In China, investigations and purges become the new normal

HONG KONG--It’s been another busy month for China’s anti-corruption authorities.
There was the head of Interpol, who was unceremoniously seized during a trip to Beijing. There was the state bank executive who was caught hiding tons--literally--of ill-gotten cash in his moldy basement.
There was the disgraced general who was purged by the Communist Party as punishment even after he had hanged himself.
Arrests, disappearances, investigations, posthumous humiliations: The stream of eye-catching headlines coming out of Beijing in October is a reminder that President Xi Jinping’s hallmark anti-corruption drive is showing few signs of letting up in its sixth year.
Chasing suspected fraudsters, influence peddlers and others remains popular with the public. But Xi’s campaign also shows other tumult within the upper ranks of China’s leadership, business world and security apparatus.
Leaders are grappling with internal upheavals at a time when Beijing is juggling mounting challenges, from trade frictions with Washington to economic stress at home.
Despite rounds of purges in recent years, “one serious problem that Xi Jinping faces is that the administration is still actually poorly run,” said Willy Lam, who studies Chinese politics at Hong Kong University. “They should have their house in order by now, but they don’t. That could affect China’s ability to carry out policy or fight the trade war with the U.S.”
The numbers are staggering. Since Xi started the push in 2012, authorities have investigated more than 2.7 million officials and punished more than 1.5 million people. They include seven national-level leaders and two dozen high-ranking generals. Prosecutors have tried about 58,000 officials and sentenced two to death.
Among the latest officials to face prosecution is Lai Xiaomin, the former head of state-owned bank Huarong Asset Management and a onetime central bank official.
Lai was expelled from the party last week after he was found in “serious violation” of party law and regulations. According to the financial website Caixin, Lai took bribes, flouted government financial policy--and hid three metric tons of tainted cash worth nearly $40 million in his house.
As a former regulator charged with helping large Chinese companies deal with their debt, Lai was instead found to be running Huarong in a “blind and disorderly way,” Chinese authorities said.
Since 2015, when a devastating stock market crash sparked outrage among the middle class, Communist Party leaders have viewed the financial markets as an Achilles’ heel for its grip on power, observers say.
Lai’s downfall represents more than just another corruption case.
It points to how Chinese leaders are increasingly using their disciplinary apparatus to enforce government policy, said Wu Qiang, an independent political analyst in Beijing.
That’s an evolution from five years ago, when Xi was clearing out rival factions in the Politburo and sensitive institutions, such as the military, Wu said.
“At the moment, the financial industry is the focus of the anti-corruption campaign,” Wu said.
To be sure, Xi’s work to cement his grip on the police and military, the two instruments of hard power, also appears unfinished.
Meng Hongwei, a deputy minister of public security and the head of Interpol, was detained this month by anti-corruption officials during a visit to Beijing. His disappearance occurred amid speculation of internal infighting.
And two top officers in the People’s Liberation Army, including former chief of joint staff Fang Fenghui, were expelled from the party last week.
Fang was found guilty of accepting bribes and political disloyalty. The other general, Zhang Yang, was stripped of his rank and Communist Party membership, said a statement, which added that he tried to “escape punishment by committing suicide” last November.
More than 300 officers were swept up as part of the investigation into the two generals, the South China Morning Post reported, citing sources close to the military.
This year, Xi expanded the leadership’s reach by forming a National Supervisory Commission with sweeping powers to investigate not only Communist Party members but also state-owned companies, hospitals, schools and even sports teams.
“Once you establish and empower agencies to investigate, they will inevitably find more and more people to lock up,” said Zhang Ming, a retired professor of political science at Renmin University in Beijing. “Eventually, it hurts the party’s prestige and the public confidence in it.”
For its part, the Communist Party has signaled that it’s just fine with the cycle of purges and investigations becoming the new normal of Chinese governance.
Since the campaign kicked into gear, the state broadcaster has released a documentary about a never-ending corruption fight titled “Always on the Road” and a slick TV drama that got huge ratings.
Typically tight-lipped government authorities have been happy to drip-feed details of greed and fecklessness to the media, rallying the public around the anti-corruption campaign.
They’ve disclosed the number of bill-counting machines it took to count one rogue energy official’s cash pile (16, four of which broke down) and the logistics required to confiscate all the gold, antiques and cash belonging to a crooked former army commander (10 military trucks). It’s not uncommon to see reports surface about the tonnage of a particular fallen official’s cash hoard.
Jude Blanchette, a China expert at the Crumpton Group, said the never-ending corruption crusade is a distraction for Xi, but it also serves to keep the Communist Party--and vast swaths of Chinese society--in a permanent state of tension and under his sway.
“The campaign has been a remarkably effective tool to help him consolidate and hold power,” Blanchette said. “It’s flexible enough to allow him to essentially go after anyone, with Damocles’ sword hanging over almost everyone. Why would he ever willingly give that up?”

‘Show gardens live only to be seen for a short amount of time, and if it isn’t seen… did it exist?’ asks Sarah Tulloch, an emerging designer who was due to showcase her student landscape at the Melbourne International Flower and Garden Show this week. Her design was titled ‘Alpine Calm’, where moulded snow gums gave way to a carpet of small plants and native grasses in an urban courtyard. It would look like springtime in the Victorian alps after snow had thawed.
As Sarah says, ‘different creativity has different end points,’ so for a lot of the installation gardens, this year’s MIFGS was the flashpoint of their existence, the entirety of their lifespan.
If all had gone according to plan, today would have been the second day of the Melbourne International Flower and Garden show. So instead, we bring a little bit of it to you.

The Digger’s Club
The Digger’s Club is Australia’s largest garden club, encouraging people around the country to get active in their private landscapes. They specialise in preserving heirloom vegetables, flower seeds and fruit trees, with a mission to help gardeners grow beautiful and productive gardens that suit the Australian climate.
When the news came through that MIFGS would not be going ahead this year, the Digger’s Club staged a mini installation of their design at their HQ, and sent the photos onto us! Other than the infamous ‘Pumpkin Pile’ they hold every year, we asked Ornamental Category Manager, Jac Semmler (see our feature on her home garden here!), what else they had in store.
Talk us through the installation you had planned…
The installation is a small glimpse into what we do in our gardens at Heronswood and St Erth every day. This year’s display greeted gardeners with a burgeoning display of hardy summer perennials, showcasing the combination of form, texture and cooling colour that brings calm and solace to the garden during our harsh Australian summers. This year’s bountiful mini plot of seasonal vegetables demonstrates how easy it is for anyone to grow delicious fresh food, even in a small space! At the centre was an education hub, which hosts informative talks to inspire both emerging and established green thumbs to get growing.

TDF friend Phillip Withers started his company in 2012 and has been making serious waves in the local landscape design scene ever since! His team of designers, architects and horticulturalists are passionate about creating a sensory connection with the natural landscape through rich, productive native plant-life. Having created award-winning gardens at previous Melbourne International Flower and Garden shows, this year, the team had designed a garden inspired by the rugged coastline of Point Addis, which Phillip himself talked us through.
Talk us through the installation you had planned…
‘It’s Our Time’ was to be presented in association with Yarra Valley Water, and the planning, research and design took over a year! As more than half of Victoria’s vegetation has been cleared since European settlement, and we face the reality of climate change, we feel it’s our time to celebrate the importance of locality, encourage biodiversity, promote water conservation and the ecological role it plays in maintaining the quality of our soil, water and air.
The landscape starts with a bluestone lookout, which looks out over a native environment full of remnant plant life. A mix of grassland swales drift through the lower plains to the shrub that rolls up the sand dunes. The topography changes to reflect the sand dunes and rammed earth cliff structures protrude from the ground plain to emulate our amazing coastal environment. A bluestone boardwalk floats takes you down from the lookout, across the natural plains and towards the beach.

Flowers Vassette is no stranger to the Melbourne International Flower and Garden Show. We asked Sonya Wilson, the creative genius behind this year’s arrangement, what she and lifestyle multi-hyphenate Chyka Keebaugh cooked up!
Talk us through the installation you had planned…
We had a slightly different idea in mind (around a Mad Hatter’s celebration!) when we started. But with the bushfires at the beginning of the year, we wanted to do something that represented the country’s resilience instead. Oversized red, orange and yellow dahlias would be displayed in brown and green metallic vessels down the centre of a long communal table, with florals cascading to the floor at each end. Four 3-metre tall eucalyptus branches with a blackened finish hang over the place-settings.
At its core, the design was to celebrate the resilience of Australians and the regeneration of life in the natural world, and just to be grateful for what we have. As it turns out, we need to continue keep doing that!

Rolling Stone Landscapes
Over the years, Dean Herald of Rolling Stone Landscapes and his construction team have built a reputation for their work in the prestige residential market, by designing resort-style gardens and taking the concept of outdoor living and entertaining to an new level. His influence in pool designs and architectural pavilions offers a refreshing balance between the hard and soft elements of the modern outdoor space.
Dean plans to show his garden next year, so has kept the centrepiece as a surprise!
Tell us what you had planned…
The inspiration for the show garden was to challenge the expectation of garden art or a sculpture piece set within an outdoor space. Art is subjective and comes in so many elements, so for this design I selected a timeless piece (which to many would be considered art!) to challenge what a feature piece can be. A gallery-style structure would house the feature, supported by stone blades and large glass walls for a seamless connection with the garden beyond. The design would also provide individual dining spaces and separate lounges, all positioned to gain a direct connection with the visual piece. A water element surrounds the gallery to provide movement and sound while planting layout will provide foliage contrast in colour, texture and shape.

ACRE
Acre is Fitzroy-based landscape design studio whose environments are designed to evolve across time and seasons, with a focus on stylised wildness. The TDF team love their projects so much we visited their office two years ago and, naturally, we wanted to hear exactly what they had in store for this year’s Melbourne Flower and Garden show. In collaboration with Form Landscaping, the pair had planned Hardscape, Landscape, Softscape, a unique design of conceptual and rugged exploration of how outdoor spaces can be experienced. We quizzed creative director, Brett Robinson, on his plans.
Tell us what you had planned…
Through a process of inversion and strong emphasis on contrasting materials, Hardscape, Landscape, Softscape upends the fundamental notions of landscaping. Monolithic and immutable, the gridded Technifirma paving gives a sculptural rhythm to the overall form; one that is enhanced by a top layer of trees and plants, which typically serve as the foundation. The stark contrast between the firm, fixed materials and soft, pliable greenery draws attention to the interplay of natural and constructed elements. Playful, exaggerated and out-of-scale, the composition is anchored by the exposed grid to effect a garden that feels raw yet refined.

SEC Brings Charges in Edgar Hacking Case
The Securities and Exchange Commission today announced charges against nine defendants for participating in a previously disclosed scheme to hack into the SEC’s EDGAR system and extract nonpublic information to use for illegal trading. The SEC charged a Ukrainian hacker, six individual traders in California, Ukraine, and Russia, and two entities. The hacker and some of the traders were also involved in a similar scheme to hack into newswire services and trade on information that had not yet been released to the public. The SEC charged the hacker and other traders for that conduct in 2015 (see here, here and here).
The SEC’s complaint alleges that after hacking the newswire services, Ukrainian hacker Oleksandr Ieremenko turned his attention to EDGAR and, using deceptive hacking techniques, gained access in 2016. Ieremenko extracted EDGAR files containing nonpublic earnings results. The information was passed to individuals who used it to trade in the narrow window between when the files were extracted from SEC systems and when the companies released the information to the public. In total, the traders traded before at least 157 earnings releases from May to October 2016 and generated at least $4.1 million in illegal profits.
“International computer hacking schemes like the one we charged today pose an ever-present risk to organizations that possess valuable information,” said Enforcement Division Co-Director Stephanie Avakian. “Today’s action shows the SEC’s commitment and ability to unravel these schemes and identify the perpetrators even when they operate from outside our borders.”
“The trader defendants charged today are alleged to have taken multiple steps to conceal their fraud, including using an offshore entity and nominee accounts to place trades,” said Enforcement Division Co-Director Steven Peikin. “Our staff’s sophisticated analysis of the defendants’ trading exposed the common element behind their success, providing overwhelming evidence that each of them traded based on information hacked from EDGAR.”
The SEC’s complaint alleges that Ieremenko circumvented EDGAR controls that require user authentication and then navigated within the EDGAR system. Ieremenko obtained nonpublic “test files,” which issuers can elect to submit in advance of making their official filings to help make sure EDGAR will process the filings as intended. Issuers sometimes elected to include nonpublic information in test filings, such as actual quarterly earnings results not yet released to the public. Ieremenko extracted nonpublic test files from SEC servers, and then passed the information to different groups of traders.
The SEC’s complaint alleges that the following traders received and traded on the basis of the hacked EDGAR information:
• Sungjin Cho, Los Angeles, California • David Kwon, Los Angeles, California • Igor Sabodakha, Ukraine • Victoria Vorochek, Ukraine • Ivan Olefir, Ukraine • Andrey Sarafanov, Russia • Capyield Systems, Ltd. (owned by Olefir) • Spirit Trade Ltd.
In a parallel action, the U.S. Attorney’s Office for the District of New Jersey today announced related criminal charges.
The SEC’s complaint charges each of the defendants with violating the federal securities antifraud laws and related SEC antifraud rules and seeks a final judgment ordering the defendants to pay penalties, return their ill-gotten gains with prejudgment interest, and enjoining them from committing future violations of the antifraud laws. The SEC also named and is seeking relief from four relief defendants who profited from the scheme when defendants used the relief defendants’ brokerage accounts to place illicit trades.
The SEC’s investigation, which is ongoing, was conducted by Market Abuse Unit and Cyber Unit staff David Bennett, Arsen Ablaev, Michael Baker, Jason Burt, Laura D’Allaird, Adam Gottlieb, James Scoggins, David Snyder, Jonathan Warner, Darren Boerner, and John Rymas, and IT Forensics staff Ken Zavos, Douglas Bond, Stephen Haupt, Gi Nguyen, and Jennifer Ross. The Division of Economic and Risk Analysis and the Office of Information Technology provided substantial assistance. The investigation was supervised by Robert Cohen, Joseph Sansone, and Carolyn Welshhans. Cheryl Crumpton and Stephan Schlegelmilch are leading the SEC’s litigation.
