The Supreme Court on Monday refused to entertain a petition challenging the cancellation of the UGC-NET 2024 (University Grants Commission-National Eligibility Test) examination on the basis of alleged paper leaks.

On Monday, the Supreme Court dismissed a petition contesting the government's decision to cancel the UGC-NET examination following allegations of a question paper leak. The court stated that intervening at this stage would create disorder and uncertainty, stressing the importance of stability for the students who are set to take the exam.

⚖️ The bench, led by Chief Justice D Y Chandrachud, along with Justices JB Pardiwala and Manoj Misra, noted that the government has rescheduled the exam for 21 August, as reported by PTI.

Chief Justice Chandrachud remarked, "Considering the petition at this point would only exacerbate uncertainty and lead to complete disorder," underlining the government's need to exercise greater caution in light of previous examination scandals such as the NEET-UG issue.

📜 Earlier, the Supreme Court had dismissed a Public Interest Litigation (PIL) filed by a solicitor on the same matter, pointing out that it had not been initiated by the affected candidates themselves. The CJI stated, "Why are you (solicitor) approaching us? Let the students come forward themselves," making it clear that the court was not offering an opinion on the case's merits.

📰 The original petition challenged the Union Education Ministry and National Testing Agency's decision to annul the UGC-NET exam, a decision taken due to concerns that the exam's integrity had been compromised. Recognizing this problem, the Central Board of Secondary Education (CBSE) and the University Grants Commission (UGC) have implemented guidelines to address sexual harassment and create safer spaces within educational institutions. UGC writes to Tamil Nadu chief secretary over appointment of VCs to state universities in violation of UGC norms

UGC has warned that the appointment of a vice-chancellor in violation of the higher-education regulator's norms shall be "null and void" and can lead to legal complications.

The University Grants Commission (UGC) has written to the Tamil Nadu chief secretary, objecting to the constitution of search-cum-selection committees for the appointment of vice-chancellors to state universities without a nominee of the commission chairperson, sources said.

Referring to a notification dated September 13 in the Tamil Nadu government gazette to constitute a search committee to recommend a panel of three persons for the selection of vice-chancellor for the University of Madras, the UGC has warned that the appointment of a vice-chancellor in violation of the higher-education regulator’s norms shall be “null and void” and can lead to legal complications.

“The UGC has pointed out a Supreme Court judgement from last year, referring to the appointment of the vice-chancellor at Sardar Patel University, Gujarat. The Supreme Court had noted that the appointment of vice-chancellors cannot be made dehors the applicable UGC regulations, even if the State Act concerned prescribes diluted eligibility criteria vis-à-vis the criteria prescribed by UGC regulations,” a source said.

Tamil Nadu Governor RN Ravi and the state’s DMK-led government have been at loggerheads about the appointments of vice-chancellors.

The present issue began on September 6 after the governor announced the constitution of three search-cum-selection committees to appoint vice-chancellors to three institutions — the University of Madras, Bharathiar University in Coimbatore and the Tamil Nadu Teachers Education University in Chennai.

He also introduced a fourth member in the committee by nominating a person on behalf of the UGC chairman.

On September 13, the state’s higher education department issued a notification for a search-cum-selection committee by excluding the nominee of the UGC chairman, which, the governor termed an “act of impropriety” and demanded the state withdraw the notification.

There has been no vice-chancellor for the University of Madras for four months and for nine months at Bharathiar University and Tamil Nadu Teachers Education University.

WHAT IS A WILP B.TECH. DEGREE?

Governor Khan should not conflate role as Chancellor with constitutional duties

Kerala Governor Arif Mohammed Khan has declared that he is withdrawing his pleasure as far as Finance Minister K.N. Balagopal is concerned. He expects constitutionally appropriate action by Chief Minister Pinarayi Vijayan. In other words, Mr. Khan wants Mr. Balagopal dismissed for remarks that he sees as seditious, undermining national unity and stoking regionalism. However, Mr. Vijayan has rejected the demand. It is difficult to agree with the Governor’s assessment that an observation that those who had seen only universities in Uttar Pradesh would not understand universities in Kerala is seditious or goes against national unity. In normal circumstances, when the Governor conveys his displeasure with a Minister’s conduct, it will have considerable persuasive value. However, in the backdrop of the unrelenting acrimony between Raj Bhavan and the Cabinet, it may have not evoked any serious response. Needless to say, the polite phrase in the Constitution that applies the doctrine of pleasure to a Minister’s tenure is nothing more than a reference to the will of the Chief Minister on the continuance or dismissal of a member of his ministerial Council.

This constitutional position, however, does not mean that the underlying controversy over the appointment of V-Cs to universities in Kerala can be brushed aside. After the Supreme Court set aside the appointment made in the A.P.J. Abdul Kalam Technological University, Thiruvananthapuram, Mr. Khan directed nine other V-Cs to resign, flagging what he felt were similar legal infirmities in their appointment. His point was that just as it was in the case before the apex court, these V-Cs too were either appointed by the submission of a single name by Search Committees (instead of a panel of three to five names, as required under UGC regulations), or were chosen by committees that included the State’s Chief Secretary. The Governor/Chancellor was obviously wrong in fixing a short deadline for their resignation, and he subsequently converted the communication into show-cause notices to them, asking them to explain why their appointments should not be deemed illegal. It is a separate legal question whether the judgment in the case of one V-C is automatically applicable to all others. However, given its potential for litigation, the sooner the university statutes in Kerala are brought in line with the UGC regulations, the better. However, there is no doubt that Governor-Chancellors should not conflate their statutory powers to handle university matters with their constitutional role in Raj Bhavan. The tussle makes a good case for why Governors, whose overtly political functioning is an uneasy fact of political life, should not be tasked with being Chancellors.
