Reaction to the delay and debate around expanding MAiD
As Ottawa seeks to delay the expansion of medically-assisted dying to people suffering from mental illness, patient advocates are disappointed.
“There have been a number of Canadians, we don’t know how many, who have been patiently waiting for that sunset clause to expire on March 17 and they’re going to be very disappointed they have to wait for a longer period of time,” said retired Senator James Cowan, who is also a board member of Dignity of Dying Canada.
Medical Assistance in Dying—or MAiD—is set to open up to patients whose sole underlying condition is a mental disorder on March 17. But last week, Justice Minister David Lametti announced the federal government would ask parliament for a delay after hearing concerns the health-care system might not be ready to handle those complicated cases.
Cowan believes the crucial question isn’t if MAiD ought to be an option for people with mental illness but when.
“The courts have already established. Parliament has confirmed that MAiD is a right that you have if you meet the criteria that are set forth in the legislation,” Cowan said.
But others, such as psychiatrist Dr. John Maher, have concerns. He spoke with W5 for its documentary on medically assisted dying that aired on CTV this past weekend.
At meetings with a team of social workers and nurses, the psychiatrist talks about patients they are working to help. Much of their work focusses on suicide prevention.
“We’re talking about which of our patients are going to die. And it’s having a profound impact about what it means as professionals, as caring human beings to try and provide hope for people,” Maher said.
“It is state sanctioned suicide insofar there is a structure created that provides a pathway to death. I have a patient right now who’s saying, ‘I would never kill myself on my own but I will kill myself with MAiD because that’s not suicide.’”
Even with a possible delay to the expansion of MAiD, a team of physicians, nurses, ethicists and mental health and addictions stakeholders are preparing for an eventual expansion and developing a Nova Scotia approach.
“I think our job in Nova Scotia is to be prepared for what will happen, whenever it will happen,” said Dr. Gord Gubitz, the MAiD clinical lead at Nova Scotia Health.
Nova Scotia Health has about 60 physicians and nurse practitioners who are currently assessing patients applying for MAiD but the majority do not do this work full-time.
Dr. Gubitz said the team is adding more full-time nurse practitioners, recruiting more doctors and nurses and will hire experts in the field of mental health and addictions, as well as a social worker. They’re also developing their own set of policies. Dr. Gubitz noted his job isn’t to weigh into the debate or reopen legislation but to determine if a patient who is suffering is eligible for MAiD and if this is the right choice for them.
“For people with mental health as a sole underlying condition, they still have to meet all of the other criteria,” he said, noting their it has to be grievous and irremediable and in a state of continuing decline.
“They have to be suffering in a way that they can’t find relief from. They have to have the ability to consent,” he said, pointing out the government is now hashing out what that looks like.
Gubitz believes Nova Scotians and his team has benefitted from having one health authority that is managing and building its MAiD system in a centralized way. It allows them to build the health infrastructure needed and act proactively.
“At the end of the day, it’s all about providing high quality care as best as we can possibly do it,” he said.
Executive Director of the Nova Scotia College of Social Workers Alec Stratford said his organization believes patients who are suffering from mental illness ought to have the right to choose MAiD but he also thinks more focus and investment needs to go into supporting people who are suffering.
“When we talk about a right to die and a right to die with dignity, what we’re missing in our political and policy decisions is that we have failed in providing meaningful supports and policy that allows people to live with dignity,” Stratford said.

'Broken system:' Policing shortages facing N.B. communities highlight national issue
Some New Brunswick communities are being forced to find creative solutions to law enforcement because of RCMP policing shortages, a phenomenon experts say is symbolic of what much of small-town Canada is experiencing.
Residents of McAdam, N.B., a historic village of about 1,100 people northwest of Saint John, have organized overnight patrols to compensate for a lack of police presence. While 200 kilometres north, the small town of Tobique Valley hired private security guards over one weekend last year after a wave of thefts.
The officer shortage in Tobique Valley is causing a rise in theft and vandalism, district Mayor Tom Eagles said in a recent interview.
"They work shifts and there's times you don't see them here for days," Eagles said about RCMP officers. "I still think we have the best police force in the world. But they're working under a broken system."
The RCMP -- aside from combating major crime such as terrorism and human trafficking -- are contracted to provide policing to about 150 municipalities across Canada in eight provinces; Quebec and Ontario have their own provincial police services. But the RCMP are having trouble recruiting, and small communities across the country say they are suffering as a result.
"It's a dangerous job. And then the RCMP more recently have come under a lot of public criticism," Michael Boudreau, professor of criminology at St. Thomas University, said in a recent interview. As well, the force was never created to provide rural and small-town policing, he said.
"They were created to be a national police force, but not necessarily a rural police force. They were created to do things like human trafficking, terrorism, organized crime, but in terms of day-to-day policing on the ground -- that was never really the intention of the force."
Labour shortages are preventing officers from responding in a timely manner, a problem not just in New Brunswick but also in Nova Scotia, Boudreau said.
The RCMP's rural policing problems were highlighted in the final report of the public inquiry that investigated Nova Scotia's mass shooting, during which 22 people were murdered over two days in April 2020 by a gunman driving a replica RCMP police car. The report by the Mass Casualty Commission found widespread failures in how the Mounties responded to Canada's worst mass shooting and recommended that Ottawa overhaul the way police are trained.
The report also said provincial and municipal officials should have more say in RCMP staffing decisions, including the in the selection of detachment commanders.
Boudreau said the Nova Scotia gunman was able to elude the police for as long as he did partly because he knew the area while some of the RCMP officers didn't. "The idea of community policing isn't working, because in order to do community policing you actually have to be in the community," he said.
Meanwhile, in the town of McAdam, residents installed security cameras on their properties and ensure to lock up bikes and other possessions to deter thieves. Mayor Ken Stannix said that after complaining about the lack of police presence between the hours of midnight and 6 a.m. -- when most of the thefts seem to happen -- "we were able to get an RCMP officer to patrol the odd night."
"Right now, the RCMP are responsible for not only crimes within the communities, but they also look after the highways and a whole host of other things," Stannix said in an interview Thursday. "Because of that they get spread pretty thin."
In Tobique Valley, Eagles said, the fire department has started responding to highway accidents because of a lack of police. "They do come. I mean, if it's serious they do come," he said of RCMP called to traffic accidents. "Sometimes it's later it's not as quick as we'd like it. You can wait a long time."
Eagles said the former RCMP detachment in the community of Plaster Rock -- before it was amalgamated to form Tobique Valley -- was staffed by four officers who got to know residents. "But now we know nobody. We don't know a soul."
The New Brunswick government set aside $20.5 million in its recent budget to pay for 80 additional RCMP officers and 51 new front-line officers for rural areas. New Brunswick Premier Blaine Higgs, however, has also said his government was open to other policing models.
"Right now we're trying to enhance the model we have because that's what we know," he recently told reporters. "But .... Anything that will improve the safety of our communities we would be willing to look at and understand clearly."
New Brunswick RCMP spokesman Cpl. Hans Ouellette said there are enough officers to respond to urgent calls and ensure public safety.
"N.B. RCMP policing resources are based on workload and other factors, not a minimum number of police officers," he said in an email. "The future allocation of police resources will be measured against theses factors, while also considering factors such as the ratio of police to population and geography."
Boudreau said RCMP incoming commissioner Mike Duheme has a herculean task ahead of him to reform the institution, adding that implementing the recommendations of the Mass Casualty Commission will require a great deal of time and effort.
"The Mass Casualty Commission indicated, and others have indicated in the past as well, myself included, the RCMP have to stop doing rural policing," he said.
"We need to rethink how policing is done. Perhaps it's time for a provincial police force."

Defence Minister Harjit Sajjan's military assistant is an army reservist who was suspended from the Vancouver Police Department for having an inappropriate relationship with a subordinate. Maj. Greg McCullough was recruited by the military, according to Sajjan's office, and neither the minister nor his staff was informed of the complaint or disciplinary action taken against him while he was a sergeant with Vancouver police.
In a statement, spokesman Daniel Minden said, "Neither the minister nor his staff were aware of the complaints to the Office of the Police Complaint Commissioner or the disciplinary actions taken by the Vancouver Police Department. We expect all members of the Canadian Armed Forces to conduct oneself in the most professional way imaginable. The Canadian Armed Forces are in control of hiring military assistants. That is something we're looking into further.”
The announcement of McCullough's hiring came as Sajjan faces calls from the opposition to resign over his handling of top-level sexual misconduct allegations and concerns about a "Old Boys network" that protects senior officers from retribution. McCullough is a senior member of the British Columbia Regiment (Duke of Connaught's Own), the same army reserve unit that Sajjan led before entering politics, but they both served on the Vancouver Police Department.
While asked about the two's relationship, Minden said: "At the Vancouver Police Department, the minister did not cooperate with Maj. McCullough. They met as reservists in the British Columbia Regiment after becoming buddies."
Questions about McCullough's appointment, why the job was founded, and the process was referred to the Department of National Defence by Minden. Defence Department spokesman Daniel Le Bouthillier said in an email that Sajjan now has six military assistants. They all work collaboratively with the minister's office to offer a broad array of service.
"For instance, this support includes improving information flow between the CAF and the (Defense Minister), giving logistical support for travel and communications, scheduling military briefings, and overall liaison services," he said.
McCullough was hired on a two-year contract in March 2020 "to support (Sajjan) while he is in his home riding," according to Le Bouthillier. "The hiring was done on the basis of a Reserve Employment Opportunity, which is a nationwide advertised employment process available to eligible Reserve Force members across Canada."
Le Bouthillier did not mention whether military or the minister's office recommended the position be created. "We have no formal record of such a circumstance," Le Bouthillier said that when asked how often military assistants are engaged outside of Ottawa.
When reached by phone on Wednesday, McCullough told The Canadian Press that his present employment is with the military, not with Sajjan. He further claimed that the minister had nothing to do with his employment.
He stated, "Minister Sajjan had nothing to do with my recruiting process. Because of the amount of time he spends on the West Coast, he needed a military aide, and that was it. I did not discuss this procedure with Minister Sajjan, and I am a member of the Canadian Armed Forces.”
When questioned about his connection with Sajjan, McCullough gave the same response. According to media reports from last year, McCullough was suspended for 15 days in 2018 after an external inquiry determined he failed to disclose a connection with Const. Nicole Chan and joined the relationship despite knowing she was in a vulnerable position.
The OPCC annual report for 2018-19 does not mention McCullough, but it does call for a five-day punishment for a cop who "was in a personal, intimate relationship with a cop who was under his direct supervision" and "failed to disclose this relationship to his supervisor."
The OPCC also recommended a 10-day suspension for the same officer for "entering into a relationship with another police officer knowing that the police officer was in a vulnerable mental and emotional condition."
The suspensions might be served simultaneously, according to the commission. the first officer had since resigned, according to the report, and had "completely cooperated in the inquiry and engaged in all necessary processes." The officer sought professional assistance in comprehending his conduct and apologized to the other officer.
According to media sources, McCullough retired from the Vancouver police department in 2018. Chan committed suicide in January 2019, after having a connection with another higher officer who was later dismissed from the Vancouver police department.
A request for comment from the Vancouver police department was not returned in time for publication on Wednesday. “I do not dispute the (OPCC's) conclusion, it is a matter of record,” McCullough stated via text message, disputing some of the prior media reports about what transpired, but he did not offer specifics.
“I was a proud member of the VPD and am still serving in the military for our country."

Federal Initiative Offers Funding for Skills Training and Hiring
“Ottawa is encouraging employers to submit proposals for funding around skills training and hiring. The move is part of an additional $72 million over three years as part of the Sectoral Initiatives Program. ‘Canadian workers and employers are facing new and evolving challenges, brought on and exacerbated by the pandemic.
