#Can A Landlord Evict You Without Going To Court?

Note
Skeleton is handled an immediate eviction notice by some lawyer. His landlord didn't know he was a monster and decided he wouldn't rent the house to a monster anymore. Skeleton has to leave without anything.
Undertale Sans - Sans keeps calm and tries to argue that it's illegal to evict someone for this reason and that he refuses to leave. He doesn't care if the guy tries something against him in court, he would more than be glad to explain to a judge their racist landlord wants to throw him out for no reason. Until then, he's not moving. Sans closes the door and then calls Toriel to get advice on this. He was not stressed enough, urgh.
Undertale Papyrus - That's ridiculous! He had been nothing but an excellent tenant so far, why is that even a problem he's a monster? Papyrus still obeys because they're representatives of the law, but he's going to argue until the very last second. Once they're gone, he sighs and calls Undyne to explain the situation. He's not worried as he knows she can have him home for a little while, and after that, he can still go to his brother's place where he has a room, but he's salty. That's completely unfair and he's going to file a report to the police station with Undyne's help. He knows he will probably never see his stuff again as the landlord would have probably throw everything out by the time he goes to court, but he's going to have reparation.
Underswap Sans - He smirked, then closed the door in the guy's face. Yeah, sure, whatever you say bro. Blue is not leaving the house. He doesn't care about whatever shit excuse his landlord found to evict him, that's bullshit. What are you going to do anyway? Call the police to take him out? Well he has news for you. Blue knows the law, he knows his rights and all of this is bullshit. Good luck trying to drag him in court with the only argument that he's a monster.
Underswap Papyrus - Honey is panicking and tries to explain he doesn't have a place to go and that they can't do this, but they completely ignore him. Added to that, his phone stayed inside and he can't go in anymore. He's having a complete panic attack on the sidewalk, desperately hugging his three service dogs to calm down but he can't calm down. He aimlessly wander in the city for a solid two hours before knocking at Asgore's door. He tries to explain the situation but quickly has a mental breakdown and bursts into tears, completely lost and confused about what to do now. Asgore calls Blue, and his brother takes things in hand. Like hell, he's going to let his baby brother sleep in the streets. He's getting his house back.
Underfell Sans - Yeah, sure, whatever you say. He closes the door at that guy's face and calls his brother. If you want to play the fierce little lawyer, wait for the moment you'll have to face a real one lmao. Edge confirms him all of this is illegal and that he's going to take things in hands. Red wouldn't like to be the lawyer behind his door. That's going to hurt.
Underfell Papyrus - Edge is very amused as the guy keeps talking, while also looking at him with wide terrified eyes lmao. Edge is a very famous lawyer and no one wants to confront him in court. What are you even trying to achieve? You already know his answer so why are you still talking? Edge explodes his landlord a few months later in court and makes him pay for his "traumatism" even though this whole story was a joke for him.
Horrortale Sans & Papyrus - Willow is angry and keeps trying to convince the lawyer that they can't leave, as his brother and him are disabled and have nowhere to go anyway. And what about all the animals on the farm? He's not just going to give up on them actually! As he talks, he's holding back a very pissed-off Oak who is furiously growling at the lawyer and trying to attack, which starts to scare the guy a little by now. Eventually, he gives up and leaves, but promises that it's not over. Willow and Oak are extremely nervous about this, and even though Toriel and Grillby assure them it's illegal and that even if that happened, they could still come to them, they can't get rid of the idea that humans don't like monsters and that their landlord might actually win just because of this.
Swapfell Sans - Oh, sorry, are you talking to him? Because that's not happening, duh. That's his house, he's paying for it and he even plans to buy it. You think he's scared of some little man that think is more powerful than him? What a joke. You want the house? Come and fight him, and maybe he'll accept to give it back. But beat him first lmao. Good luck with that.
Swapfell Papyrus - Uh oh. Looks like trouble. Rus takes a deep breath, loads his best French accent and "Tata, ta tarte tatin tenta Tonton ; Tonton tâta ta tarte tatin, Tata." The lawyer is extremely confused but just assumes he doesn't speak the language and leaves him alone. Thanks, Duolingo.
Fellswap Gold Sans - You want him to what? Lol. He asks the man to wait a second and sends a text. Two minutes later, he gets a second. Here. The landlord is dead, how did that happen? But eh, no landlord, no problem right? Bye now!
Fellswap Gold Papyrus - Well, Coffee doesn't open the door to strangers so that lawyer is going to wait a very long time in front of the door and give up. What are you even going to do lol? You know who is his brother? Well, I hope for you that you never find out because that's not going to be pretty.

For people that missed it (@giraffeseatingcake), because it's on my mind again, the Tina Dollyhair thing to the best of my ability to remember which we all know is not great and of course I didn't keep links to everything. I could probably find them again but you know, I don't want to. Google it yourself.
I don't know why I started looking into it again. Maybe someone mentioned Tina's supposed death somewhere, or maybe someone mentioned Ida taking over and it got me curious. I don't remember.
Anyway, we never found a public death notice or obit for Tina and that makes sense since obits aren't posted unless a family member pays for one to be printed. I didn't know that before.
What I did find was mention of Heidi with a different last name. IIRC it was through public records, I started noticing clusters of names that were showing up together often across different public record aggregation websites. Tina Amuntula/Kristina Amuntulla/Kristina Miller, Heidi Amuntulla/Heidi with a different name, and Steve Amuntula/Amuntullah who also has a different first name but I've forgotten it. He goes by Steve publicly in the US.
There was also some sort of hint that Heidi was in television or the movies in some capacity which made me wonder if there was an IMDB profile for her. There was! Then I looked her up on wiki and found that Heidi OTHERNAME was also named Heidi Amuntullah.
Also checking the ownership history of DollyHair showed that Steve's other name was registered as owner for some time.
Going around and around in circles with public residential and business records put the whole family together.
That was the first time I'd had anything even close to proof that Tina's Sister Heidi actually existed.
How this led to finding out that Tina apparently really did die is that searching about Heidi and Steve Amuntullah brought up a series of documents about a court case brought against the two of them by Melanie Chan.
I did keep a link to one of the documents but not everything else tying this document to Tina Dollyhair because of course.
Anyway, it's here:
In that document it says:
The FAC alleges that Plaintiff’s landlord, Kristina Miller, passed away in August 2020. (FAC ;41.) Defendants being decedent landlord’s father and sister are inferred to be heirs or successors-in-interest to decedent landlord.
Melanie Chan was suing the Amuntullas for wrongful eviction after Tina died, saying they didn't give her enough warning to be able to find another place to live before changing the locks on her. Heidi and Steve took ownership of Tina's house and wanted to sell it. It's recorded either in this document or some of the others that Tina was letting Melanie live in her upstairs for rent without any sort of official lease.
That's basically it.
Tina really died in 2020 (not any of those other times she said she died before), Heidi does exist and both Heidi (Tina's sister) and Steve (their father) took ownership of Tina's house, kicked out her unofficial renter, got sued for it, won the lawsuit, and sold the property.
As for Ida claiming to not know the family or not knowing any of the drama behind the DollyHair shop, she's mentioned in that document, too.
Plaintiff’s reliance upon the allegations regarding “Ida,” an employee of Heidi, is uncertain to allege a trespass in that it is only alleged that Ida entered the “house” and not specifically her “upstairs guest apartment.”
It could be a different Ida.
She could have somehow not known, I guess. It's possible she worked for Heidi without knowing anything about Tina or DollyHair and Heidi was like "Hey, you want this business because I don't...."
So, it's possible.
Either way, I do hope DollyHair as a company can build a new, better reputation with good customer service and not shorting people on their hair orders, now. They do have some hair colors that aren't available elsewhere and DollyHair has the widest selection of fibers as far as I know.

Getting Evicted PLEASE HELP
Tumblr media Tumblr media
So I have been fighting an eviction. Did an appeal and still lost. I'm being thrown out because my mom's widows benefits were taken away with zero notice all because they had the wrong address on file even though we had updated it with them several times. Luckily we managed to get mom's benefits back but the damage was done. The landlords didn't want to work out on an agreement and I had to bide time so we wouldn't be thrown out.
Luckily I found a house to move to and I have paid first month's rent and deposit as well as gotten the utilities turned on but I need help with the move. My mom and I are both disabled and I need enough to rent a uhaul and to pay for someone to help us move things. I am at the point where I have next to nothing to get by in the future. Any money I had saved is now gone because my landlord wanted to take me straight to court.
I don't have family or friends down here nice enough to help me without any monetary incentives which is why I'm asking you guys for help. I didn't think I was gonna have to do this but I have no choice. I really thought things had gotten better with me close to finishing my degree. Any money saved up would go to the uhaul van I need to rent, paying someone to drive me back and forth and for any pet supplies I may need to help make the trip easier for my kitties. I'm setting the goal for $400. I'll be fine with any donation or any amount I can get. Please boost and lots of love. Thanks

Tw SH, Substance abuse, relapse, homelessness
So I got evicted because my landlord wanted to raise the rent, and instead of being upfront about it, they found out we were planning on moving and made the excuse that our apartment smelled like marijuanna. It was five days until christmas when i got the notice. I don't have the money for court fees and definately don't have the time or energy for court so I can't even fight it. On new years I'll officially be homeless. Ableit it won't be permanent we have plans to get a new place, which is definately not an improvement from our already small falling apart place but I'm still greatful for that. But I'll be separated from my partner. Like my platonic life partner. Like I love them so much I cook for them daily and they drive me around because I cant drive and i can't imagine living my life without them type partner. They are my bestfriend. And I can't bear to know they're gonna be suffering mentally crashing at their parents house and I wont be able to do anything about it because I haven't been able to work for nearly a year now. I'm also having to get rid of a lot of things that are very dear to me, which has been especially hard growing up with scarcity trauma and ending up with hoarding tendencies. I won't have my own space for a month. I grew up sharing a room, and even once I got my own as a teen I never had any privacy and wasn't really allowed to take up space and so sleeping in a one bedroom home with 2 other people and two cats is going to be a lot to me . I'm going to try to see it as just a very long vacation crashing on a friends couch but truth is its really going to drive me crazy. I ended up drinking an entire bottle of wine to myself and BY MYSELF and that's where the real issue comes in. I am totally fine usually to drink wine in moderation as a self care or social thing, as long as I limit myself to one glass. But when I use it as a coping mechanism for stress, and then also do it by myself with no one around to judge me or to keep me in check or to drink up the rest of the bottle before I can, that's when I know I've fucked up. I also dissociated really bad when told the news to the point where I stared at the same spot on the floor for an hour, scratching at my fingers which are now blistered from it, and when my roomate left for work I began immediately uncontrollablely hyperventilating and crying. I feel so hopeless. But not even in a unreasonable and depressed way. In a genuinely ... things are awful way. I've tried to be positive and hopeful for so long. But I mean... if you lost all your dreams, most of your mobility, your independence, your money, and your house you'd be upset about it too. If you weren't I think there'd be something else wrong. Anyway. I know not many people care but this is my safe space where I document my brain. I used to journal but my mother stole my journal as a kid ahahah so now I can only use tumblr bc i know she isn't tech savvy enough to see it or even find me here because nobody has for 5 years. Anyway if you did read this and need company in misery feel free to message me.

Goals for 2023
I had a lot planned for 2022, but the year of madness made it virtually impossible to reach all those goals. The IRS requiring I pay back the "no strings attached" stimulus check because I'm a "non-contributing" citizen, aka Disabled, was just the beginning. Then the eviction without cause, seeking out a new rental and finding none, searching for a house to buy within our limited budget (yay for first time home buyer programs), arranging the move, the person handling the paper failing which then resulted in delaying the move and losing all our cold and frozen groceries, the former landlord trying to pull illegal nonsense with keeping our deposit (threatening small claims court changed their mind), Husband starting a new job, contracting covid and spending weeks recovering, Husband's grandmother passing away, euthanizing Jasper due to cancer, long term effects of covid (severe inflammation in my ears) and being treated for it, and now we're at the end of the year. All this delayed or prevented me from being able to start and finish projects in time for the holidays.
But we did have good things happen. We're now homeowners, Husband requested he be moved to a different location and position, which has been granted, successfully acquiring commissions, sell what I've made, recover from covid, purchase a new cutting table, sewing chair, and sewing desk, finished quilt tops, starting and finishing little things like ornaments and coasters, and soon we shall see about replacing our garage door with a wall in order to turn the space into a library and D&D game room.
I'll keep my goals for 2023 very simple and far more achievable. The long term effects of covid have left me with my eustachian tubes (tubes in your ears) inflamed. This resulted in partial deafness for a few days, with zero equilibrium, pressure in my head that had me feeling like it was going to pop off as though it were a cork on a bottle of shaken bubbly wine, and in pain. I'm on powerful medications right now, and the side effects are enough that I'm not comfortable standing for long periods of time and my hands are unsteady. This will pass in a couple weeks, and my ears have improved quite a bit. It likely won't be until the middle of January before I really get back to work in my sewing room.
Now let's focus on the sewing and art goals I have for 2023, shall we?
Make at least three lap size quilt tops, measuring no less than 50x50 inches. All the quilt patterns and fabric I have pulled meet the criteria, and these are fairly simple patterns. It'll make for quick work once I get to it. These quilt tops will be listed on the commission page later, providing a clear image of what the finished quilt will look like. More on that later.
Make a bookshelf wall quilt for the bedroom. A bookshelf quilt is simply a quilt that looks like a bookshelf. I high recommend using a search engine and checking out what you find. They're often made using foundation paper piecing. Most of the blocks I'll be using are free, but I there are several I plan on purchasing. This will hang on the wall at the head of the bed, made using patterns that reflect the interests and hobbies my husband and I have. It won't be a show piece, but something to make the bedroom have less of an echo and have a much more homey effect.
Open commission in April 2023. The commissions will have finished quilt tops as mentioned above. Several clients informed me this gave them more confidence about results. People unfamiliar with quilting may find it difficult to "see" the quilt in their mind. Having the information there on the screen makes it easier to decide on commissioning me. They can then choose which quilt I work on. This gives me more focus, and I also don't end up with several finished quilts taking up limited space while they wait for a buyer.
Make at least one queen size quilt for home. I want to make a warm weather quilt, something light and breathable, and very colorful. I have two queen size quilts from my mom, but they're earth tones, nothing vibrant. I do have one finished quilt top that qualifies, and that one I intend to have machine quilted by a local quilter. The fabric and pattern were a gift from my mom, which I love, but I want to make something a little more personal and handquilt it.
Make a sampler quilt. This will also fit in with a couple of the other goals. What's a sampler quilt? It's a quilt make using many different blocks that don't repeat. You get to sample different blocks and designs this way. I have fabric set aside for a sampler quilt, and have found a pattern I like. I might keep it, seeing as it's queen size, though it will likely be placed on my commission page.
Create at least three tree wallhangings that will be placed in my shop. I had hoped to make these this year, but things didn't quite work out that way. I intend to start these early, and make them using scraps. They're small enough that I can machine quilt them comfortably.
Make more pins and magnets. These are tiny things, about 1.5x1.5 inches. Easy and quick to make, but I haven't had the energy or focus to make them this year. I hope to make at least 10 batches of four, and spread the work throughout the year.
Close commissions in August 2023. Depending on what sort of commissions I have, it may be earlier. This will provide me with time to make more holiday quilts. I know August may sound early, but keep in mind my work takes weeks and even months to finish. A December quilt is best started in September in order to have it finished by November.
Reach my Ko-Fi goals. I intend to purchase a filing cabinet, a printer that uses toner, vertical storage for my sewing room (hanging baskets, tack board, shelves), and fabric (I'm out of yellow, low on orange, very low on prints in black, white, grey, and black & white combinations). Commissions and successfully selling what I have in my shop, plus donations, will cover these quite nicely.
Learn how to make my own pants and shorts. I'm barely 5'2" or 1.57 meters tall, aka very short, and pear shaped. Women's clothes for short people tend to assume we're also very thin. Finding clothes that fit and match my style and preferences is virtually impossible. If I want something I like, I'll have to make it myself. When I was a teenager, my favorite shorts were a pair my mom made for me using Hawaiian prints. I wore them to the point of threadbare, and have missed having such wild shorts. Plus, they went to my knees, and most of women's shorts are too short and tight for me to be comfortable. Making my own pants will also be great because I prefer mine very baggy, wide leg and not boot cut/bell bottom. Finding those has, in fact, been impossible. Once I learn how to make my own, I will be a very happy lady.
These are all achievable, especially with the help of clients, supporters, and members. Member will, of course, have the option of commissioning me earlier. Commissions will be open for them starting probably in mid-March, giving them first dibs. If you want to have this early advantage, sign up to be a member here. It works like a friendly version of Patreon. I currently have just three members, resulting in $29/month in support. Members also receive and automatic 15% discount in my shop and on commissions, as well as a few other goodies you can read there.
Thank you for taking the time to read this. As a show of gratitude, use 2023GOAL for a 20% discount in my shop. It expires January 2nd, so use it soon.
I hope 2023 treats us well, with a dull and uneventful year, a time of calm and recovery from the madness we have enduring since 2020. Remember to take care of yourself, especially in regards to wearing a mask so as not to get sick or make others sick. Wash your hands, treat yourself and those around you with kindness, and find things to look forward to. Give yourself an achievable goal, make them easy, and reward yourself when you have reached them. Don't be shy or ashamed of asking for help; we are mortal and no one can truly survive entirely on their own. Find something to look forward to, be it a new game that's coming out, finishing a book you've been reading, whatever simple thing that will provide you with gratitude and happiness. May 2023 be a happy new year.

CHAPTER 16
landlord goes in and turns it off to try to make the tenant move instead of going through the legal eviction process. Before those two, in all the thirteen years I've been on the bench, I'd never had even one.
And IPs in small counties are sometimes, at least initially, left to their own devices to work through problems and issues for which there are adequate tools, mechanisms, and protocols already in place in large counties. Judge Russell Johnson in rural Coke County had to face hours and hours of run-around and buck-passing with regional and state of. ficials when, early in the pandemic, a suspected virus-related death left him holding the bag when it came to responsibility for testing and sending the body along for autopsy.
Geographically myopic big city IPs can be appalled by the kind of informal judging that goes on in tumbleweed Texas. Likewise, small town IPs don't see assembly-line justice as anything they'd care to sign up for.
Yet the simple fact is this: a small-county JP, like retired judge Sarah Miller (Erath County), might have slapped a $200 fine on her neighbor for burning his trash during a county burn-ban, because she just happens to know all her neighbors, and recusing yourself from all the cases in which you know folks just isn't an option. But by the same token, Judge O'Brien in Dallas County can't help it that she has to employ a rigorously systematic approach to getting through all the time-sensitive evictions filed in her court. It's just a fact that there are going to be a lot of forcible entry and detainer (eviction) suits filed in that precinct. O'Brien told me that on her very first day in office she had to hear over eighty.
The disparity between the two courts is reflected in the complex challenges that an advocacy group like the JPCA faces. Former Williamson County JP Patricia Ott spent a lot of time looking out for her judicial sisters and brothers before the Texas state legislature in her day; she points out how important it is to educate those who write the laws about the many different kinds of justice courts there are. "Every law doesn't work for every court," she says, "and, in fact, many of them can make things much more difficult for certain JPs." When it comes to educating the judges themselves, Ott says that one-size-fits-all classes don't make any sense. Continuing education for JPs should take into consideration the size of the county, and it should be noted that rural counties (es-pecially in suburban areas) can become mid-sized counties; and that mid-sized counties like her own can become large counties. Round Rock
In the Opinion of the Court

had 26,000 people when Ott took office. Its current estimated population ls over 130,000. (incidentally, Judge Out hasn't just been an adacate for Ps. She's worked hard at improving training for clerks, and eate authored a clerk manual focused on justice court process.
Beth Smith has watched her precinct in Hays County go from around four or five thousand people when she came into office in 199 to between 50,000 and 5,000 today. Her caseload has grown with her population.
Our county is really growing. It used to be nothing but cedar posts and moonshine liquor around here.
-Hon. Ronnie Webb, Somervell County
Would It Be Better for JPs in Texas to Run as Non-Partisan Candidates?
Another point of disagreement that crops up between judges is whether justices of the peace should run without any mention of political party affiliation. Such a move would, no doubt, incite blowback in a state in which political parties wield significant power and influence, especially at the state level. Yet down at the county level, except in the area of campaign assistance and certain perceptual benefits that redound from being a member of a particular party in a particular county, perhaps party identity has been oversold, and losing partisan labels might be a blessing. With the demise of the Yellow Dog Democrat and the
"rouging" of rural Texas, and the expansion of urban and suburban Democratic strongholds, JPs throughout the state are scrambling to brand themselves in the way that best serves their efforts to stay in office.
Emblematic of this period of seismic political party realignment among Texas JPs is the fact that no fewer than nine elected county office holders in Lamar County decided to all hold hands in January 2011 and take the Republican plunge together. This group migration from blue to red included four of the county's six JPs.!
Judge Crow sides with those who'd like to see party affiliation for IPs go away.
I would love to see a movement for judges not to have to run along party lines, because I don't think it matters. What matters are your qual-

What International Students Should Know About UK Rental Laws
Tumblr media
International students are often likely to find the first difficulty in relocating to the UK: finding housing. The UK rental market has a tremendous variety, but the best way to get to know the rental sector is to comprehend its regulations. These laws have been enacted to guarantee tenants' safety and give them the right to reside in a fair and secure environment. This is why students who come to the UK for the first time must know them.
This is a full guide to all the crucial aspects of UK rental laws that international students must know. It also provides some tips to make the process more convenient.
1. Tenancy Agreements: Your Legal Safety Net
The tenancy agreement is a legally binding document you and your landlord signed. Typically, student housing is under an Assured Shorthold Tenancy (AST), which provides all the rights to the tenant.
Key Details to Check:
Rent amount and payment schedule. The length of the tenancy.Deposit amount and terms. Additional fees for utilities or late payments.
Rent amount and payment schedule.
Length of the tenancy.
Deposit amount and terms.
Any additional fees, such as for utilities or late payments.
The first and foremost step is to read all the contract clauses thoroughly and then you should line it up in your mind if it all makes sense to you. If there is anything that is not definitive to you, get guidance to confirm that you're confident about your duties and licenses.
2. Deposit Protection Schemes
In the UK, your landlord is by law obliged to put your deposit in a government-endorsed Deposit Protection Scheme. Thus, it is guaranteed that the money you've deposited will be safely returned when your lease expires, in case you do not leave any damage or fail to pay rent.
Types of Schemes:
Direct payments into this government-run scheme (Deposit Protection Scheme, DPS)
Tenancy Deposit Scheme (TDS)
Deposit Protection Service (DPS)
My Deposits
Tenancy Deposit Scheme (TDS)
You should be sent a certificate or confirmation of deposit within 30 days of the deposit from the landlord. You can get a court order to punish the landlord who does not do so.
3. Right to Rent Checks
Residing in the UK illegally is a punishable offense. Perhaps landlords can use the best available record to prove that the person is residing legally in the UK, but, if they neglect this measure, they could be found guilty of a serious crime. As a foreign student, you are going to have to hand in the following papers:
A valid passport.
Your student visa or BRP (Biometric Residence Permit).
Proof of university enrollment is required.
These checks are done before signing the contract and ensure that landlords do not rent to people who do not have their legal papers in order.
4. Landlord Responsibilities
Landlords have several legal obligations to ensure your safety and comfort during your tenancy. You can be sure of:
To fix structural defects, leaks, or broken appliances in the property.
Safety certificates must be provided: gas safety certification, including electrical safety laser tests and a valid energy efficiency rating (EPC) among others.
Smoke and Carbon Monoxide alarms that work properly: There should be at least one smoke alarm on each of the property's floors.
However, if your landlord does not fulfill these obligations, you have the opportunity to give this landlord a bad report at all the local council or housing authorities.
5. Your Rights as a Tenant
As a student tenant, you have the specific rights that shield you from being mistreated:
Peaceful enjoyment: Your landlord must provide you with at least 24 hours' notice if they are to enter the property.
Protection from eviction: Landlords must follow the proper procedures if they want to evict tenants. Any attempt to unlawfully evict you by a landlord without giving you a notice is illegal.
Requesting repairs: You have the right to ask for the necessary repairs and to have them attended to promptly.
6. Rental Scams: Stay Alert
International students can be the most likely to be the target of rental scams. Stay on alert when dealing with strangers or suspicious listings. Her common warnings are as follows:
Requests for large amounts of money as a deposit without being able to see the apartment.
The landlord does not want to sign a tenancy agreement.
Listings with deals that confer unreasonable benefits.
Ensuring the property is valid remains at all times, and whenever possible, use specialist platforms or agencies in student housing that have good reputations.
7. Council Tax and Utilities
In most cases, students are exempt from paying council tax, but you may have to supply evidence of your student status to your local council. However, you will probably want to plan your budget for utilities like electricity, water, and internet if they are not part of the rent.
8. How to Handle Disputes
If problems are likely to come up between you and the landlord then try to deal with your differences in a friendly way. In case this solution doesn't work, you can still take the case to:
Local council housing departments.
Citizen's Advice Bureau.
The Housing Ombudsman.
Document all the communications and records of the payments and agreements you have, and keep them as proof.
9. Choosing the Right Accommodation
It is critical to know UK rental laws; however, the right choice of accommodation is also of the same importance. Prefer student-centered residences, such as purpose-built student accommodations; which are exclusively designed to cater to students' studies.
Utilities, security, and social spaces are the most commonly used rental factors, eliminating most of the common problems. Also, these accommodations are even more preferable, as they are specially geared for international students; consequently, there is a safer and more comfortable experience for them.
Final Thoughts
It might seem a little worse than hellhole to be a foreign student who is relying on UK landlords. Nonetheless, thorough mastery of one's basic rights and responsibilities is the key to moving on to a successful and comfortable life in the UK. Along the way, you would know a landlord can be sued for not protecting a deposit and also failing to meet the agreements stated in the tenancy agreement.
Meanwhile, in Student Tenant, we only use the verified accommodations that are safe, which were thoroughly checked during the student exchange with the UK. In detail format, our team understands every student's expectations and they give guidance from beginning to end, e.g. finding the proper place to stay and getting settled in with comfort. Come to us so that we can help you transition to your study in the UK smoothly and cheerfully!
While gaining knowledge of the service and selecting the trusted accommodations, your UK dream could be as pleasant as you've been imagining. Have a safe trip and a continuous happy study!

To elaborate: if you are a renter in the US (the system I'm most familiar with), you typically are forced to sign (or agree to orally) a contract with your landlord that can range from a month to several years. Most are about 6 months to a year. The contract agrees that you will pay x amount of money in rent and often penalizes you by having to pay all of the remainder of the contract's rent if you have to leave for whatever reason, say because you can no longer afford it because your family breadwinner died violently in an Amazon warehouse accident.
Now there are supposed to be protections. For starters, the landlord can't kick you, your kids, your pets and your posessions out and change the locks whenever he feels like. Legally speaking. You are also supposed to get paid by the government, your job, maybe life insurance.
Except none of those places want to pay and the process never takes less than 2 weeks. Most take months. IF the website is working, or they get your mail (10+ days from now), or the phone lines don't have wait times so long they just hang up on you. In the mean time, you and your kids and pets are hungry. You can maybe go to a food bank, but if you dont have a car youre walking or taking the bus.
And then there's the lease. There is no provision for if you suddenly lose your job or your spouse. Breaking the lease is often more expensive than staying on it, because of all the associated fees and upfront costs with moving and because you might be on the hook for the remainder of the leases rent.
If the landlord illegally evicts you, this is obviously, well, illegal. But it's very hard to take someone to court when you have just been made homeless, isn't it? Try filing anything if all of your vital documents are in a dumpster somewhere and you're living out of your car or a shelter or your sister's basement. Odds are you might not even win if you did. And then that whole process would be on your record, and good luck getting a new rental then.
But if the landlord decides to take you to court for not paying rent a month ago or 2 weeks ago or a week ago or even 2 days ago (yes in many places that's legal), you will have a court date scheduled for you. It might be when you have a family emergency, or an appointment, or maybe during your jobs hours, or when you have to pick Timmy up from school. Doesn't matter. It can be scheduled as little as 5 days after you hear about it, and 2-3 of those days can be a weekend.
You won't get legal representation. The judge will not have gone to law school, they will have taken (hopefully) a 6 week course in relevant law and handle several hundred cases a day. They will likely know the landlord and may even be very chummy with them. Judgments in the landlords favor are common, even if you show up. If you don't, default judgments are nearly 100% in the landlords favor.
There is an appeal process, but it takes months, and during that time you have to keep paying rent (it's a slightly more complex process but the bottom line is you have to pay the equivalent of rent). If your problem is you can't pay rent, that's obviously an issue. You can apply to certain programs, but that's another multi hour over the course of several weeks process. If you don't appeal, you get maybe 10-30 days to pack up and get out.
I think it's no wonder most people don't show up to court and instead spend that time packing so they have a shot at bringing their valuables intact to a new place or storing them, and then getting the fuck out without complaint. Especially since if they do that, the landlord might pay them to leave, or wave the rent they're still on the hook for.
And that's how, despite the fact that it's not even remotely supposed to work that way, many people in the USA are already living this theoretical nightmare.

How Can Property Lawyers Assist with Rental Property Issues
Renting a property can feel like walking a tightrope. There's a lot to balance between lease agreements, maintenance disputes, and tenant rights. And when things go awry, it’s easy to feel overwhelmed. That’s where property lawyers in Melbourne come into the picture. These legal professionals are the safety net landlords and tenants need when rental property issues tip the scales. Let’s explore how they can help you navigate the complexities of rental properties confidently and efficiently.
Understanding the Role of Property Lawyers
Property lawyers are specialised legal experts who focus on all things real estate. From drafting contracts to resolving disputes, they’re the go-to professionals for landlords and tenants. In a bustling city like Melbourne, where the rental market is as dynamic as it gets, having a property lawyer by your side can make all the difference.
Renting a property isn’t always smooth sailing. Legal issues can sometimes arise when you’re a landlord dealing with a difficult tenant or a tenant facing unfair treatment. Here’s why contacting property lawyers in Melbourne could be the best move you can make.
How Property Lawyers Can Help
1. Drafting and Reviewing Lease Agreements
The lease agreement is one of the most critical aspects of any rental property. This document outlines the tenancy terms, from rent amounts to property maintenance responsibilities. A poorly drafted lease can lead to misunderstandings and disputes. Property lawyers in Melbourne can assist in drafting clear, legally sound lease agreements that protect your interests. They’ll ensure every clause is fair, understandable, and in line with current laws.
Tumblr media
If you’re a tenant, a property lawyer can review the lease before you sign it, ensuring no hidden clauses or unfair terms could cause issues down the road. This proactive step can save both parties from future headaches.
2. Handling Disputes and Mediation
Disputes between landlords and tenants are more common than you might think. These issues can quickly escalate from rent arrears to disagreements over property repairs. Property lawyers in Melbourne are skilled in dispute resolution and mediation, offering a way to settle conflicts without going to court. They act as intermediaries, helping both parties reach a fair and amicable solution.
If the situation does require legal action, property lawyers can represent you in court, providing the expertise needed to present a strong case. Whether you’re pursuing compensation or defending your rights, their knowledge of property law is invaluable.
3. Navigating Evictions
Evicting a tenant is never easy, but sometimes it’s necessary. However, eviction must be handled legally and carefully to avoid complications. This includes serving the correct notices, following proper procedures, and representing landlords in court if needed.
For tenants, a property lawyer in Melbourne can help if you believe you’re being unfairly evicted. They’ll review your case and advise on the best action to protect your rights.
4. Advising on Property Maintenance and Repairs
Maintenance and repairs are among the most contentious issues in rental properties. Landlords are responsible for keeping the property in good condition, but disputes often arise over what constitutes necessary repairs. Property lawyers can clarify these responsibilities, helping landlords understand their obligations and advising tenants to enforce their rights to a well-maintained living space.
Conclusion
Navigating the rental property landscape can be tricky, but you don’t have to do it alone. Whether you’re a landlord looking to protect your investment or a tenant defending your rights, property lawyers in Melbourne are there to help. From drafting lease agreements to handling disputes and evictions, their expertise can turn a potentially stressful situation into a manageable one.
So, don’t wait for the problem to escalate if you're facing rental property issues. Reach out to property lawyers in Melbourne and let them provide the legal support you need to resolve the issue effectively and efficiently.

How to Handle Tenant Disputes After Serving an Eviction Notice
Serving an eviction notice is often a challenging step for any landlord, but handling tenant disputes that arise afterward can be even more stressful. In Las Vegas, the eviction process is governed by specific legal requirements, and managing tenant disagreements effectively is crucial to avoid delays and additional complications. Here are some steps you can take to resolve tenant disputes after serving an eviction notice service.
Tumblr media
1. Review the Eviction Notice
Before addressing any disputes, ensure that your eviction notice is clear, accurate, and in full compliance with Las Vegas laws. A tenant might contest an eviction based on errors in the notice itself, such as incorrect dates or improper grounds for eviction.
2. Maintain Open Communication
It's essential to keep the lines of communication open. Sometimes, disputes arise from misunderstandings. Try to have a calm and clear discussion with the tenant. Offer to meet in person or via a call to clarify any issues related to the eviction.
3. Document Everything
Record every interaction you have with the tenant regarding the eviction. Save emails, texts, or letters and take notes of any conversations. Having a detailed record can help protect you legally if the dispute escalates.
4. Offer Possible Solutions
In some cases, disputes can be resolved without going to court. Consider discussing alternative solutions such as payment plans, lease extensions, or even mediation to find common ground with your tenant.
5. Stay Calm and Professional
It’s crucial to remain calm and professional, no matter how heated the dispute may get. Reacting emotionally can worsen the situation and may lead to additional problems, such as retaliatory actions from the tenant.
6. Seek Legal Advice
If the tenant is unwilling to cooperate or disputes the eviction in court, it’s best to seek legal advice. A lawyer specializing in landlord-tenant law can help ensure that you're following the proper legal process and help you handle the dispute in a timely manner.
Handling tenant disputes during an eviction can be stressful and time-consuming, but working with a reliable eviction notice service can make the process much smoother. If you're in Las Vegas and need assistance, Reno Carson Messenger is here to help. They specialize in delivering eviction notices efficiently and in compliance with local regulations. Personal Post
Buckets of stress on chronic stress. Please be patient with me wherever however you know me for the forseeable future. A few longer reasons under the read more.
TLDR: I've been in housing instability since 2018 causing chronic stress and now have been served a notice of eviction and my landlord is probably committing something called "Self-help eviction" over the last year that might help our case. Regardless, I am currently the metaphoric portrayal of those stressful scenes in disaster movies where someone's trapped in a container filling up with water and their head keeps going under as they trash. They're fighting to take sips of air through the little gap between the uneven water surface. All while trying to help each other stay at the surface. Meanwhile, the gap between uneven water surface and ceiling is closing. And apparently we actually have to wait until the stage where we must all hold our breath (served official eviction court papers on March 6th) and pray the emergency housing structures and support are able to rescue us before we drown. Anyway researching all this and doing everything I can as I can on top of trying to work my ass off finding a job has become its own extremely exhausting, panicky full time job. Also the flooring in my kitchen is super unsafe (part of the possible case of "self-help eviction" going on). I am in high stress survival mode and with the state of the world as it is between queer rights violations, this shit election coming up, women's rights violations, Palestine, and more I am really losing my capacity to hope. All sources of trying to find uplifting motivational spiritual stuff are almost entirely religious and thus the opposite of helpful for someone like me who was spiritually and emotionally abused through childhood by their churches. If prayer, faith, and wishful thinking helped more than just a little placebo-effect, SO MANY more people would be saved from suffering, so many people DESERVE to be rescued. I deserve it, my family deserves it, and whatever you're going through right now if you're also trying not to drown under something, YOU also deserve that rescue. I hope we're one of the lucky stories. I'll fight to keep us all above that closing gap, but I'm finding it impossible to have any kind of faith. No matter the darkness, there's always a next sunrise. That's hope. I have hope. So long as I get to see a next sunrise, there's hope, and if I don't, my need to worry about it anyway is over.
I wish I had the capacity for faith in the universe or anything beyond me, but that's been abused out of me by now. I'm not suicidal, but there's definitely something wrong with the state of "but at least if I die in an accident of some kind this would be over for me." Which I actually fear not because I fear death anymore but because of how much harder that would be for my friends and family to weather on top of all this other shit. Maybe it's enough to have faith in humanity. There's so many ways in which we fall short or are downright horrible to each other and ourselves, but I do have faith in many of us to help who we can, to make the world better. Maybe even in at least half of us. Humanity might not be all-powerful and unfailing, but there are SO MANY we do help and not just each other. Humans are limited, so I only have hope, rather than faith that my family will be one of the lucky ones. We have friends and family ready to help however they can.
Doesn't stop me from being scared. Being a jobless financial burden on even more people in my life is a nightmare. The idea I might never get to see my cats and they'll always wonder what happened to us is even worse. I'll try to focus on faith in humanity, in the counter-measures put in place. And I want to thank those of you I've already opened up to for your support and willingness to help and for just being in my life in general. Without you I might not even have hope over the next sunrise.

We have other things happening but seriously you people are annoying us we're going to do despicable things to you cuz we feel like it it's funny that you go up to New Hampshire and you become mulch most of you without even a shot fired so we can disgusting we need to do it
-we have to clean you out of here we're treating you with respect and stuff and it's wrong he reminds us that Corky's is just March right into a hole and had no purpose in life so we're going to start that again it's such f***** and yeah like Okeechobee has a Gamera and that guy is down there in a bunker. There's also one that is near the bird sanctuary below and it's Tommy f and it's a Godzilla machine it's about 4 miles from it to the east. Jones loop road from the 41 about 4 MI and Walmart is two so he's trying to kidnap him there to try and force Godzilla into their possession.
-my son keeps telling Tommy f go the other way you know. And now it's going the other way and he said this is how it's going all these people going after me cuz when I'm doing and he's been warning us and we didn't listen and when our son says it's not even s ever listen and most often pushed by your own and checked out and said it's true too because he won't shut up and he can't and all that other stuff we're going after him and his right now we have this full-blown thing going after the clothes and it's true
-there's a couple other points besides you organizing again to go to the first ring and you're told not to like everybody and the outer ring you are being disposed of when you go to prison and you should have known it you're asking where they are and stuff and it's the most beautiful conversation I've ever heard what they say is they got sick and died and were disposed of and it said you just threw him away like garbage and they say it too and the guy on the phone doesn't know what to say usually hangs up it's been going that way and they ask you to try to revive and then say yes and then they say You're supposed to notify us first and we'll come take the body and they say no we're not and they're wondering who the hell it is so going there and they're trying to figure it out and they look at the cards and they look like pseudo empire little it turns out to be Jason and he's threatening our son that's right with death and burning so we're going to threaten him. We're going to actually take him down because he's an animal and doesn't listen to anyone and gets hurt a lot and it doesn't do much since these three jackasses of bja but he's more comatose we're beginning to proceed on him now and he's beginning to proceed on himself. And he's attacking Trump and he's trying to evict him.
-Stan and Sherry are not captured yet and are out there and that will be this Sunday that they get captured by the clones held there and then they all get captured even the clones and put into service no it's not the clothes we're going to put into service against the clones and they held in the south they can't leave the battlefield there's a huge flotilla and a whole ring of them in Europe and it's disgusting that's what he's up to and her son doesn't care there's a little bit about the landlord that's going to start Sunday today is Tuesday what happens today is pretty big they go to court and they get charged with criminal charges and put in jail and they get brought to prison is a huge fight over the prison here and they're fighting for people who are in prison across the 75 and they're fighting for people in prison in the middle and these guys get hauled out to the middle every time this is going to be a huge battle it usually more like clues and it's going to go like that daily and it starts a whole bunch of things up like in the UK
-the clothes are being attacked their ships are quieting down half of them shut down and they know that this is probably the last round and they're going to start them up and test them out and then launch so everybody's getting ready to attack it is going to be gigantic
-few more things are going on the sun says you have to fund me no matter what time of the day or year it is and it's true you can't wait until he's down further or a certain time it's all the time and these guys are sitting here saying it's not and they're not full of us it's just that someone thinking and we are trying to get him funding and through multiple sources one is social security and they owe money. They owe money for when they shut off social security and that was shut off by Trump his son Garth his sister and some others like Cherry cheeseman I'm kind of running it now and that's how they came to run it and the new guy says I want to shut it down to start running it and one is Jason and he's too lame and one is bja but we don't want to do it that way and we don't have to so I'm calling them up on it and we're telling them to go screw and we're going to do it a different way they used to just pay the money over and didn't even say who it was doing it as a matter of course and then these guys messed it up these pseudo empire is it into it much but the empire wants it paid and they're going through them rapidly and killing them all off he's supposed friends of our son and they're not and they're dying to hold some money off our son a few bucks and it doesn't make sense cuz they can't get forcing and they can't infiltrate so they're just going to sit here and die like hugs because they just want to kidnap him so we hate them and we're going to help try and get the funds there's a reason to get the money to him some say they want to ask for it back some say it's too much money but mostly it's to have him go to Utah and they have a timetable I'm going to say they're on track and that Sunday bloody Sunday will help and we agree so we're getting in line for that and today is going to line a lot of it up because of the Court sessions and what they're going to hear from these people they're very mean and nasty and they're ready to tell people what they're doing

Understanding your rights as a tenant is essential when it comes to eviction defense. These rights can vary depending on your jurisdiction, but there are common principles that typically apply:
Notice Requirements: Landlords are generally required to provide a written notice before initiating eviction proceedings. The notice period can differ based on the reason for eviction and local laws.

Right to Habitability: Landlords are obligated to provide habitable living conditions, including proper maintenance, repairs, and essential services.
Protection from Discrimination: It's illegal for landlords to evict tenants based on factors like race, gender, religion, or disability.
Due Process: The most essential right you have as a tenant is the right to due process. This means that your landlord can’t just demand that you leave your home without going through the proper legal channels.
Options for Eviction Defense
When facing eviction, tenants may feel like they have few options. However, there are several options for eviction defense that can help tenants stay in their homes. Here are some of the most common options:
Negotiate with your landlord: One of the first things tenants should do when facing eviction is to try to negotiate with their landlord. Tenants can explain their situation and try to come up with an agreement that works for both parties.
Seek legal assistance: Tenants facing eviction can seek legal assistance from an attorney who specializes in eviction defense. A lawyer can help tenants understand their rights, negotiate with landlords, and represent them in court if necessary.
File a motion to stay: Tenants can file a motion to stay, which is a request for the court to postpone the eviction. This can give tenants more time to find a new place to live or negotiate with their landlord.
File a counterclaim: If the eviction is based on false or inaccurate information, tenants can file a counterclaim. This is a legal response to the eviction notice that includes information that disputes the landlord's claim and explains why the eviction is unjust.
Apply for government assistance: Tenants who are struggling to pay their rent can apply for government assistance programs. These programs provide financial assistance to eligible tenants who are facing eviction due to financial hardship.
Eviction defense is a daunting process, but as a tenant, you have rights. Knowing your rights and options can help you defend yourself against an eviction notice. If you are facing eviction, don’t give up hope—there are ways to fight back and keep your home.
