Walmart shooting leaves 2 people dead and an officer injured
A shooting at a Mississippi Walmart left two people dead, an officer wounded and a community in shock. The gunfire broke out Tuesday morning at a store in Southaven, the third largest city in Mississippi. Carlos Odom was walking out of the store when "I heard a bunch of gunshots. Pop pop pop pop -- more than a dozen shots," Odom told CNN. "I just thought 'Run!' and ran to my car. This is crazy. The world is crazy nowadays." Both the suspect and an officer who responded to the scene were shot and being treated at local hospitals, DeSoto County Sheriff Bill Rasco said. The stricken officer was wearing a bulletproof vest and "is doing fine" a representative from Baptist Memorial medical center said. The condition of the suspect at Region One trauma center was not immediately known. The names of the two victims killed have not been released. And the motive for the shooting remains a mystery. Southaven, a city of 49,000 residents is near the Mississippi-Tennessee border and is a suburb of Memphis. CNN's Gianluca Mezzofiore and Dylan Miettinen contributed to this report. It was the first time in Mississippi defense attorney Richard Rehfeldt's long career that he can remember where police seized a client's furniture.
In 2012, Rehfeldt says the Hind County Sheriff's Office raided his client's apartment on suspicion her boyfriend was a drug dealer. Anything purchased with drug proceeds is fair game to be seized by police under civil asset forfeiture laws, and they determined the boyfriend had furnished the apartment, so off went her TV, her table and chairs, her couch, her lamps, and even the pictures on the wall.
"Her case is the first in my 38 years of practicing law where they took the furniture," Rehfeldt says.
Under a settlement agreement, all of it was eventually returned. Well, all of it except the couch.
"It is, therefore, ordered and adjudged that one Visio television, one dining room table and chairs, pictures and lamps are to be returned to the plaintiff upon execution of this Order by this Court," the Feb. 10, 2015 order in the Hinds County Court reads. "Additionally, one white couch is hereby forfeited to the Hinds County Sheriff's Office."
The order in her case* is one of hundreds contained in a tranche of court records and data collected by a Mississippi state legislature task force studying asset forfeiture in the Magnolia State. The records, which include forfeiture orders from almost all of the county and circuit courts in the state in 2015, offer a rare glimpse into Mississippi's asset forfeiture machine.
The records show many seizures of cash well over $100,000, the sort of big hauls that police say make asset forfeiture a vital tool to disrupt drug trafficking. But there are also many seizures of petty cash and cars in connection to little more than misdemeanor drug possession charges. Many of those cases ended in settlements, like Rehfeldt's client, where police only partially returned money and property—arrangements that state officials say can give the appearance of a shakedown.
For example, in April of 2015 the Desoto County Sheriff's Department agreed to return a 2006 Chevy Trailblazer owned by the mother of the petitioner, Jesse Smith, in exchange for $1,650. As Reason has reported in several cases, family members, especially parents, frequently have their cars seized for the alleged crimes of their children, even though the parents may not be charged or in any way connected to illegal activity.
According to the Mississippi legislature's Joint Committee on Performance Evaluation and Expenditure Review (PEER), which analyzes government operations, such settlements can be problematic. In a July 15 letter obtained by Reason, PEER executive director James Barber wrote to state lawmaker Mark Baker that "upon a cursory analysis of these orders, PEER staff notes that Agreed Orders tend to have the most potential for indicating possible abuse."
"This is because most Agreed Orders are entered into upon a settlement agreement in which the arresting authority receives some or all of the forfeited property as a condition subsequent to some sort of an agreement made between the arresting party and the defendant," Baker continued. "As the arresting party often seizes a large amount of property or cash and many of these Agreed Orders stipulate that some of most of the said property or cash will be returned while some will be forfeited, a reasonable person might assume that the arresting party is using its authority to gain assets from an arrest by settling with the defendant."
Put more simply, a reasonable person might assume he or she is being extorted.
According to court records, a Mississippi man named Robert Evans agreed to plead guilty in 2015 to a reduced charge of misdemeanor drug possession. In return, the state seized his truck and $170 in cash.
In total, the Mississippi Bureau of Narcotics, working with local police departments, seized nearly $4 million in cash in 2015. Out of 154 seizures in 2015, the average cash value amounted to $66,733, and the median was $12,914. They seized cash amounts as low as $75 and as a high as $460,000. They seized trucks, cars, ATVs, riding lawnmowers, utility trailers, and 18-wheelers; an arsenal of assorted handguns, shotguns, and rifles; cell phones, cameras, laptops, tablets, turntables, and flatscreen TVs; boat motors, weed eaters, and power drills; and one comic book collection.

"Stay Alert" for This Venomous Species

"Stay Alert" for This Venomous Species
The fact that we cohabitate with snakes pretty much everywhere in the U.S. means that there’s never really a time when they shouldn’t be on your radar—even in the winter. After all, being aware of their behavior and habits can make it easier to avoid accidentally disturbing them on your property and out in the wild. And even though the weather is cooling down, some might be surprised to know that it’s still a special time of the season for one venomous species of snake that authorities warn the public should “stay alert” of for safety’s sake. Read on to see which type of reptile might be more visible right now.

Warmer weather usually comes along with spending more time outdoors, whether it’s hiking or spending more time in the garden. Depending on weather patterns and where you live, the high season for snake bites typically begins in April and stretches through October, according to the U.S. Department of Agriculture’s (USDA) Forest Service. According to experts, this has much to do with reptiles’ biology.
“Snakes are cold-blooded, meaning that they rely on external sources, such as the sun, for a large chunk of their warmth and energy,” Stewart Flynn of Bug-N-A-Rug Exterminators previously told Best Life.
But even as the weather cools off come fall, other biological factors can still make snakes more visible—especially in warmer climates. In some areas, certain types of venomous snakes are giving birth to live young that will seek hiding places in yards and wooded areas. However, one particular venomous snake species is especially active for a different reason right now.
Shutterstock
On Nov. 5, police in DeSoto County, Florida, were called to a condominium complex in Lake Suzy after receiving a report from a resident of a large snake “curled up” near a sidewalk, the Miami Herald reports. Officers arrived to find an eastern diamondback rattlesnake measuring about five feet long resting near the residences.
Fortunately, authorities arrived with the proper equipment and training necessary to wrangle the venomous reptile. They were able to safely “capture, remove, and safely relocate” the snake to a wooded area nearby, according to a Facebook post from the DeSoto County Sheriff’s Office.
But the officers also warned local residents to stay on the lookout for species this time of year. “Peak mating season for the eastern diamondback rattlesnake occurs in late summer and fall. So always stay alert for wildlife no matter where you are,” the agency warned.

While there are plenty of different types of venomous reptiles in the U.S., the eastern diamondback rattlesnake stands out for a few reasons. “It’s the most dangerous snake in the United States,” Jimmy Stiles, a herpetologist and PhD candidate at Auburn University in Alabama, told AL.com. “So it’s definitely one that people should be familiar with.”
The animals grow three to six feet on average—but up to eight feet in some cases—and have an average weight of 10 pounds, making them “North America’s longest and heaviest venomous snake,” according to the Smithsonian’s National Zoo & Conservation Biology Institute. They’re also native to the southeastern U.S., across all of Florida up to the North Carolina coast and over through southern Mississippi and eastern Louisiana.
And besides their telltale defensive rattle, it can be easy to pick the species out of a lineup due to other characteristics. “They are best identified by their diamonds, which are dark diamonds on the top of their back, bordered by bright yellow,” Stiles told AL.com. “Diamondbacks also have dark rings towards the back of their tail.”ae0fcc31ae342fd3a1346ebb1f342fcb

Even though it’s best to stay alert during their mating season, there are a few ways you can decrease your chances of crossing paths with eastern diamondback rattlesnakes. Of course, staying aware of your surroundings and listening for the snake’s defensive buzzing rattle gives you an advantage that humans don’t have with any other species. The reptiles are also most commonly found in areas like overgrown fields or abandoned farms near pine forests, so you should exercise caution if working in unkempt areas, according to the National Zoo.
And given the rattlesnake’s preferences, there are also some ways you can make your own property less inviting to them.
“A yard that is unattractive to snakes—especially the venomous ones—has the following characteristics: the grass is kept mowed; plants chosen for landscaping are ‘spindly’ rather than bushy so that they cast little shade and you can easily see the base of the bush; firewood is stored on a table or other platform elevated a few feet above the ground, with no debris piles; and snakes cannot crawl underneath the buildings because they are flush with the ground or because access under porches or into crawl spaces is blocked off,” Emily Taylor, PhD, a professor of biological science at California Polytechnic State University, San Luis Obispo and owner of Central Coast Snake Services, wrote in a Medium post.
