DeJoy’s steps for more postal cuts draw flak – People's World

WASHINGTON—The latest steps by Trump-named Postmaster General Louis DeJoy to cut Postal Service costs by cutting service have drawn bipartisan flak from Capitol Hill and prior protests from USPS workers from Medford, Ore., to Newburgh, N.Y.

DeJoy’s sneered at congressional and other oversight ever since.

The latest saga has its origins in DeJoy’s ten-year plan to put the USPS on a sound financial footing. Past parts of the plan include slowing mail deliveries, closing smaller sorting centers in favor of mega-facilities, forcing workers to move or quit, and incessantly raising prices.

And, in one area where DeJoy and the nation’s postal unions agreed, both lobbied successfully for the section of a postal reform law which ended the $6 billion yearly pre-payment a prior GOP-run Congress and GOP President George W. Under DeJoy’s plan, the USPS was to break even this year, on paper, for the first time in at least 15 years. But DeJoy reported a $1.7 billion loss from April-June and forecast a $5.2 billion loss for fiscal 2023, which ends Sept. 30.

His latest cost-cutting move, launched last year in a test run in Georgia, closes “back office” functions in hundreds of post offices and forces Letter Carriers to drive dozens, if not hundreds, of round-trip miles to regional “Sort and Delivery Centers,” to pick up the mail they now sort in post office back rooms before heading out to deliver it.

Most individual post offices would stay open, but only to sell stamps and provide similar services. But not all: A post office in the rural Baltimore County, Md., town of Fort Howard, whose residents are mostly elderly and without cars, is scheduled to close by Sept. 30. Their postmaster told them about it. Now, residents walk to the post office—Fort Howard’s that small—to get their mail.

There’s no Letter Carrier route. They’d have to drive 14 miles roundtrip to Dundalk to get mail. They came out in 96-degree heat to sign a petition to keep the post office open, WMAR TV reported. Their congressman, Rep. Kwesi Mfume, D-Md., sought a meeting with DeJoy about it. No answer yet.

DeJoy’s also made it impossible to mail anything other than small first-class letters from the blue mailboxes on street corners. In 2020, he yanked out sorting machines for first-class flat mail. And new blue mailboxes have small letter slits at the top, not the pull-down doors able to take large flat envelopes and small packages.

As typical of a corporate chieftain, which is what DeJoy was in the private sector before becoming Postmaster General, his excuse is to cut costs and his method is to load the burden on workers. DeJoy said the move to the central sorting plants would save money and be more efficient.

But distances to the sorting centers which Letter Carriers would have to navigate before even starting their routes would further slow down the mail. That prospect led to workers’ demonstrations in May in Medford, Ore., and elsewhere—and to separate objections from Reps. Paul Ryan, D-N.Y., and Pete Huizenga, R-Mich., whose mostly rural district includes Kalamazoo.

The Medford workers feared their jobs would be moved to Portland, 274 miles away. Kalamazoo residents fear being overwhelmed by mail trucks coming all at once to pick up pre-sorted letters from all over Southwest Michigan, Huizenga wrote DeJoy.

“Consolidating our area’s postal operations to a Sort and Delivery Center” there “threatens to disrupt the current standard of delivery experienced by Southwest Michigan residents,” Huizenga, who represents Kalamazoo and surrounding rural counties, explained.

“Mail carriers would be required to divert to this single center to pick up the mail before proceeding on their route. The workforce would be stretched thin, having to travel much farther to reach communities they serve.

“Residents, including the many older households, rely on prompt mail delivery for time-sensitive materials like medical bills and financial documents.” Besides, masses of vehicles from all over Southwest Michigan converging on one center would cause daily traffic jams, vexing residents.

Huizenga also told DeJoy local citizens and governments have been left in the dark about his plans: No timeline for back-office closures or for opening the sorting center, and no notice to local governments and citizens, much less consultation with them, as last year’s postal law mandates.

Ryan, who represents the Hudson Valley, not only wrote DeJoy, but took his protest public on May 17 in Rock Tavern, N.Y., joined by members of the Letter Carriers, the Postal Workers and the Rural Letter Carriers, three of USPS workers’ five unions. DeJoy wants to close the back-office operations in favor of a big sorting center in Newburgh, N.Y.

“Hudson Valley families deserve only the best service from their post office, but DeJoy is threatening reduced customer service, increased wait times, and post office closures,” Ryan said. “This is completely unacceptable for both postal workers and residents. I will keep fighting alongside my friends in labor to make sure every post office stays open, our postal workers are protected, and there are not any service delays.”

“The APWU is extremely concerned about the proposed transfer of the S&DC” to Newburgh, “specifically as it relates to diminished customer services, increased safety issues, and the possibility of selling and relocating post offices,” added Postal Workers Local 3722 President Diana Cline.

Specifically, a sorting center at Stewart Airport in the town of Newburgh would force Letter Carriers from counties on both banks of the Hudson River to come there to pick up their pre-sorted mail before delivering it. Those coming from the east bank would have to battle their way across the incessantly jammed Newburgh-Beacon Bridge—in morning rush hour—to get it.

Ryan said his constituents “emphatically oppose this change. Moving mail sorting away from our local post offices would surely lead to downsizing and reassignment which risks the wholesale closure of a branch. That is a disservice to Hudson Valley residents, and it is a disservice to hard-working union members across the region.

“Mail carriers from my district are also particularly concerned about the delays to service, added hours in commute time, and the destabilizing effects this plan will have,” Ryan said. It will add to carrier stress and burnout, he warned. He’s gotten no answer from DeJoy."

Former Bank Employee Diape Seck Sentenced to Three Years in Federal Prison for Fraudulently Opening Bank Accounts as Part of a Larger Bank Fraud Scheme Targeting Churches and Religious Organizations. Accepted Cash Bribes to Open the Accounts From Co-Conspirators Engaged in Check Fraud and Rental Car Fraud Schemes Greenbelt, MD (STL.News) U.S. District Judge Theodore D. Chuang today sentenced Diape Seck, age 29, of Rockville, Maryland, to three years in federal prison, followed by three years of supervised release, for his role in a bank fraud scheme in which he and his co-conspirators obtained or attempted to obtain almost $2 million by fraud, including the theft of checks from the mail of churches and religious institutions. Judge Chuang also ordered Seck to pay restitution in the amount of $1,708,446.49 and to forfeit $114,647.50. A federal jury convicted Seck on February 24, 2023. The sentence was announced by Erek L. Barron, United States Attorney for the District of Maryland; Postal Inspector in Charge Damon E. Wood of the U.S. Postal Inspection Service - Washington Division; Special Agent in Charge James C. Harris of Homeland Security Investigations (HSI) Baltimore; Special Agent in Charge Jeffrey D. Pittano of the Federal Deposit Insurance Corporation, Office of Inspector General (FDIC-OIG); Chief Marcus Jones of the Montgomery County Police Department; Chief Terry Sult of the Cary, North Carolina, Police Department; and Sheriff Dusty Rhoades of the Williamson County, Tennessee, Sheriff's Office. According to the evidence presented at his eight-day trial, from at least January 2019 to January 2020, Seck, a customer service representative with Bank A, conspired with Mateus Vaduva, Marius Vaduva, Vlad Baceanu, Nicolae Gindac, Florin Vaduva, Marian Unguru, Daniel Velcu, Vali Unguru, and others to commit bank fraud. Specifically, the evidence showed that Seck fraudulently opened bank accounts in fake identities in exchange for cash bribes. Co-conspirators engaged in fraud that included fraud involving rental cars and the deposit of checks stolen from the incoming and outgoing mail of churches and other religious institutions into the fraudulently opened bank accounts. The co-conspirators then withdrew the funds and spent the fraudulently obtained proceeds. As detailed in the trial evidence, Diape Seck facilitated the opening of hundreds of bank accounts at Bank A for his co-conspirators, who used purported foreign identities, often but not universally Romanian, to fraudulently open bank accounts with him at Bank A, as well as bank accounts at other victim financial institutions. Seck opened accounts for co-conspirators without their presence in the bank, without verifying identity information, and opened accounts for co-conspirators who opened multiple accounts at a time under different identities. To conceal his improper activities, Seck opened accounts for the co-conspirators at the same time, he conducted legitimate bank activities. The co-conspirators paid Seck up to $500 in cash in exchange for each of the fraudulent bank accounts he opened. According to court documents and witness testimony, Seck violated numerous bank policies in opening approximately 412 checking accounts in a one-year period from approximately January 2, 2019, through January 3, 2020, relying predominantly on purported Romanian passports and driver's license information. Checks payable to and written from churches and other religious institutions from around the country were deposited into many of the 412 checking accounts, which were not opened in the names of the churches. The co-conspirators fraudulently negotiated the stolen checks by depositing them into the victim's bank accounts, including the fraudulent accounts opened by Seck at Bank A, often by way of automated teller machine (ATM) transactions. After depositing the stolen checks into the bank accounts, the conspirators made cash withdrawals from ATMs and purchases using debit cards associated with the bank accounts. Co-conspirators also used fraudulently obtained debit cards to rent cars which they used and then failed to return, resulting in charges by the rental car companies, which had to be "written off" by Bank A. According to court documents, co-conspirators deposited at least approximately $780,064.04 in stolen checks into the accounts Seck personally opened on their behalf, and the bank had to write off at least approximately $921,590.50 from the co-conspirators' rental car fraud in the accounts Seck opened for them. Co-conspirators Vlad Baceanu, age 38; Marian Unguru, age 36; and Vali Unguru, age 20, all of Baltimore, Maryland, previously pled guilty to conspiracy to commit bank fraud and wire fraud. Mateus Vaduva, age 29, of Baltimore, was sentenced to five years in federal prison and ordered to pay restitution of $1,320,885.84; Nicolae Gindac, age 52, of Dania Beach, Florida, was sentenced to 54 months in federal prison and ordered to pay restitution of $1,096,660.11; Florin Vaduva, age 31, of Dania Beach, Florida was sentenced to 51 months in federal prison and ordered to pay restitution of $1,096,660.11; Marius Vaduva, age 28, of Baltimore was sentenced to 42 months in federal prison and ordered to pay restitution of $1,334,230.84; and Daniel Velcu, age 43, of Baltimore was sentenced to 34 months in federal prison and ordered to pay restitution of $1,313,499.79 after they previously pled guilty to conspiracy to commit bank fraud and wire fraud. Robert Reich - Musk's Humongous Mistake

When Elon Musk bought Twitter for $44 billion, he clearly didn’t know that the key assets he was buying lay in Twitter’s 7,500 workers’ heads.

On corporate balance sheets, the assets of a corporation are its factories, equipment, patents, and brand name.

Workers aren’t considered assets. They appear as costs. In fact, payrolls are typically two-thirds of a corporation’s total costs. Which is why companies often cut payrolls to increase profits.

The reason for this is simple. Corporations have traditionally been viewed as production systems. Assets are things that corporations own, which turn inputs — labor, raw materials, and components — into marketable products.

Reduce the costs of these inputs, and — presto — each product generates more profit. Or that’s been the traditional view.

Yet today, increasingly, corporations aren’t just production systems. They’re systems for directing the know-how, know-what, know-where, and know-why of the people who work within them.

A large and growing part of the value of a corporation now lies in the heads of its workers — heads that know how to innovate, know what needs improvement, know where the company’s strengths and vulnerabilities are found, and know why the corporation succeeds (or doesn’t).

These human assets are becoming the key assets of today’s corporations. But they can’t be owned, as are factories, equipment, patents, and brands. They must be motivated.

When Musk fired half of Twitter’s workforce, then threatened to fire any remaining dissenters and demanded that the rest pledge to accept “long hours at high intensity” — leading to the resignations last week of an estimated 1,200 more Twitter employees — he began to destroy what he bought.

Now he’s panicking. Last week he tried to hire back some of the people he fired. On Friday he sent emails to Twitter employees asking that “anyone who actually writes software” report in, and stating that he wanted to learn about Twitter’s “tech stack” (its software and related systems).

But even if Musk gets this information, he probably won’t be able to save Twitter.

Most of Twitter’s employees are now gone, which means most of its know-how to prevent outages and failures during high-traffic events is also gone, most of its know-what is necessary to maintain and enhance computing architecture is gone, most of its know-where to guard against cyberattacks is gone, and most of its know-why hate speech (and other awful stuff advertisers want to avoid) is getting through its filters and what to do about it, is also now gone.

Without this knowledge and talent, Twitter is a shell — an office building, some patents, and a brand — without the capacity to improve or even sustain its service.

Twitter is unlikely to fail all at once. But bugs and glitches will mount, the quality of what’s offered will deteriorate, hateful tweets will burgeon, and customers and advertisers will flee.

As Richard Forno, assistant director of the Center for Cybersecurity at the University of Maryland, Baltimore County told the New York Times, “it’s like putting a car on the road, hitting the accelerator, and then the driver jumps out. How far is it going to go before it crashes?”

Not even Donald Trump seems particularly eager to take up Musk’s offer to have him back on the platform.

Safe to say, Twitter is no longer worth the nearly $44 billion Musk paid for it. It’s now probably worth only a fraction of that sum — a fact that should be of no small concern to the bankers who lent Musk $30 billion to purchase Twitter on condition he pay $1 billion a year in interest.

Two lessons here.

First, corporations that regard employees only as costs to be cut rather than as assets to be nourished can make humongous mistakes. Elon Musk is Exhibit #1.

Second, where corporations view employees as costs, the traditional way for employees to flex their muscle is to strike, thereby temporarily closing factories and stopping the machines.

But where employees are a corporation’s key assets, workers’ greater power comes in threatening to — or actually — walking out the door. Elon Musk is Exhibit #2.

Your mother was a kind woman, she single-handedly raised you in Baltimore, Maryland, and rose through the ranks of her corporate job, ending up as a mid-level manager before she died. A car accident stole her ability to work, every bit of money she made was funneled towards her medical care and then to her funeral.

You had sat next to her on her deathbed, cradling her cold hands between yours and trying to force a comfortable smile to ease her pain. She had looked you in the eyes, a tired smile gracing her face before she leaned forward and spoke in a breathy voice, “Doctor Stephen Strange.”

And then, she died. You were 15, nearly broke, and completely out of options. You had never known your mother's family - she always changed the subject or dismissively waved her hand when you asked about them. She never spoke about her past at all, you realized, watching the view outside of the cloudy train window. You sighed and changed your position on the uncomfortable seat, hoping the combination of your loud music and the nice view would lull you to sleep - or at least a sense of peace. A huff of air blew through your nose as you recounted your mother's last words. Doctor Stephen Strange - a man you spent hours searching for at the public library and only finding through a dated article claiming he was in an accident.

“Must be somethin’ in the air,'' you mumbled to yourself, fumbling with the chain on your mother's old necklace. It was rusted and covered in fingerprints that always seemed to be visible no matter how hard you scrubbed at it, with a small piece of metal in the back annoyingly pressing into the back of your neck each time you moved your head. Despite everything wrong with it, you clung to it. A year before she had died, you had asked your mother the significance of the necklace and she had taken the time to describe the man who gave it to her.

A deep breath pushed through your lungs as you pressed the tip of your nails into your palm until a small crescent moon appeared on your skin. Thinking of her too much would make you cry, you reminded yourself, and you do not need to cry on this stupid old train. So, instead, you pondered the man she sent you after.

Doctor Stephen Strange. A dumb name, you decided after thinking about it for a second. You had memorized every photo of him you could find, with his smooth dark hair and the white streaks that slowly appeared over the years. You wondered how old he was, what he liked to do. What kind of man was this Doctor Stephen Strange? Was he kind like your mother? He must have been someone she trusted if she sent you after him.

Almost as if on cue, the train screeched to a halt and the various passengers began to stand and get off at the station. You hastily followed their lead, stuffing your hands in your pockets and leaving your only luggage on the train. With one last look at the faded purple bag, you stepped off the train and dumped your phone in a trashcan. There was no way that social services were going to find you before you found this man. You wouldn’t let them ruin this, let them take your mother away from you for good.

You flipped your hood up and walked through the station, occasionally getting shoved by people who gave you pointed glares instead of hurried apologies. But you didn’t care - you had a goal.

With one final step, you left the station and stepped into the cool New York air. You followed the crowd, awestruck at the size and density of the city. It seemed like everywhere you looked, 100 more people showed up. Part of you was tempted to stand in place and watch the world spin around you, to ponder what brought each person here, what they dreamed of, and what they feared. But you simply shook the thoughts from your head and continued on, nearly passing your destination and only noticing when you heard the squeal of a siren. You spun on your heel and looked at the looming building, pushing yourself through the front door and breaking into a sprint until you saw the front desk.

So focused, you hadn’t seen where you were going until you crashed into a blonde woman with her hair tied into a neat bun.

“Oh!” You exclaimed, dropping to your knees and picking up everything she dropped when you crashed into her. “I’m so sorry. Are you alright?”

“I’m fine. Are you okay? You look like you're in quite a hurry.”

You nodded enthusiastically, “I am, actually. I’m looking for a man-”

“A patient? You’ll have to check in with the front desk.” The woman stood and rubbed the dust off her scrubs.

“No, no. He’s a doctor.” You winced, remembering the article. “Was a doctor? I’m not sure.”

Her eyebrows scrunched together in thought, “I’m really sorry, but I’m kind of on a schedule.” She began to walk away, shooting you an apologetic face as she left.

“Wait!” You chased after her and grabbed her sleeve. “Stephen Strange.”

The woman stiffened, her head snapping towards you. “What?”

“Doctor Stephen Strange. My mother told me his name before she died. I want to know why.” You avoided eye contact, slightly uncomfortable with her scrutinizing stare.

She sighed heavily, “Stephen is an egotistical man. Whatever she sent you for, most likely wasn’t good.”

“I don’t care! It’s all I have left.” You looked up, a new fire burning in your eyes. “If I leave now - this will all be for nothing. And besides, I don’t have anywhere to go!”

The woman ran a hand through her hair and set the stuff she was holding down on a nearby cart, “What’s your name?”

“(Y/N). (Y/N) (L/N).”

“Well, (Y/N),” she smiled sadly, “my name is Christine Palmer. I’ll… try to help you find Stephen.”

“Thank you!” You exclaimed and grabbed her hands, “Thank you so much, Christine. I promise I’ll make it up to you.”

“Just…” she sighed, “just don't get your hopes up, okay?”

“Hopes are down.” You lied, the giant smile on your face betraying you.

Christine tugged her hand free and rubbed at her temples, “I’m going to regret this.”

...

“I regret this.” You spoke in a hushed voice, trembling before the large door. Christine rubbed your shoulders and smiled reassuringly at you.

“You’ll do fine, (Y/N). You haven’t spent the last two months staying at my place to give up now, have you?”

“No. No, of course not. I’m just…”

“Scared?” She finished for you.

“Terrified.”

“He has that effect on people. Go on, knock.”

“I can’t.”

“Sure you can!” She leaned forward and harshly knocked on the door. “See? Easy.”

“Christine!” You hissed, quickly turning to face her with wide eyes.

“Oops.” She laughed and retreated down the stairs as the door slowly opened.

A tall man stood in front of you, his eyes were worn down and his lips seemed to be pressed too thin. He looked you down, narrowing his eyes in confusion, “Hello?”

“Hi.” You gulped down your fear, your fingers unconsciously playing with the rusted, old necklace that seemed a bit colder than normal. “My name is-”

“How did you get that?” He interrupted you, looking down at the necklace.

“The… what?”

“The necklace. How did you get that?”

“Actually, this is a great segway, my mother-”

“Your mother?”

“Yes, my mother! My mother gave it to me - or, I kinda… took it. But still, it was my mother's necklace and after she died, I took it and she gave me a name so I went to New York looking for this man with the strangest name. Anyway, I found Christine who let me stay with her and she says I can find him here, so I guess now I’m asking do you know a Stephen Strange?” You took a deep breath after you rambled, looking into his eyes and watching him realize something.

“(L/N)?”

“That’s my last name.”

He sighed and leaned against the door. “Christine, why didn’t you tell me earlier?”

“You weren’t exactly in a talking position the last time I saw you.” She countered.

“Tell you what? Tell him what?” You looked between the two of them in confusion.

“Come in.” He ushered you inside, “Please, take a seat. This is going to be… tough for you to understand.”

“Alright.” You nervously walked inside, scared about what he was going to tell you. You sat on a black leather chair, running your fingers over the golden indents on the arms.

“My name is Stephen Strange.” He began, and your heart started to race. “And, if I understand this correctly, it appears you’re my daughter.”

You paused. Did you hear that right? No, of course, you didn’t. Your father died. It was the only thing you knew about him for certain. He died of cancer. He was not this random dude you found in this weirdly nice-looking building.

“Bullshit. My father is dead.”

“Is that the story she told?”

“It’s not a story, it’s the truth!” You stood and began to leave the building.

“May 2nd, it was raining.” You paused as his voice echoed through the building. “We had been on our fifth date, but picnic dates and rainstorms don’t exactly go well together. We decided to go window shopping instead. I bought nearly everything I liked, but your mother would only smile at it instead. I hadn’t realized until I saw her staring at this beautiful necklace, and her eyes glistened in a way I’d never seen before. So I asked her to look at something and when she was distracted, I bought the necklace and engraved the day in the back. When I gave it to her she had said,” a smile grew on his face, a sad and distant smile, one that you recognized quite well.

“You are the stupidest man I've ever met.” The two of you spoke in unison. You looked up and his eyes met yours.

“When she disappeared, I assumed she’d thrown it out. But I guess she was a woman of many secrets.” He walked towards you and thumbed the front of the necklace. “Oh - there. You can still see the dent from when she dropped it down the stairs.” He ran his nail across a minuscule dent, one you had never noticed before.

“Are you really…?” Your voice cracked.

“I’m not sure.” He sighed, “But I’d love to find out.”

“I don’t have money.” You spoke before you could catch yourself, “I’m not even sure how we could find out for certain, it would all be-”

“Don’t worry about money.” He ruffled your hair, “You came all the way here, you found me. It’s only fair that I do my share of the work.”

You wiped a tear from your eye as you sniffled, “You… you were her last words.” He froze and you took that as a sign to continue talking, “She said your name and I looked and looked and looked and I couldn’t find you but you were right here and I had no idea, and now I’m in front of you and I don’t know what to say.”

He chuckled softly and kneeled down to your eye level, “You don’t need to say anything. If anything, I should be apologizing for not finding out about you sooner. But you’re here now, and so am I, and it’s going to be okay.”

You leaned forward and smelled his cologne, “I miss her so much.”

“I know,” he wrapped his arms around your back, “I do too.”

After a few moments of hugging, you pulled away and looked at him again. He smiled haphazardly and squeezed your arm. In that infinite moment, you almost felt your mother's arms wrapped around you, almost felt like you were whole again.

It took only a few weeks for him to obtain a paternity test and within the month, you got the news you were waiting for. The paper was filled with numbers and words you barely registered because at the bottom was the phrase probability of paternity: 99.99%. Neither of you had said anything, only staring at the paper and eventually turning to each other with a wide grin.

“It’s official.” He spoke in a breathy voice. “You’re my daughter.”

“Does this mean I move in with you now?” You spoke, mostly in shock.

He chuckled, “It could if you’d like. But for now,” he stood and grabbed a small wrapped box and slid it over to you, “I got you a present.”

“A gift?” You looked at him with wide eyes. “Why?”

“To celebrate.”

You swallowed anxiously and unwrapped the present, looking at a small box with inquisitive eyes. As you peeled the lid off the box, you frowned in confusion at Steph- your dad. “Mom's necklace?”

He lifted it from the box and clasped it around your neck, “I added a ward onto it. No magic or spell can affect you while you’re wearing it.”

“Oh.” You touched the metal, “Thank you.”

“Now that that’s settled,” he stood and clapped his hands against his thighs, “We should really get you enrolled in school.”

“Speaking of,” you crossed the room and grabbed a pamphlet out of your new backpack, and shoved it in his hands, “I liked this one.”

“Midtown School of Science and Technology?” He looked through the pamphlet, “Not that I don’t love the idea, but isn’t that place a bit tough to get into?”

“Yes, well,” you smiled confidently, “the entrance exams can’t get that hard if my formerly-a-neuro-surgeon father helps me study.”

He laughed suddenly, “Well, I suppose you’re right. Let’s see if we can get you in.”

You were right, the tests were a breeze. But you seemed to overlook the hardest part: being a new student in an elite school. People were far too busy to even look at you, and you spent the first few weeks struggling through the courses hoping to make a friend. It was one of the days where you felt even more lonely than usual when two lunch trays slid across from you. Connected to them were two boys, roughly your age, with sympathetic smiles.

“Hi.” The skinnier of the two said, awkwardly looking at his friend.

The friend, seemingly just happy you hadn’t up and left yet, beamed at you. “Hi, my name is Ned and this is my friend Peter.”

“Nice to meet you?” You looked between the two of them.

Ned sat and began to pick at his food, Peter quickly followed his lead. After a brief awkward silence, Ned spoke up again, “So, did you just move here?”

“Kind of.” You responded, suddenly fascinated with the shitty lunch food.

“That’s nice. Hey, have you heard about Spider-Man?”

Peter elbowed Ned and shot him a glare, “Ned!” He hissed.

“Spider-Man?” You looked up in confusion.

“You really don’t know?”

“No, I’m from Baltimore.” You replied, knowing it was a weak excuse by their confused expressions.

“Spider-Man.” Ned continued. “Friendly Neighborhood Web-Head. Masked menace.”

“Menace?” You recoiled. “Is he like… a super-villain?”

“What? No.” Peter looked at you with a comforting expression before switching to a pleading expression pointed at Ned. “Let’s just stop talking about him.”

“No, I’m kinda curious. What’s he like?”

Ned smiled, “He’s a vigilante! He stops criminals and saves lives.”

You nodded, “Like Iron Man.”

“Like Iron Man.” Ned confirmed.

“I wonder if I’ll ever get to meet Spider-Man,” you thought out loud. “Must be fun being a vigilante.”

Peter looked at you, his mouth somewhat agape as he considered you. Had he known what was coming, he would have stood and walked away. Had he known what painful future awaited you, he never would have sat down in the first place.

He just wishes he meant it when he told himself that.

Federal law enforcement has been [asking for a backdoor][2] to read Americans’ encrypted communications for years now. FBI Director Christopher Wray did it again last week [in testimony to the Senate Judiciary Committee][3]. As usual, the FBI’s complaints involved end-to-end encryption employed by popular messaging platforms, as well as the at-rest encryption of digital devices, which Wray described as offering [“user-only access.”][4]

The FBI wants these terms to sound scary, but [they actually describe security best practices][5]. End-to-end encryption is what allows users to exchange messages without having them intercepted and read by repressive governments, corporations, and other bad actors. And “user-only access” is actually a perfect encapsulation of how device encryption should work; otherwise, anyone who got their hands on your phone or laptop—a thief, an abusive partner, or an employer—could access its most sensitive data. When you intentionally weaken these systems, it hurts our security and privacy, because there’s no magical kind of access that only works for the good guys. If Wray gets his special pass to listen in on our conversations and access our devices, corporations, criminals, and authoritarians will be able to get the same access.

It’s remarkable that Wray keeps getting invited to Congress to [sing the same song][6]. Notably, Wray was invited there to talk, in part, about the January 6th insurrection, a serious domestic attack in which the attackers—far from being concerned about secrecy—proudly broadcast many of their crimes, resulting in hundreds of arrests.

It’s also remarkable what Wray, once more, chose to leave out of this narrative. While Wray continues to express frustration about what his agents can’t get access to, he fails to brief Senators about the shocking frequency with which his agency _already_ accesses Americans’ smartphones. Nevertheless, the scope of police snooping on Americans’ mobile phones is becoming clear, and it’s not just the FBI who is doing it. Instead of inviting Wray up to Capitol Hill to ask for special ways to invade our privacy and security, Senators should be asking Wray about the private data his agents are already trawling through.

### **Police Have An Incredible Number of Ways to Break Into Encrypted Phones**

In all 50 states, police are breaking into phones on a vast scale. An October report from the non-profit Upturn, “[Mass Extraction][7],” has revealed details of how invasive and widespread police hacking of our phones has become. Police can easily purchase forensic tools that extract data from nearly every popular phone. In March 2016, Cellebrite, a popular forensic tool company, supported “logical extractions” for 8,393 different devices, and “physical extractions,” which involves copying all the data on a phone bit-by-bit, for 4,254 devices. Cellebrite can bypass lock screens on about 1,500 different devices.

How do they bypass encryption? Often, they just guess the password. In 2018, Prof. Matthew Green [estimated][8] it would take no more than 22 hours for forensic tools to break into some older iPhones with a 6-digit passcode simply by continuously guessing passwords (i.e. “brute-force” entry). A 4-digit passcode would fail in about 13 minutes.

That brute force guessing was enabled by a hardware flaw that has been fixed since 2018, and the rate of password guessing is much more limited now. But even as smartphone companies like Apple improve their security, device hacking remains very much a cat-and-mouse game. As recently as September 2020, [Cellebrite marketing materials][9] boasted its tools can break into iPhone devices up to “the latest iPhone 11/ 11 Pro / Max running the latest iOS versions up to the latest 13.4.1”

Even when passwords can’t be broken, vendors like Cellebrite offer “advanced services” that can unlock even the newest iOS and Samsung devices. Upturn research suggests the base price on such services is $1,950, but it can be cheaper in bulk.

Buying electronic break-in technology on a wholesale basis represents the best deal for police departments around the U.S., and they avail themselves of these bargains regularly. In 2018, the Seattle Police Department [purchased 20 such “actions”][10] from Cellebrite for $33,000, allowing them to extract phone data within weeks or even days. Law enforcement agencies that want to unlock phones en masse can bring Cellebrite’s “advanced unlocking” in-house, for prices that range from $75,000 to $150,000.

That means for most police departments, breaking into phones isn’t just convenient, it’s relatively inexpensive. Even a mid-sized police department like Virginia Beach, VA [has a police budget of more than $100 million][11]; New York City’s police budget is over $5 billion. The FBI’s 2020 budget request is [about $9 billion][12].

When the FBI says it’s “going dark” because it can’t beat encryption, what it’s really asking for is a method of breaking in that’s cheaper, easier, and more reliable than the methods they already have. The only way to fully meet the FBI’s demands would be to require a backdoor in all platforms, applications, and devices. Especially at a time when police abuses nationwide have come into new focus, this type of complaint should be a non-starter with elected officials. Instead, they should be questioning how and why police are already dodging encryption. These techniques aren’t just being used against criminals.

### **Phone Searches By Police Are Widespread and Commonplace**

Upturn has documented more than 2,000 agencies across the U.S. that have purchased products or services from mobile device forensic tool vendors, including every one of the 50 largest police departments, and at least 25 of the 50 largest sheriffs’ offices.

Law enforcement officials like Wray want to convince us that encryption needs to be bypassed or broken for threats like terrorism or crimes against children, but in fact, Upturn’s public records requests show that police use forensic tools to search phones for everyday low-level crimes. Even when police don't need to bypass encryption—such as when they convince someone to "consent" to the search of a phone and unlock it—these invasive police phone searches are used “as an all-purpose investigative tool, for an astonishingly broad array of offenses, often without a warrant,” as Upturn put it.

The 44 law enforcement agencies who provided records to Upturn revealed at least 50,000 extractions of cell phones between 2015 and 2019\. And there’s no question that this number is a “severe undercount,” counting only 44 agencies, when at least 2,000 agencies have the tools. Many of the largest police departments, including New York, Chicago, Washington D.C., Baltimore, and Boston, either denied Upturn’s record requests or did not respond.

“Law enforcement… use these tools to investigate cases involving graffiti, shoplifting, marijuana possession, prostitution, vandalism, car crashes, parole violations, petty theft, public intoxication, and the full gamut of drug-related offenses,” Upturn reports. In Suffolk County, NY, 20 percent of the phones searched by police were for narcotics cases. Authorities in Santa Clara County, CA, San Bernardino County, CA, and Fort Worth, TX all reported that drug crimes were among the most common reasons for cell phone data extractions. Here are just a few examples of the everyday offenses in which Upturn found police searched phones:

* In [one case][13], police officers sought to search two phones for evidence of drug sales after a $220 undercover marijuana bust. * Police stopped a vehicle for a “left lane violation,” then “due to nervousness and inconsistent stories, a free air sniff was conducted by a … K9 with positive alert to narcotics.” The officers found bags of marijuana in the car, then seized eight phones from the car’s occupants, and [sought to extract data from them][14] for “evidence of drug transactions.” * Officers looking for a juvenile who allegedly violated terms of his electronic monitoring found him after a “short foot pursuit” in which the youngster threw his phone to the ground. Officers [sought to search the phone][15] for evidence of “escape in the second degree.”

And these searches often take place without judicial warrants, despite the U.S. Supreme Court’s clear ruling in [_Riley v. California_][16] that a warrant is required to search a cell phone. That’s because police frequently abuse rules around so-called consent searches. These types of searches are widespread, but they’re hardly consensual. Forensic searches of cell phones are increasingly common. The Las Vegas police, for instance, examined 260% more cell phones in 2018-2019 compared with 2015-2016.

The searches are often overbroad, as well. It’s not uncommon for data unrelated to the initial suspicions to be copied, kept, and used for other purposes later. For instance, police can deem unrelated data to be “gang related,” and keep it in a “gang database,” which have often vague standards. Being placed in such a database can easily affect peoples’ future employment options. Many police departments don’t have any policies in place about when forensic phone-searching tools can be used.

### **It’s Time for Oversight On Police Phone Searches**

Rather than listening to a litany of requests for special access to personal data from federal agencies like the FBI, Congress should assert oversight over the inappropriate types of access that are already taking place.

The first step is to start keeping track of what’s happening. Congress should require that federal law enforcement agencies create detailed audit logs and screen recordings of digital searches. And we agree with Upturn that agencies nationwide should collect and publish aggregated information about how many phones were searched, and whether those searches involved warrants (with published warrant numbers), or so-called consent searches. Agencies should also disclose what tools were used for data extraction and analysis.

Congress should also consider placing sharp limits on when consent searches can take place at all.
