Last week, the Indian state of Uttarakhand passed a bill to adopt a controversial Uniform Civil Code (UCC), which will bring an end to religious or personal laws governing marriage, divorce, adoption, and inheritance, among other issues. The change will bring all communities together under a common law to regulate those practices. The new legislation has already faced pushback from Muslim leaders and other members of India’s political class.
Indian Prime Minister Narendra Modi and the ruling Bharatiya Janata Party (BJP) hope that Uttarakhand will serve as a model for the introduction of a UCC across India, or at least across BJP-ruled states. Some of these states, including Assam and Modi’s home state of Gujarat, are already considering their own UCC bills and are keen to use the Uttarakhand code as a template, although they may tweak the legislation to address local needs. Despite its seeming impartiality, the UCC pushed by the BJP would be a threat to India’s religious pluralism.
The idea of a UCC has long caused consternation among India’s religious minorities, especially Muslims. Muslim politicians and religious leaders have suggested a UCC would amount to unwarranted interference in their community’s norms, especially when it comes to specific legal protections related to marriage, divorce, and inheritance. The Uttarakhand code even regulates live-in relationships—a clear nod to conservative Hindus, many of whom frown on such arrangements.
These critics’ misgivings are not without merit. The BJP has long pursued three contentious goals that impinge disproportionately on the interests of the Muslim community: the abolition of Article 370 of the Indian Constitution, which granted special autonomous status to the Muslim-majority state of Jammu and Kashmir; the construction of a Hindu temple in the city of Ayodhya on the site of a mosque demolished by a Hindu mob in 1992; and the adoption of a nationwide UCC. It achieved the first goal in 2019, and the Ram Mandir in Ayodhya is not yet complete but was consecrated last month.
However, the idea of a UCC goes back decades to India’s foundations as an independent state. The subject was extensively debated by the constituent assembly that helped forge India’s constitution in 1949, but it was not resolved. Owing to the sensitivities of religious communities, most notably Muslims, no government was willing to tackle the politically fraught question. So why is it the unabashedly pro-Hindu BJP government—and not one controlled by the Indian National Congress party, which is committed to secularism—that has taken up the issue of the UCC? The answer requires a bit of historical exegesis.
The prevalence of separate personal laws for different religious communities in India can be traced to a colonial-era regulation. Warren Hastings, then the governor of Bengal and later the first British governor-general of India, directed in 1772 that “in all suits regarding inheritance, marriage, caste and other religious usages and institutions, the laws of the Koran with respect to the Mahomedans and those of the Shaster with respect to Gentoos [Hindus] shall be invariably adhered to.” In 1937, the British Raj enacted the Muslim Personal Law (Shariat) Application Act, which codified Islamic law for marriage, divorce, succession, inheritance, and other family affairs.
Those who drafted the Indian Constitution debated the necessity of a UCC, with most Muslim members against it. One of the principal architects of the constitution, B.R. Ambedkar, argued that if India could have a common criminal code, it could also have common personal laws, and suggested that a uniform civil code initially be voluntary. The framers instead settled for Article 44, a set of non-justiciable directives that range from prohibiting cow slaughter to curbing liquor consumption. It also called on the Indian state to endeavor toward a UCC for its citizens.
During Indian Prime Minister Jawaharlal Nehru’s first term (1952-1957), the Congress party succeeded in codifying Hindu personal law through four pieces of legislation in the face of opposition. Conservative forces decried the move to meddle with Hindu personal laws, while reformists wondered why the changes were restricted to Hindus alone. But when asked about a uniform civil code, Nehru said that the time was not ripe for it.
The matter largely remained unaddressed until 1978, when Shah Bano—a recently divorced Muslim woman—sued her former husband in a lower court in central India for not providing alimony in accordance with the Indian penal code. The local court awarded Bano monthly basic maintenance, which was later increased by a high court. Bano’s husband, Mohammed Ahmad Khan, later challenged the matter before the Indian Supreme Court. Khan contended that he was not obliged to support his former wife under Muslim personal law because he had paid a dowry and three months’ maintenance.
In 1985, the Supreme Court not only rejected Khan’s appeal, but also came out in support of a nationwide UCC. At the time, Chief Justice of India Y.V. Chandrachud—the father of the current chief justice—asked why Article 44 remained a “dead letter,” noting that the Indian state lacked the “political courage” to enact a UCC. The judgment created a firestorm, especially among the Muslim community.
The Congress government led by then-Prime Minister Rajiv Gandhi responded by passing the Muslim Women (Protection of Rights on Divorce) Act in 1986, which said that maintenance had to be paid only for the waiting period for a widowed or divorced woman, usually three months—effectively nullifying the Supreme Court ruling. The new law doused the controversy for the moment, but it also opened up the Congress government to charges of so-called minority appeasement. Today, the BJP tends to characterize the Congress party and others as placating Muslims and other religious minorities in the name of secularism.
Since the Shah Bano case, several court rulings have whittled away at Muslim personal law—but none more so than the 2017 Supreme Court ruling that determined the practice of instant triple talaq to be unconstitutional. The ruling came in response to women’s petitions challenging the practice, in which Muslim men can divorce their wives by uttering “talaq” (divorce) three times in quick succession. Indians across the political spectrum welcomed the judgment for advancing women’s rights, but some observers saw it as another step toward a UCC. The BJP government followed up with the Muslim Women (Protection of Rights on Marriage) Act in 2019, which made triple talaq a punishable offense.
The UCC indeed has the potential to bolster women’s rights in India by doing away with the anachronistic traditions of some religious groups. But improving the lot of Indian women does not appear to be what drives the BJP. Instead, the party’s pursuit of a UCC appears to be an attempt to stigmatize a particular faith under the guise of enhancing the status of women. (After all, if the BJP were truly concerned about women’s autonomy, it would not have sought to ban the dubious concept of love jihad, which suggests that Muslim men insidiously entice Hindu women into marrying them under questionable circumstances.)
Uttarakhand’s adoption of a UCC is a step toward fulfilling one of the BJP’s key election promises and a staple of its manifestos for the last three decades. Goa is the only other state that currently has a UCC, but its common law dates to the 19th century, when the state was under Portuguese rule. Despite efforts in other BJP-ruled states, a nationwide UCC may be some time away. Still, both Modi and Indian Home Minister Amit Shah have spoken about the idea, with Shah saying recently that the BJP “remains steadfast in bringing in UCC.”
India’s current political climate is far more amenable to the idea of a UCC than in the past. Modi and the BJP are very popular, and unlike the Congress party, they do not rely on Muslim voters to win elections. However, the situation is complicated by the fact that other religious minority groups such as Sikhs, as well as indigenous communities and the Dalit community, feel the potential of a UCC to infringe on religious and cultural rights. (The Uttarakhand code exempts the indigenous peoples of the state, who make up 3 percent of the state population but are present in greater numbers elsewhere.)
The BJP has succeeded in achieving its long-held goals in Indian-administered Kashmir and in Ayodhya. India’s national election is swiftly approaching, and the Modi government has a seemingly inexorable commitment to its Hindu nationalist agenda. If it returns to power this spring with a clear-cut parliamentary majority, the implementation of a nationwide UCC will likely figure prominently in its political priorities, pushing back against what remains of India’s commitment to religious pluralism.

OC Profile Tag
Thanks for the tag @noblebs! Check out the one for their OC Devilant over here!
Going with Ryla for this, and I am also setting this as an open tag, so if you're seeing this and feel a hankering to participate, then please do so!
Tumblr media
Name: Rylanen Pryseia Geshvarel Miraadon
Nickname: Ryla
Kind of Being: Lantean (basically a human with magical powers)
Age: 24
Gender: Cis female
Appearance: 6'2"
Occupation: Opiri Slayer
Family Members: Phaidral Thuvian Dejar Miraadon (maternal grandmother, deceased), Folkaran Zahberok Delerden Shaster Miraadon (maternal grandfather, deceased), Kathera Lakeerask Jedaham Miraadon (mother, deceased), Artaan Osaris Thathal Nolanus Miraadon (father, missing), Camalla “Cam” Vassarus Thelannan Miraadon (eldest sister, missing), and Jineal “Jin” Zena Phassos Miraadon (older sister, missing)
Pets: None
Best Friend: Cadel Cardeau, one of her classmates from her Slayer training days
Describe Their Room: lol I literally made a whole post about this!
Way of Speaking: As a child, the daughter of royalty, she was trained to be both an eloquent and intelligent speaker. As a Slayer, she was essentially given the medieval equivalent to media training, to help uphold the standards of the order. Because of all this, she has a hard time not sounding like she's giving a presentation, even among friends
Physical Characteristics (posture, gestures, attitude): She's tall and athletic, dark skinned and pale haired, with electric blue eyes. Her posture is impeccable, and she's not really one to make a lot of gestures as she speaks (she tends to keep her hands clasped behind her back). Everything about the way she holds herself screams professionalism, and it takes a lot for her to let her hair down, as it were
Items In Their Pocket/Purse: Thanks to magic, she's able to carry literally anything she could possibly need with her, regardless of pocket space, but the necessary items she physically has on her person are a pocket multi-tool, an emergency stash of money, her badge of office, a ration bar, and a knife
Hobbies: Reading, researching history, collecting books
Favourite Sports: Archery
Abilities/Talents/Powers: Thanks to the natural, inborn abilities all Lanteans possess, she's more or less got access to the suite of Wizard spells from D&D. As a Slayer, she's been altered physically to be faster, stronger, and more resilient than your average person, and is able to pull from a deeper well of magic than non-Slayers can (there's a price to this, of course - Slayers often don't make it past their 30's). Beyond that, she's an exceptional orator and diplomat, a skilled swordswoman, and a peerless archer.
Relationships (how they are with other people): Very courteous and professional, if closed off with strangers. Opiri Slayers are able to go wherever the greatest Opiri threats spring up, regardless of borders, due to their stalwart reputation, so it's up to individual Slayers to maintain that good reputation while dealing with the public. Ryla is very mindful of this. With people she knows and likes, however, she's more relaxed and open, though it takes her a lot of trust to be able to open up to people about her less-than-stellar past. People who do get that close to her? She's absolutely ride or die for them.
Fears: That she actually is at fault for all the misfortune that befell her family, and that there is fundamentally something wrong with her.
Faults: Her own well being is her least pressing priority. She will throw herself into harm's way, in order to do whatever she can to help others, without a thought for her own safety. She says it's because she's doing this for the greater good, but it's honestly self-destructive at this point.
Good Points: She's determined, relentless, an unstoppable force that is sent in to take care of impossible problems. She has yet to meet failure, in this regard. She's a cunning diplomat, able to get both sides of a conflict to agree to her terms, and has cooled tempers that were burning for blood. She's the poster child for what an Opiri Slayer should strive to be.
What They Want More Than Anything Else: Not that she would admit it to herself (not that she would even remember it herself, as she's suppressed her own wants and needs for so long), but she wants family. At this point in her life, however, she doesn't think she's deserving of one.

Superhuman Wisdom
There is a superhuman wisdom, sublimity, and majesty in the style of the Bible.
Strange and unlikely as it was, the writers of Scripture have produced a book which even at this day is utterly unrivalled. With all our boasted attainments in science and art and learning we can produce nothing that can be compared with the Bible. To talk of comparing the Bible with other "sacred books" so called, such as the Koran, the Shasters, or the book of Mormon, is positively absurd. You might as well compare the sun with a rushlight — or Skiddaw with a mole-hill — or Saint Paul's with an Irish hovel — or the Portland vase with a garden pot — or the Koh-i-noor diamond with a bit of glass. God seems to have allowed the existence of these pretended revelations in order to prove the immeasurable superiority of His own Word. ~ J.C. Ryle

Mai Bhago
Sometimes called the "Sikh Joan of Arc", Mai Bhago (17th-18th century) was a Sikh warrior woman who is now venerated as a saint in Sikhism.
Born in Chabal Kalan in what is now Punjab, to an important and religious family. She learned Shaster vidya, a form of martial arts taught by Sikh gurus using stick-fighting. In 1705, when the Mughals invaded, 40 Sikhs abandoned their people and their Guru because they were told they would be spared. Mai Bhago openly criticized and shamed them for their disloyalty and rallied these deserters, convincing them to return to Guru Gobind Singh and apologize.
During this time, the Mughals attacked Guru Gobind Singh and forced him and his people forced to flee. They met up with Mai Bhago and her men in Khidrana, where they attacked and defeated the Mughals. All 40 of the men following her died, and Mai Bhago was severely injured, but they succeeded in forcing a Mughal retreat.
After the battle, Mai Bhago became a bodyguard of Guru Gobind Singh, dressing in men's clothes and dual-wielding a musket and a lance (the lance weighed over 100 pounds|45kg). She did this until his death, when she retired.
Today, Mai Bhago is remembered as the first Sikh woman to take up arms against oppressors.

The Hidden Truth: 1.6 Penny Post Paid (20th August 1964).  Written by Roger East; dir. Marc Miller.  Featuring regulars Alexander Knox, James Maxwell, Zia Mohyeddin, George Moon & Ruth Meyers.  Guest starring David Garth, Kathleen Breck & Gary Watson.
Professor Lazard is asked by Grace Barber (Kathleen Breck) to check the authenticity of the Dockwra postmarks on some 300 year old letters belonging to her uncle, middle-aged barrister George Ayestone (David Garth).  But Ayestone has forged the postmarks in order to send the value of the letters soaring, and the investigation could “shatter a daughter’s love for her father.”
[It’s not clear from the write-ups whether ‘daughter’ is an error for niece (given the highlighting of Breck’s role), or an actual daughter (Geraldine Moffatt plays another young woman listed as ‘Moddy’ so it’s possible).  Lazard is “innocently involved in a case of forgery” so the issue for him could be the consequences of proving the fraud, or maybe complicity in having initially pronounced them genuine.]
Gary Watson played Thomas Bazzle, Robert Ayres Julius Shaster, Marianne Deeming was Elsa and Geraldine Moffatt ‘Moddy’ plus John Cater as Frank Dobel and Alan Dudley as the voice of a judge.
The unusual, quirky nature of the story attracted some attention in the TV pages.  Roger East (aka Roger Burford), who had previously written 1.2 “The Shape,” based the story on his father’s tales “about the odd things he had done as a consultant analyst,” combined with his own interest in stamp collecting, “so the subject presented no difficulty.”
Dockwra postmarks relate to the London Penny Post launched in 1680 by William Dockwra, and are very rare and much sought after by collectors.

Tumblr media

No such translation of the Koran
This he admitted; but said that no such translation of the Koran would be or could be the Koran itself; that nobody would or could receive it as such; that it would have no authority, and could have none; and that all their prayers and worship and religious expressions must absolutely be in the ancient language, whether understood or not. I told him that in this respect they were exactly on a level with the Jews, Armenians, Greeks, Coptics, Maronites, Jacobites, lloman Catholics, and even the degraded heathen in India, all of whom had their Shasters and Liturgies in ancient and unknown tongues; that while in business transactions with one another they always made it a point to understand and be understood, in all transactions with their Maker they used words without meaning, and that, in fact, nobody but Protestants even so much as pretended to offer unto God a ‘ reasonable service,’ — a worship intelligible to themselves.
Scriptures into Turkish for the Mussulman
“ The British and Foreign Bible Society have spared no pains or expense in their efforts to procure a good translation of the Scriptures into Turkish for the Mussulman; they have revised, and re-revised, and they are ready to make any further effort which may be required. But my own opinion would be, that they should now wait, and make no further change till the present editions shall be nearly exhausted, or till there shall be a waking up of the Turkish mind to the truth.
When there shall be a class of Turks who desire to know, and to have their neighbors and friends know, exactly and fully what God’s revelation is, it will then be comparatively easy, with their help, to prepare a translation which shall meet their wants and wishes; for it would then be adapted, and intended to be adapted, to the common mind. Learned natives could then be employed in the work, who, like Luther, would be all alive to the subject, from their own personal interest in it, and wrho, being fully’’ capable of appreciating the common mind, w’ould have all the stores of the Turkish language at command, to be used freely for the benefit of such minds.”
