you may not have enough to cover the other costs of buying and moving into your new home. Please note that to buy property in Melbourne (your dream property or even a house) with significant potential for renovation, you must have Section 32 checked by your conveyancer or solicitor. Determining whether or not there are any building defects or pests on the property is also a good idea.
4. Do your research on the area in which you'll be purchasing a home.
You'll probably find a handful of properties in Melbourne based on your search criteria. Take care to familiarise yourself with the area before you go out there, however. Then take a drive on the first Monday of every month to see how the atmosphere is. How is the traffic situation? The public transportation system in the area is decent. If there isn't a train or a tram in the area, I'm not going to live there. Simply put, you need to keep everything in perspective so that you won't be turned off by shattered beer bottles on a footpath.
Tumblr media
5. Don't give up on your dreams.
Trying to do it on your own can be frustrating because there are so many factors to consider and, various costs are incurred along the journey. Your goal should always be at the forefront of your mind. Choose something that you won't regret later. Taking shortcuts could end up costing you more money in the long run. The amount of money you're about to spend is going to be in the hundreds of thousands. Make sure that whatever you decide to buy is worth every penny.
Pre-purchase inspection of a real estate transaction
To avoid unpleasant surprises, you may want to have the property inspected to buy property in Melbourne and a pest inspection company before making an offer or placing a bid. Depending on what type of inspection is required, report costs can vary significantly.
As a rule, when borrowing money to buy a house, the lending organization will have a property appraiser inspect it before lending. You may also want to get a second opinion. The cost will vary based on the location of the home.
Buying property in Melbourne with the help of a professional
To find and secure property to buy property in Melbourne, you can hire a buyer's advocate. In addition, once your offer has been accepted, you should consider hiring either a lawyer or a qualified real estate conveyancing agent.
The majority of Melburnians insure their homes and possessions while buying property in Melbourne to protect themselves from the risk of loss or damage. There are several different insurance companies. Be sure to connect all of your utilities before you move in. It includes your electricity, gas and water lines as well as your phone line and the internet. Your realtor may be able to refer you to a variety of service providers to buy property in Melbourne.

How Do I Find Excellent Conveyancing Solicitors?
Tumblr media
There are several reasons why you would need to hire conveyancing solicitors. But in most cases, you will require some assistance in either buying or selling a property. These professionals can always be relied on to deal with the things you might not have secured, such as a requirement for an additional legal document.
If you’re planning to hire one soon, listed below are some of the things worth considering.
Recommendations
Family and friends who’ve had a favourable experience in working with such professionals can offer their recommendations to help you narrow down your options on the best conveyancing solicitors to hire. Ask around to see if someone you know has had a good experience with a particular solicitor or conveyancer before getting in touch for a quote.
Size of the firm
When deciding on which conveyancing solicitors fees are worth paying for, the size of the firm sometimes becomes an important factor, too. Some people prefer to use small, family solicitors, while others opt for bigger firms. There are pros and cons to both – you might get a more personal service from a small firm, but if your key contact goes on holiday or is out of the office for another reason, it may mean your purchase is delayed. You could find the service is more impersonal with larger firms, but at the same time, you're perhaps more likely to get a continuous service. Always ask what protocols are in place, just in case your main contact should ever be unavailable.
Price comparisons
Before hiring a professional, you might want to compare conveyancing solicitors fees in the market. The best way to approach the situation is to get a few quotes and decide which one represents the best value. Make sure you compare all the quotes on a like-for-like basis; some firms will include VAT in their quotes, while others might not.
Online conveyancers
While a local conveyancer may have been the first choice several years ago due to their extra knowledge of surrounding areas, nowadays the internet allows for most conveyancing cases to be organised remotely, and non-local conveyancing solicitors can do just as good a job as a local one. The majority of customers will search for a solicitor or conveyancer online, then correspond via email and telephone. If you need to pick up and drop off paperwork or sign documents, many firms will have an office nearby. Generally speaking, though, the conveyancing solicitors will be out doing the actual conveyancing, which is definitely a positive thing.
Recommendations from mortgage lenders
When buying a house with a mortgage, your lender will usually only work with certain approved conveyancers and solicitors who are on the mortgage lender's "panel". If you choose to work with a conveyancer that’s not on this list, you'll have to pay the lender's representation, which could be expensive and complicated. You can use online conveyancer search engines to help you gather the details of conveyancers and solicitors that your mortgage lender is prepared to work with as well as their respective conveyancing solicitors quotes.
Accreditations
One of the best ways to ensure that you're dealing with professionals is by reviewing their credentials and accreditations. For solicitors, this is the Quality Conveyancing Scheme, run by the SRA (Solicitors Regulation Authority) and for licensed conveyancers, it's the CLC (Council for Licensed Conveyancers). Suppose you're finding your conveyancing firm from a reputable conveyancing solicitor. In that case, you can be confident that they will only work with fully accredited firms and operate on most lenders' panels. You can also look at how they check their partners, as they should be very strict in choosing who to work with and that their conveyancing solicitors quotes are market-friendly.
Conveyancing solicitors can work on several cases including buying or selling property or land, remortgaging, transfer of equity, buying at auctions, and shared ownership schemes, just to name a few. In most cases, providing timely information and direction as to the legal process are what clients require of conveyancers or solicitors, so be sure to find one who can guarantee you these things. If you need any of these services, feel free to cite the things listed in this guide for your reference.

Getting or selling a house is possibly the biggest 'deal' in your life. A key component of this is selecting a vetted solicitor that you can count on.
Tumblr media
1. Look for individual (as well as recent) referrals
Great old fashioned word of mouth is among the most reliable techniques of ensuring you get an excellent service-- in any type of sort of trade. Ask friends and also associates who have actually just recently gotten or offered residential or commercial property if they enjoyed with their solicitor or (qualified conveyancer) as well as whether they would advise their solutions. The evidence, after all, remains in the dessert.
2. Ask the agent offering the residence
The agent in charge of marketing the residence may also have the ability to suggest a good solicitor-- nevertheless, they manage them daily and recognise which ones are much more aggressive as well as which are much less so.
3. Think about a regional conveyancing specialist firm
As much of the conveyancing process is now executed online (or by means of the traditional article) it's not crucial that the firm you select is local to your present home. Nevertheless, if time pressure is on later on down the line, it can be comforting to recognise you can deliver records or picture ID for instance, by hand.
4. Audio them out
While you may not completely understand the ins and outs of what a solicitor does, remember you are a paying customer and it's your right to scope out what you can anticipate in terms of get in touch with, speed and estimated expense.
Constantly telephone the solicitors prior to making an instruction as well as ask to talk to whoever will be dealing with the case. This is also a chance to develop a connection which might verify useful later on down the line.
5. Think of the dimension of the firm
Especially if it's throughout the summer or Xmas holiday, you might wish to take into consideration using a larger firm of solicitors. By doing this, there'll be most likely to be others that can action in as well as cover if your solicitor is off-- as well as maintain that critical momentum going.
6. Don't plump for the most affordable
It's a great suggestion to obtain an approximated repaired expense upfront from your solicitor, do not be lured to simply head directly for the most affordable. The stating, "if you pay peanuts you obtain monkeys," is one that occurs. My advice is to choose high quality.
Both solicitors (who are managed by the Solicitors Regulation Authority) as well as Licensed Conveyancers (who are managed by the Council for Licensed Conveyancers) are completely managed as well as insured. See our overview on conveyancing costs to offer you an idea of what conveyancers as well as lawyers consist of in their fees and also just how much you should anticipate to pay.
Home owners Alliance makes it very easy for you to find the conveyancers and also lawyers that our members have actually had the best experience with, by showing you a ranking following to some of the quotes. If the solicitor or conveyancer is not thorough and efficient in sending off the ideal little bits of paper at the right time, they can create substantial hold-ups to the procedure. - Some conveyancers and also solicitors can be hard to get hold of, making it hard to track exactly how your situation is going, or to get any kind of inquiries answered.

Three Step Guide on How to Haggle in the Current Property Market
Tumblr media
The present market is back in the doldrums and when the property market is falling, past experience tells us it's a really great time to bag a bargain and buy a house at a discount that you are unlikely to get in the coming a long time. Here's a step by step guide on how to buy a property by haggling down the price. 1 . Get your finances sorted! The important thing success to securing a bargain property is to be able to buy quickly. This means you need to have either cash and as good as cash with a hefty deposit and a lender that is capable of making funds available in a few weeks, rather than the usual six weeks they take. 2 . Find a legal company which can exchange quickly The legals for dealing a home can take months. Much of this is down to poor conveyancing companies. So if you want to bag a bargain, it's important to ensure you work with a legal company that can work to tight deadlines and isn't reliant on one people to do the work, in case they go sick or on holiday. 3. Understand where to get property bargains Property bargains are generally secured when people are desperate to sell. There are lots of reasons why someone might sell a property at a bargain price such as: - (a) The three 'D's -Death, Divorce and Debt Sadly things happen in life to help homeowners that force them to have to sell their property at less than it's worth. If someone dies, an associate might need to sell up as they can't afford the property anymore or they need to move nearer to friends and family. When a couple aren't getting on and divorce is the only option, not everyone can afford to stay in their house, particularly with so many families having two working parents. Debt is a rough thing, particularly in a lot of these difficult times, so when it really bites, selling up and releasing the equity is sometimes the only option. (b) Repossession For a property to be repossessed, the procedure takes sometime - it can be six months or more. If the owner may be to court they will often be given/be advised to try to sell the property themselves to get the best price they can rather then have the property taken off them and sold on incurring increased fees for doing so by the lender. This can be a terrific source of bargains, but can be like finding a needle in a haystack, unless you are happy to hang around the legal courts. They are either sold through agents, to 'quick sale' companies or via local auctions. (c) Stringed falls through If someone has sold their property and made an offer on another one, then their own buyer pulls out, this can cause a chain to breakdown unless another buyer can be found at short see, so a great time to be able to offer less than the property originally sold for - as long as you can move within a issue of weeks to replace the previous buyer. (d) New Build Properties Developers run businesses and businesses get targets to achieve. So at the end of the year, or even the half year, the sale of one property may well mean bonuses all round for the developer's staff. This is when dropping a property's price is worthwhile. Since is selling off the 'last two' properties to free up expensive site sales offices and staff. (e) Half and Half Homes At the moment, buyers are making offers on properties which are either pristine in addition to ready to move into or a wreck which needs a lot of work (new kitchen and bathroom, re-decorating). Half along with half homes which are partly pristine and partly a wreck therefore just aren't selling, so after having a long time waiting for a buyer, vendor's are more likely to drop their price. These properties can take a while to protected at a bargain though, as it often takes vendors more than six months to realise they aren't going to discover the price they had hoped. (f) Properties needing substantial work Many people want to do a up a property, but it does not necessarily really mean they want to get their hands dirty. Most 'do-er uppers' are really looking for somewhere they can move into in that case upgrade the decoration and put in a new kitchen and bathroom. The real bargains come when a property must have gutting - or already has been, if it's been fire damaged, wrecked by previous owners. So a smaller amount buyers trying to compete to buy these properties means you are more likely to 'bag a bargain'. (g) Properties using 'undesirable' neighbours Most properties are sold when they sit next to another property or overlook lots of beautiful country side. Those though that have a pylon in the back garden, front onto a busy road (although less which means that in city centres), next to schools, or a dilapidated property, tend to sell for a lot less than those within a better location. In a falling market these are the toughest properties to shift, so you can make pretty small offers and if the vendors can still move on, your offer may well get accepted. So if you want to deal to bag a bargain in the property market, it's essential to sort out your finances, sign up a proactive authorized company and find properties where vendors are likely to be 'motivated sellers' and let you have the property for less than they would in the event the property market is buoyant.
