Obrafour sues Drake for copyright infringement
Veteran Ghanaian rapper, Obrafuor has sued American rapper, Drake for copyright infringement. According to details of the suit that has been shared online via the District Court of Southern District of New York, Obrafour is suing Drake for sampling his “Oye Ohene (Remix)” in his song “Calling My Name.”
Details of the suit suggest that Drake had sought permission to sample the song via email but the email was never responded to. He however, went ahead to release the track which was featured in an album days later.
“Obrafour had not yet responded to the June 8, 2022 Clearance Email or the follow-up June 13, 2022 Clearance Email at the point when Drake’s “Honestly, Nevermind” album was released on June 17, 2022. Nonetheless, the Infringing Work is one of the songs appearing on the “Honestly, Nevermind” album, as released to the world by ‘surprise’ on June 17, 2022,” the suit reads.
Based on the success of the song which was on Drake’s highly published, “Honestly, Nevermind” album, Obrafour is asking for $10,000,000 as compensation.
“Obrafour sues for copyright infringement under the Copyright Act, and seeks all remedies afforded to him thereunder, including preliminary and permanent injunctive relief, monetary damages, including but not limited to, actual damages, profits directly and indirectly attributable to from Defendants’ infringing conduct, statutory damages under the Copyright Act in the sum of up to $150,000.00 per infringement where such infringement commenced after the Copyrighted Work was registered with the United States Copyright Office, and other economic relief,” part of the suit reads.

In the early 90s, Ghana’s music scene could be said to have undergone a sort of renaissance. The country’s unique sound; Highlife was being remixed into other genres. But what stood out was Hip-life, a fusion of Highlife and Hip-hop, various artistes, including Reggie Rockstone, Okyeame Kwame, Obrafour and many others took the scene by rapping in the popular Akan Twi. An article published on the official Grammys website on August 21, 2024, attempted to list some notable artistes who had influenced the Hiplife sound with their works. The article listed acts like VIP, Sarkodie, Reggie Rockstone, Obrafour, Black Sharif, Lord Kenya etc The article, however, did not go down well with Reggae/Dancehall musician, Stonebwoy who called out the writer and the Recording Academy for failing to include him in the list.

Ghanaian Artist Obrafour Sues Drake For $10M Over Copyright Infringement
Ghanaian Hip Hop legend, Michael Elliot Darko aka Obrafour has dragged award-winning Canadian rapper Drake to court for sampling his song without permission. In 2022, Drake released the album ‘Honestly, Nevermind’ and on the 6th track, ‘Calling My Name’, he sampled the 2003 remix of Obrafour’s ‘Oye Ohene’. The Ghanaian artiste is suing him in a New York court, saying Drake infringed on his copyright when he sampled his song without seeking his approval. The court documents read; “Defendants released the Infringing Work on June 17, 2022, despite the fact that an agent of one or more Defendants had previously contacted Obrafour seeking to obtain Obrafour’s permission for the use of the Copyrighted Work in the Infringing Work.” “Obrafour never granted Defendants permission to use the Copyrighted Work and the Infringing work was released mere days later”. According to Obrafour, the ‘Hotline Bling’ hitmaker and other defendants in the suit have greatly benefited from the proceeds of the song since its release. The Ghanaian musician is therefore seeking $10,000,000 (Ten Million Dollars) in damages among others. “To date, over the mere 304 days that have elapsed since the Infringing Work was released, the Infringing Work has already been streamed over 4.1 million times on YouTube, streamed over 47,442,160 times on Spotify, and streamed tens of millions of times on Apple Music. “In addition to generating enormous sums of global streams and sales across numerous platforms, the Infringing Work has also been exploited by the Defendants via other means, including live performance,” the document added. He is also seeking an injunction requiring the “defendants and their agents, employees, officers, attorneys, successors, licensees, partners, and assigns, and all persons acting in concert or participation with each or any one of them, to cease directly and indirectly infringing, and causing, enabling, facilitating, encouraging, promoting, inducing, and/or participating in the infringement of any of Obrafour’s rights protected by the Copyright Act.” Read the full article
