It's consistent with what he says in his book that he had a huge drinking problem around that time and quit in part because he did irresponsible things sexually including screwing super drunk women. 

I wish there was more nuance here than demonization (of either the accused or accuser) but what he did there what wrong & the person has a right to call out wrong behavior. 

I wouldn't be for crucifying canceling and demonizing someone after he changed himself, especially because that sets incentive for people to never change & only double down, but there is no spinning this as "regret" or "she was just drunk" or that there’s “no proof” (she told ppl at the time including therapists not affiliated) - they recently convincted trump on this level of proof. 

 This kind of act isn't ok and it should be called out so it gets cemented as such in the public consciousness so that people take care not to do it even "accidentally" & that those who have it done to them know it wasn't ok. 

 This is different from the thing with Till; It’s not hearsay or “bad vibes” but a story coming directly from the victim, She wasn't “just drunk” she was barely able to move, they didn't walk to bed together he just suddenly started touching her, he didn't ask and she didn't even agree/want it at the time, this is not a case of regretting or reconsidering & with the statements from her relatives & therapists is highly unlikely that she made it up. 

I don’t think it’s rape automatically because she was 17 (age of consent is 16 and, like, I remember being 17 I I knew what I was doing in more ways than not) BUT you do have a higher responsibility to make sure the other party is comfortable, it could have been her first time. And that was simply not done here at all. He just grabbed her while she was lying there, flipped her back around when she turned away, no talking, no checking in, no communicating.

There is no talk that they were making out earlier or anything, he just lais down next to her. 

She’s totally justified in saying she was “used”. 

To his credit Flake seems to have eventually realized that he was behaving irresponsibly and stopped drinking & seems to regret (if maybe not get the full magnitide of) what he did;

But is totally believable that someone who had a serious booze problem at the time with a history of doing irresponsible & impulsive things (including sexually) while intoxicated could just have done something stupid, irresponsible & impulsive.

He might have thought that she was ok with it but he certainly didn’t show great care there unlike with the Till storys where he’s always asking. He may not be as guilty as someone who, say, held someone down while they were screaming and I’d say calling him a predator (that is, like, a systematic, planned repeat perpetrator) would definitely be an exaggeration but there is just no way this situation could be considered as consensual, no matter how you turn it. 

Honestly, Flake was always my favorite because he was always so chill in interviews & I just liked his hair I guess, but he fucked up there, severely, and he's absolutely responsible for it.
