How Many States

The how many states poll I answered and reblogged reminded me of my 2022 summer trip and other car ride stories.

My introduction to long car/van/passenger vehicle rides was the three-and-a-half to four hour trips we used to make from my home to my cousins' home in NY State. We'd go three to four times a year, sometimes for as short a stay as Friday through Sunday. In the summer we'd stay longer, but rarely a full week. In retrospect I see this was likely due to the adults limited tolerance for one another.

When I was 12 my family drove from MA to Orlando, FL. We stayed overnight in Atlantic City, NJ, after spending the day at the Bronx Zoo. The next day I think we spent the night somewhere in Georgia after crossing the Chesapeake Bay Bridge-Tunnel (idk why my mom chose to do that, she hated every moment of that stretch of road, but it is very cool). In Orlando we went to Disney and Epcot and the now-closed River Country (which I until-today thought was named after the Fort Wilderness campground which apparently used to contain the water park before it closed). On the way home we stopped in DC to see the cherry blossoms - and not much else. We were all very tired of not having our normal routines by then and I think my parents rushed the trip home out of exasperation.

We never took a longer car trip as a family after that :P

This past summer my partner R___ and I took the Amtrak from MA to WA. We had a sleeper cabin which was an awesome way to travel. I wouldn't have wanted to travel that far by seat alone, but having the option to stretch out, and lay down was delightful. I enjoyed the older model, single-level train of the first leg (lakeshore limited) better than the more modern, two-level train we took from Chicago onward - the LL cabin had a row of windows for each sleeping bunk, and a toilet tucked right into the cabin for middle-of-the-night peeing. The Empire Builder (train line from Chicago to Seattle) was clearly a newer train but from the upper bunk your only view was the inside of the cabin.

Because there was a layover of a few hours between the arrival in Chicago of the LL and the departure of the EB, and since my oldest friend C______ lives in Chicago, we decided to stay overnight one night and resume the journey the next day, which was an excellent decision in so many ways. From the logistics perspective, it meant that we never spent more than two nights in a row on the train, which was a bonus. Additionally it meant we had time to enjoy the Field Museum, a lovely dinner at the Duck Inn, and C and I stayed up late, late into the night talking about life, growing up, being grown up, and playing crokinole (my first time).

The highlight of the train journey was the happy accident that R and I took dinner in the dining car for exactly the right seating, completely unbeknownst to us. As we were enjoying our complementary freshly prepared meal and complimentary cocktail, the train arrived at the station for Glacier National Park, then proceeded to climb into the Rocky Mountains as the sun began to set. We were treated to the golden glow of the last hour of daylight illuminating fresh dustings of snow on pine-clad ridges and valleys climbing up the slopes as we ascended into the mountains (my first time approaching the mountains by land)

On the way home, we were driving a Penske moving truck. Our goals were to 100% Rt. 90, visit Bear Lodge (colonizer name: Devil's Tower), visit Deadwood, and (suggested by a friend) visit Wall Drug store. We left on a Friday evening, planning to drive about 4 hours before stopping. We had until the following Friday to return the truck at our end destination - plenty of time, we thought. We had previously driven a rental car from the end of Rt 90 in Seattle towards Mt Tahoma (colonizer name: Rainier), which saved us some headache in the moving truck, avoiding downtown traffic and a detour since our initial departure point was on the Olympic Peninsula. We picked up Rt 90 just before the exit we'd previously used to visit the mountain, and we were making good time, but then we had to stop.

R's guts had decided to rebel (I think this is about when they coined the phrase "the bowelrog has awoken") and we spent the next three nights in the hospital in Nowhere Lake, WA. I may rant another time about the emotional journey which was being in this area, but for now I'll just say that we escaped that place with mostly pleasant memories on Independence day. We were now almost three days behind schedule, but determined to make up the time on the road.

We decided immediately that we had to skip Bear Lodge and Deadwood to meet our timeline. We also agreed that skipping those reinforced our dedication to earning the Rt. 90 100% complete badge. Unfortunately, this meant Wall Drug was still on the table - we stayed just long enough for me to eliminate a bowelrog of my own and for R to get low-key stressed out about the WAY TOO MANY FUCKING PEOPLE milling around before we jumped back on the road.

After leaving WA we stopped in Sheridan Wyoming. On Tuesday we only drove about 500 miles, stopping somewhat early in preparation for The Push. We had decided to push for 1000 miles on Wednesday, starting early and staying up late, but pushing on all the way to our home time zone, close enough to get the rest of the way home in one shorter drive on Thursday. We drove from Mitchell South Dakota to [incomprehensible] Ohio.

Did you know that in OH Routes 80 and 90 merge, as 90 dives south to get around the Great Lakes? Did you know that OH traffic signs on 80 have been allowed to deteriorate to such a degree that the characters on them don't really reflect light in a useful way? Did you know that since Rt. 80 is the 'primary' route at that point, that to stay on 90 you need to take an exit ramp?

I didn't know any of that until I was approximately 50 miles past the turn off. We spent another tenish miles deciding whether we should just follow GPS to the hotel we were aiming for, or whether we were going to turn around, drive 50 miles the wrong direction, and take 90 through Cleveland as we had originally planned. Ultimately, "I never want to come back to Ohio, and especially not just to complete a hundred miles of 90 I'll never have another reason to return to" won out. We turned around, head 50-60 miles back down 80, passed the exit for 90 and turned around again, then switched drivers and drove on through Cleveland and another stretch of highway until we reached Madison. (Incomprehensible earlier because I literally had no idea where we were by then. I had to look up my hotel reservation history to confirm that detail. I'm impressed that we made it that far - I had a memory that maybe we'd stopped slightly before we intended to because of the gods damned tireds.

From Madison to Buffalo to Syracuse to Albany and on to home we managed another 500 miles, which was still exhausting because we had not enough rest or sleep or relaxation this week, but we did it. Two amazing friends drove approximately 2 hours each way just to meet us at the storage unit where we unloaded the truck, which we managed to do that same night. Then we slept, and then we returned the truck on time and full of gas! (except for one minor hiccup where I had to go fill the tank after the guy had started my paperwork and technically got back after noon but he didn't ding us for it!)

New Florida Laws in 2023

Florida’s legislature has enacted a number of new laws for 2023. Notable among the new laws is the prohibition of allowing third party contractors to sue insurance companies on behalf of the insured (a practice known as “assignment of benefits”) and toll relief for motorists who frequently travel toll roads.

TOLL CREDITS: Last December, lawmakers approved a measure (SB 6-A) that provides 50 percent credits to motorists who record 35 or more toll-road trips in a month. The program will last for a year, and includes a $500 million grant to toll agencies to cover lost revenue.

RESTRICTIONS ON LOBBYING: New laws (HB 7001 and HB 7003) will carry out a constitutional amendment that voters passed in 2018 to expand from two to six years the time that certain officials will have to wait to start lobbying after leaving government positions. The restrictions will apply to lawmakers, state agency heads, judges and many local officials.

DISASTER RELIEF: Responding to the devastating 2021 collapse of the Champlain Towers South building in Surfside, lawmakers approved property tax rebates when residential properties are rendered uninhabitable for 30 days. During the December special session, lawmakers passed a measure (SB 4-A) to offer similar rebates to property owners who sustained damage in Hurricane Ian and Hurricane Nicole. Property owners will be able to apply to county property appraisers between Jan. 1 and April 1.

PUBLIC NOTICES: HB 7049 allows local governments to publish legal notices on county websites instead of in newspapers. Local governments in counties with fewer than 160,000 residents must first hold public hearings to determine if residents have sufficient access to the internet.

WORKERS' COMPENSATION RATES: The Florida Department of Insurance Regulation approved an overall 8.4 percent decrease in workers’ compensation insurance premiums for 2023. This change took effect in January, marking the seventh consecutive year that average rates have decreased.

PROPERTY INSURANCE: During the December 2022, the Florida legislature enacted a law that ended the controversial practice known as assignment of benefits for property insurance. The practice involves homeowners signing over claims to contractors, who then pursue payments from insurers. The prohibition on assignment of benefits (SB 2-A) applies to policies issued on or after Jan. 1.

APPELLATE COURTS: Florida’s appellate courts were revamped Jan. 1 under a law (HB 7027) that created a 6th District Court of Appeal and revised the jurisdictions of the 1st District Court of Appeal, the 2nd District Court of Appeal and the 5th District Court of Appeal.

SCHOOL LIBRARY BOOK SELECTIONS: As part of a broader education bill (HB 1467), lawmakers required that a training program be available as of Jan. 1 for school librarians, media specialists and others involved in the selection of school library materials. The program is aimed, in part, at providing access to “age-appropriate materials and library resources.”

MIYA'S LAW: Lawmakers passed a measure (SB 898) that will require apartment landlords to conduct background checks on all employees. The bill, dubbed “Miya’s Law,” was prompted by the death of 19-year-old Miya Marcano, a Valencia College student who went missing from her Orlando apartment in September and later found dead. The suspected killer, who later committed suicide, worked as a maintenance worker at Marcano’s apartment complex.

summary: your best friend since childhood friends goes up to bat for you after you get into an unfair predicament. (srry if there are crammed imperfections)

warnings: cursing, gore, angst, violation of the body.

further warning: blood, whipping, crying, past rape experience, trauma, suffering, abuse.

“all i’m saying (Y/N), is that if you hadn’t gone out and LEFT ME, IT WOULDN’T HAVE HAPPENED”

“oh yeah BLAME ME AGAIN, HOW CAN YOU BE UPSET THAT I NEEDED A BREAK FROM YOUR CONSTANT BITCHING” You yell out. This was the fourth argument you’ve gotten into with your husband, Mitch.

And that’s just counting today. Things have been heated between you ever since a disagreement led you to staying with a friend for a week.

“(Y/N), you need to calm down” Jason sighs and walks into the kitchen.

“did you not just hear your best friend yell at me?” You ask in disbelief. “HE CHEATED ON ME” You fuss again. “but i’m the one who overreacted??” You glare at him.

Jason gives you a stoic look and you scoff. Mitch thought you’d be an idiot and forgive and forget it all.

But once he realized that you wouldn’t and actually wanted to leave him, he became more aggressive towards you. Telling you that you’re making stupid decisions, saying it’s your fault.

And worst of all, he’s had his friends and family over more lately so that it would be harder for you to talk to him about the topic.

Well fuck that. You didn’t care who the hell heard the two of you this time. You were going to put an end to this. Your phone rang and your dug around in your bag to retrieve it.

You picked it up and it was Johnathan. Mitch started rambling on about something and suddenly there was a glass shatter by your head. You jumped at the sound and angrily looked at him.

“who the fuck are you throwing shit at, i can do that too” You pick up a case and aim it directly at his head, he ducks though and the heavy china smashes against the wall.

Nothing but glass shattering sounds throughout the house with the yelling. Cursing, screaming, grunting.

This all continued until you threw one small vase. The last glass object on the shelf. And you regretted throwing it as soon as it left your reach.

The glass shattered with its thin shell turning into confetti the moment it touched the floor. A cloud of what people would think is dust arose and your heart dropped.

“what the fuck??” Mitch’s voice broke a bit and he carefully knelt onto the glass covered floor.

“Mitch… i didn’t mean to..” You put a hand over your mouth. You just threw his mother ashes right in front of him out of anger.

“jesus, what is going on in here???!!” Orlando rushed in with Jason this time. “what did you do (Y/N)?” Both of you are crying, but their pity was always for Mitch. You can’t be mad at them this time though.

“i really didn’t mean to.. it was an accident Mitch” You try to explain. You notice his two best friends faces change once they realized the gravity of the situation.

“fuck man, i’m sorry” Jason stoops down with Mitch. Mitch wipes his face and quickly leaves the dining room.

“leave.” Jason commands.

“what? this is my hou-“

“we don’t give a shit, get out before we make you. door’s open.”

Your heart wrenches in your chest and Jason tries backing you into a wall. You shove him away and he knocks you onto the ground with a forceful push.

You groan as some of your skin is ripped open by glass. “fuck!” You take deep breaths as tears stream down your face. Why. Why is this happening to you?

You could hear things being knocked over upstairs while the two men towered over you. You throw glass in their faces when they got too close and received multiple kicked to your body and face.

Your breathed became labored as you tasted blood. Mitch came out with a bat in hand and revenge in his eyes. He approached you and looked down at you in disgust.

“you know, i never really loved you… but you were a great fuck, so i managed.” He pulls your head back by your hair and you wince. A trickle of blood pooled into your waterlines as you tried to blink away the pain.

“you’re ungrateful, disrespectful, and infertile? you thought it cared for you, huh?” He teased. You lip quivered and your vision was blurring.

“Mitch please… please..” Your voice cracked and you stumbled over your words a bit at you tried to calm him down.

“well? why don’t you guys see why i stayed with her all this time? her ass is just perfect” You instantly scream for help and begin trying to get up.

Everything was stinging, it even hurt to breathe. You received a kick in the mouth again, feeling your lip get cut against your chin.

A screaming sob erupts from your mouth and you get rolled onto your stomach. You would rather die right mnow than continue this.

Your sweater was cut off and your leggings were ripped open. You try to get up and scream again before seeing Mitch swing his bat, that was the last thing you saw.

You couldn’t open your eyes, only hear your surroundings. There was yelling, beeping from the fire alarms, and what sounded like… chains?

“look into my eyes” A deep rumbling voice spoke up. More screaming was heard after that.

“jesus, you’re gonna be alright (Y/N)

Your whole body was aching when you sat up. You felt a slight itchy sensation under bandages from the small cuts and bruising.

But the worst of the pain came from your head. It was throbbing like crazy. You use the little strength you have left to sit yourself up. Your body felt 3x as heavy as before.

“fuck… i have to pee” Only when you sit up do you look at your surroundings. You’re at.. Johnathan’s house?

You stiffly get up and take your time walking to his bathroom. You finish up and walk towards his kitchen to find any snack to cure your hunger.

There wasn’t a damn thing. You didn’t know what to expect from a man who constantly eats out.

You hear the front door open and a loud rustling approaching you. Johnny doesn’t see you sitting at the table as he walks by. His eyes were focused on the bag.

You wait until everything was sat onto the counter to say something. “hi” He jumps and frowns as he turns.

“damnit, (Y/N).” He shakes his head and puts a hand on his chest. You chuckle. “what are you doing up?” He asks.

“bathroom” You answer. “what’s all that?” You look behind him.

“i’m going to try to make your favorite” He grins.

“ (F/F), really?!” You light up. You moved a bit too much though and felt another head pin. You groan and he shuffled through a bag.

“here” You look up to find a pill bottle. “for the pain” You thank him and take one of the pills.

“johnny what happened yesterday… i only remember bits of it”

“well, i called and you accidentally answered the phone, i heard everything that was happening and drove there straight away… when i got there, you were all beat up and..” You notice his jaw flex as he leans onto the counter.

“Mitch and his friends are all in the hospital.” He finished.

“what? why?” You ask, genuinely confused. You didn’t remember hurting anybody, and Johnny had just got there.

“that’s still a mystery” He shrugs. What about the fire you saw then…

“okay…” You head back to the couch and sit down, just when the show was getting good again, the fire alarm went off.

You turn and see even more smoke in fogging up the hall between his room and the kitchen.

You open up a few windows and try to open the bathroom door, it didn’t have a lock on it, but there was weight keeping you from pushing it open.

“Johnny?!? what’s going on, let me in” You say. You huff at the silence and wait a moment before coming up with a plan.

“i’m going to go the extinguisher from outside” You walk away and open and close the front door as if you left.

That’s when a literal skeleton on fire ruched out of the bathroom. Your heart dropped and your breath got caught in your throat.

A loud gasp erupted from your lips and that caught its attention. The skeleton peeped around the corner and you booked it out of the door.

“(Y/N)! wait!“ the deep voice rumbled. You hiss as your skin stings from reopening wounds. Once you hit the bottom step, you started making your way to the side of the apartment building.

“(Y/N)! it’s me, Johnathan” He raises his voice. You don’t speak up, but you stop screaming and continue to cry.

“… i can explain everything inside “ He reaches out for you but you flinch and back away. He was visibly hurt but you could care less.

He nods and you are just taken aback. He gets up and goes to check on your food once more. “so you made a deal with the devil… and now you turn into this every night” You ask.

“… right” You stare at him. This was something so surreal. A real life skeleton on fire, cooking you dinner.

“no, wait! you would’ve been this.. thing, when you came to the house then… and i could’ve sworn i heard “look into my eyes” with fire nearby” You state.

“oh… well, you caught me” He hums. That voice, it’s something else.

“what was that about?” You ask.

“why don’t we save the rest of the questions for dinner” He looks at you. You wanted to look away, he was so intimidating.

“…” You slowly turn back to the TV. He finished the food and it tasted great. “you did really good” You say, shocked a bit.

“you seem so surprised” He says.

“well, you’re no ramsey..”

“wow” He shakes his head and you laugh.

He answered every question to asked about his situation and apologized for the scare. You understood why he hid it at the end of the day.

The two of you talked you into bed while he stood on the side. “was it worth it?” You ask and he looks at you. You could tell you caught him off guard.

He was about to answer was suddenly you saw flames and the old street you used to live on. Your sister was in a fight with a girl way bigger than her.

“M-Michele!” You picked up a rock and tried to hit the girl with it but it was no use. Your sister put up a good fight but ultimately got beat.

Blood trickled across her forehead as she laid there. You cried and cried and yelled for help but no one came.

You helped her walk home with both of you crying, he out of pain and you out of fear. The front door was locked so you had to get through your windows.

Once you got in, your dad was right in your room waiting for you.

“what the fuck happened??” He asks, quickly grabbing your sister, body almost limp.

“a-a big girl got her” You try to explain.

“why didn’t you do anything???” He yells.

“i did” You sob.

“JANUARY!” He calls for your mother as he takes your sister out of the room. You got on the floor and cried like a baby. You felt so guilty for not doing enough.

You didn’t know when you fell asleep, but you did. Your bedroom door was loudly slammed shut and it made you jump up.

“you know your sister almost died because of you, (Y/N)?” Your dad lowly spoke. You eyes started water again, you knew a beating was coming.

“daddy..” Your voice breaks into a high pitch cry.

“ take it off.” He firmly orders.

“it wasn’t my fault!” You try to say.

“WHAT did i say?”

You sniffle and sob as you take your t-shirt off. You wipe your tears as if they weren’t a never ending stream.

“th-thirteen” You choke out.

“.., you’re growing up on me” You look up at him and he was staring at your chest. You put your arm over yourself and wiped at your tears again.

“turn around and get over the bed” He says. You do as he says, knowing there’s no escape. Your body was tensing as you prepared for your lashings and they sure did come. You counted 7 before you could t count anymore.

His leather belt left unforgivable marks on your back and waist. He stopped and usually he’d just leave after.

Instead, he began to tug down your jeans. “daddy, what are you doing?” You begin to cry more. Was he now going to hit your legs. Just imagining the pain made you cry into your comforter.

“think of it as a reward, for growing up” He pushed your head into the covers and suddenly, you saw black.

Johnny’s guest room slowly faded into view. Things were very blurry though. “(Y/N), sweet jesus, please tell me you can see?” He placed a hand on your shoulder.

“Johnny, it wasn’t my fault… i didn’t mean to make him mad like that” Your lip quivers. The neck of your shirt was soaked from tears that you didn’t even know were falling.

Your words became inaudible as you tried to reason with him.

“i know (Y/N), come here” He offers, you put your head into his leather jacket and absolutely bawl into his chest.

“what that what happened to mitch” Your words were barely coming out, and the more you opened you mouth, the saltier things tasted from the tears.

“yes..” He answers.

“that shouldn’t happen to anybody” You breakdown.

Johnny stayed with you the whole time, he promised you that he’d be there when you woke up. And with that reassurance, your trembling and crying died down.

More minor incidents cause embarrassment for Sakura, Hana and Reiko, before the school is totally affected. Soon, everyone and everything is immobilised. Activated by freak accident, GoldyMarg starts moving, escaping the Metal Locker Room. Mamoru sensing the Zonder causes him to abandon Sunou to fish, the lonely kid sees him go. It's on a path to the Bay Tower Base, the brothers act quickly to neutralise the payload dropped on the city. The girls aboard are detected, forcing them to send GaiGar Duel Equip in to rescue them. Pizza gloats to himself that no matter what Gai does the planet is doomed, which trigger a memory of him saying this once before, on a world with 3 suns, but tries to dismiss it. GoldyMarg refuses to listen to Hyuma and sit still until needed, busting out of the Bay Tower Base, becoming GoldyTank to get out the water, he starts shooting before being told of the girls, then triggers a missile by driving over it. GaiGar tears open the roof and the girls ejector seat out.

GoldyMarg brings down the plane as GaoGaiGar forms, so they have to Dividing Driver a safe crash site, but GoldyMarg is seemingly lost in the battlefield creation, then the Broken Magnum is destroyed, preventing use of Hell and Heaven, but fortunately GoldyMarg survived, enabling Hammer Hell and Heaven to defeat the Zonder.

Number.23 is Mic 13

NASA, like the Space Development Corporation, is a pinnacle of space development, the two entities working together on a project at the New Nevada base. The Solitary Wave Risers, 1st through 13th, all equipped with GS-Rides, the test is a success, and the head scientist, Dr. Liger, is glad of the chance to return to Japan, and see Leo and Gai.

It has been raining for a week, Mamoru going for a meeting, as the Amphibious Armoured Maintenance Vehicle has a rondezvous with the US submarine Orlando, where a unit using the CR system will be transferred to them as payment for the offering of GS-Ride technology. The two dock and Liger rocket skateboards on, Liger greets his nephew Gai, before the old brothers start arguing, Leo Lariat facing Liger Uppercut. A sudden storm mid transfer causes the CR unit to be lost at see.

Mamoru and Ushi face off in RC robot combat at an event, Mamoru's GaoGaiGar inspired unit winning.

At the Big Order Room, the rellteam returned having recovered the case, however brothers find the case unlocked, the CR Unit vanished.

Sunou has created the Hyper Sunou SRX to face Mamoru, however everyone is swiftly distracted by the giant robot that appears outside the event.

GGG are searching for the CR unit, which only had it's AI installed 7 weeks ago, but it still has the mentality of a child. Fortunately, the intelligence division picks up the trail. As storms brew, Penchinon is sure this Zonder will be unstoppable.

The robot picks up Mamoru, introducing himself as Mic Sounders 2000, or Mic, but after introductions Mamoru senses a Zonder, and Mic scares the kids with his stomping.

GGG realises a Zonder is behind the storm, as the brothers start rescue work and Volfogg tries to save Mamoru but is intercepted by Penchinon, the stadium starts collapsing, the brothers hold the roof but Mic stops the kids running due to the external dangers, preparing to save them. He summons the UFO esque Baribarien, docking with is and telling the kids to get aboard.

GaoGaiGar flies into the storm but is buffeted, when another GS-Ride approaching is detected, as Mic, identified by Liger as the missing CR, flies past before dropping the kids off. Learning GaoGaiGar is Mamoru's friend, and refusing to do nothing, Mic flies at the storm, but is sent flying. Everyone else is occupied, so they launch GoldyMarg with the Dividing Driver to get to GaoGaiGar, which enables them to drive the storms away and reveal EI-22, and once the Goldion Hammer is activated it can do nothing but be defeated. Volfogg chases Penchinon but he escapes. Mic is retrieved, everyone wondering if he can even be of use, as Liger thinks about his hidden power even Mic knows nothing about.

Number.24 is Protection Disabled.

Mic is being formally introduced to the team, while the Shishioh brothers argue, Liger mentioning NASA has the capacity to mass-produce the Pliers, and each of the Brave Robots explains to Mic their abilities. Mic starts to feel worthless, but Gai says there are robots with important jobs like Piggy, whom Mic develops a crush on. At this point, Mic is asked to take Mamoru home, Mamoru starts worrying if his friends will still like him if they learnt of his powers.

Pasdar discusses with the Four Heavenly Kings, while they need a new Zonder Metal Plant soon, he is convinced to prioritise eliminating the Legacy of Cain.

Mic secretly hacks the archives, downloading data on the Zonders this far, and sneaks away, Volfogg, hidden, wonders what he plans. Liger breaks into the Baribarien, taking a floppy containing GGG records of 2005, and now just needs a Zonder Metal sample.

Mamoru goes out, Ai discusses with Isamu how she fears him leaving one day. Pizza flies by. Yoseph pulls Hana along and barks at her classmate, Kaidou Ikumi, he is quiet, but she drags him to join the rest at the parade. Elsewhere, Gai, Swan and Mikoto are also watching, and concerned when Mic involves himself. Pizza arrives, and launches a Viking ship into the crowd towards Mamoru, before Gai can do anything a strange blue robot with an electric guitar blasts it away before flying off, Kaidou looks towards Pizza, who finds himself inexplicably intimidated, as though the boy psychicly attacked him. Mamoru and Gai both come to conclusions about the strange robot, while Liger can't see how the Protection was bypassed, as Volfogg, some distance away, also confirmed the ID.

(CNN)A 14-year-old boy died after he fell Thursday night from a drop tower amusement ride that recently opened at the Orlando area's ICON Park entertainment complex, authorities said.

Tyre Sampson, 14, of St. Louis, Missouri, fell from the Orlando FreeFall ride, described by its operators as the world's tallest freestanding drop tower, the Orange County Sheriff's Office said. In video circulating on social media that purportedly shows the incident, a person falls from their seat about five seconds into the ride's drop down the tower, as the vehicle decelerates before it reaches the ground. Deputies were called to ICON Park around 11 p.m. Sampson was taken to a hospital, where he died from his injuries, the sheriff's office said. Details about what led to the fall were not immediately released. A Seaman Or Not: Malpractice And Unsettled Law

The Massachusetts Supreme Judicial Court reversed the dismissal of a legal malpractice action

This legal malpractice action requires an understanding of the requirements for expert testimony under Fishman v. Brooks, 396 Mass. 643 (1986), and the duty of an attorney to properly advise a client when the law governing the client's case is unsettled.

Norris Marston (Norris) suffered a severe brain injury after an accident at his work site, an offshore light tower. His attorneys secured a $7,500 lump sum settlement under the Massachusetts Workers' Compensation Act (Act), and then pursued Federal remedies, including a claim under the Jones Act, 46 U.S.C. § 30104 (2012), ultimately negotiating a $200,000 settlement. The plaintiff, Norris's conservator, believing these settlements were woefully inadequate in light of Norris's injuries, sued the defendant attorneys for malpractice. On the eve of trial, a judge of the Superior Court issued a number of rulings that led to the dismissal of all of Norris's claims against the attorneys. This appeal followed.

On August 24, 2008, as Norris was cutting sections of a steel docking station attached to the light tower, the docking station came loose, striking him on the head and driving him deep into the water, where he remained for a significant period of time. Norris was diagnosed with an anoxic brain injury.

A resident of Gloucester, Norris retained local attorneys Joseph M. Orlando and Brian S. McCormick, of the firm of Orlando & Associates (collectively, attorneys). The attorneys planned to seek damages exceeding $1,000,000 against [subcontractor] Hallum and other parties under the Jones Act and related Federal statutes (collectively, Federal claims) in the United States District Court. They decided to first pursue Norris's remedies under the Act in proceedings before the DIA.

The key issue for compensation purposes was whether Norris was a "seaman."

the generous remedies provided under the Jones Act are limited to seamen.

During the proceedings, Hallum and the two third-party Federal court defendants raised the specter of the possible preclusion of the Jones Act claims due to the actions and positions taken at the DIA. Attorney McCormick addressed this defense in his mediation memorandum.

A one-day mediation session was held on October 17, 2011. Attorney Orlando advised Norris that if he did not take the final offer, he would lose at trial. Accordingly, Norris accepted $200,000 plus Farm Family's waiver of its $18,666.52 workers' compensation lien�� in full settlement of his claims against all the Federal court defendants (Federal settlement). Within days, Norris retained new counsel. A petition for the appointment of a conservator on behalf of Norris was filed in the Probate and Family Court, and Norris's brother, Jonathan Marston, was appointed. The conservator sought to intervene and reopen the Federal case on behalf of Norris. His efforts were unsuccessful.

Then came the malpractice claim, which the trial court dismissed

The absence of an expert opinion on fair settlement value was not fatal to the conservator's legal malpractice case. Fishman teaches that while expert testimony on reasonable settlement value is admissible in this type of action, it is not required to establish the cause and extent of the client's damages...

The trial judge concluded that while the lump sum agreement was a final adjudication of Norris's claim under the Act, it did not finally adjudicate the issue of Norris's status as a nonmaritime employee for purposes of future Jones Act claims. The conservator, with support from his expert witness, maintains that the agreement to accept a lump sum settlement in the DIA proceeding resulted in a "final adjudication" that potentially precluded Norris's subsequent Jones Act claims. Cf. Martin v. Ring, 401 Mass. 59, 60 (1987). We conclude that, in the context of this case, it was error to reach the question whether the workers' compensation settlement had preclusive effect on the Jones Act claim. In fact, this was an issue that was not settled at the time of these proceedings. And it is the unsettled state of the law that is pertinent in assessing any negligence on the part of the attorneys.

Thus

Given the unsettled state of the law, the attorneys had the duty to fully disclose the potential consequences to Norris before recommending that he accept the Massachusetts settlement. See Williams v. Ely, 423 Mass. 467, 476-477 (1996). Contrary to the trial judge's assertion, the preclusive bar had been raised in the Federal proceedings. The attorneys' failure to alert Norris to the uncertainty deprived him of the opportunity to assess the risk and was an actionable basis of negligence.
