Background
The petitioner, Harmeet Singh, had filed a suit for a perpetual injunction against the respondent-landlord, Desh Deepak Gupta.
The petitioner sought to restrain the landlord from evicting him from the property in his tenancy without following due process of law.
The Civil Judge (Junior Division), Raebareli, dismissed the suit at the admission stage, relying on Section 38(1) of the U.P. Regulation of Urban Premises Tenancy Act, 2021, which bars civil courts from entertaining suits related to matters covered by the Act.
The petitioner then filed a revision, which was also dismissed by the Additional District Judge, affirming the Civil Judge's order.

Whether the provisions of the U.P. Regulation of Urban Premises Tenancy Act, 2021, barred the civil courts from entertaining a suit for perpetual injunction filed by a tenant against the landlord, seeking protection from eviction not conducted in accordance with the law.
Argument of the parties
Petitioner's Argument
The Tenancy Act of 2021 provides remedies for landlords to seek eviction and recover arrears of rent, it does not include provisions for tenants to file suits for perpetual injunction against eviction. Therefore, the jurisdiction of civil courts to hear such suits was not barred.
Respondent's Argument
There was no cause of action for the petitioner, as the landlord was not attempting to evict the tenant unlawfully.
However, he did not dispute the legal submission that the Tenancy Act does not empower the Rent Authority or Tribunal to entertain a suit for perpetual injunction by a tenant.
Court's Observation
The U.P. Regulation of Urban Premises Tenancy Act, 2021, primarily regulates the relationship between landlords and tenants, conferring specific jurisdiction to Rent Authorities and Tribunals to handle eviction proceedings initiated by landlords.
However, it does not provide any provision under which a tenant can file for perpetual injunction against apprehended eviction. Therefore, the jurisdiction of civil courts to hear such suits remains intact.
The Civil Judge failed to exercise jurisdiction vested in it by law, which rendered the lower court orders unsustainable.
Court's Order
The High Court allowed the petition, setting aside both the order of the Civil Judge, Raebareli and the order of the First Additional District Judge, Raebareli. The case was remanded back to the Civil Judge to pass fresh orders on the admission of the suit.

"High Court Upholds Injunction: Disputed Land Construction Halted Amid Ancestral Property Claims"
If the property is found to be Joint Hindu Family Property, any sale of a specific piece of land without partition is impermissible.
The case involves a dispute over land that was purchased by the petitioners.
The petitioners filed this petition under Article 227 of the Constitution of India to challenge the temporary injunction orders passed by the 9th Civil Judge Junior Division and the order was affirmed by the 4th District Judge, Rewa. The injunction restrained the petitioners from raising construction on the land they purchased.
The respondents had filed a suit in 2012 seeking a declaration of title, partition, and injunction, along with challenging the validity of Wills and Sale Deeds related to the disputed property.

Legal Issue

Argument of the parties
Petitioners submission: Argued that since the sale deeds were executed during a time when no temporary injunction was in force, they should not be restrained from constructing on the land. They also contended that the purchasers (petitioners) were bona fide buyers, and the injunction causes irreparable loss.
Respondents Submission: Claimed that the disputed property is ancestral and has not been partitioned, so the sale deeds executed by defendants were invalid. They argued that the land could not be alienated without partition, and the injunction was necessary to preserve the status quo.
Court's Observation
The Court observed that under Section 52 of the Transfer of Property Act, any sale deed executed during the pendency of a suit does not become void but is subject to the final outcome of the suit. The Court also noted that if the property is found to be Joint Hindu Family Property, any sale of a specific piece of land without partition is not permissible. Therefore, the lower courts' temporary injunction was appropriate to prevent potential irreparable harm.
Order:
The petition was dismissed by the High Court, the Court didn't found any jurisdictional error in the orders passed by the trial and appellate courts. The temporary injunction order restraining the petitioners from raising construction was upheld.
