Supreme court verdict on validity of Aadhaar Card

Supreme court has been given the final verdict on validity of Aadhar Card.A five-judge constitution bench headed by Chief Justice Dipak Misra held that while Aadhaar would remain mandatory for filing of IT returns and allotment of Permanent Account Number (PAN), it would not be mandatory to link Aadhaar to bank accounts and the telecom service providers cannot seek its linking for mobile connections. it would not be mandatory for school admissions, as also for the examinations conducted by the Central Board of Secondary Examination (CBSE), National Eligibility cum Entrance Test (NEET) for medical entrance and the University Grants Commission (UGC).

Justice Chandrachud says Speaker was wrong in classifying Aadhaar Bill as a Money Bill as it denuded the federal structure of law making by limiting the role of Rajya Sabha in Aadhaar Bill. Justice Chandrachud in his minority dissent view says Aadhaar Bill could not be treated as Money Bill as it had so many provisions which had nothing to do with the characters of a Money Bill. Aadhaar card is mandatory for PAN linking, says Supreme Court.n Supreme Court upholds passing of Aadhaar Bill as Money Bill by Lok Sabha. Aadhaar not to be made mandatory for opening of bank account and for getting mobile connection, says SC. There was no illegality in Aadhaar law passed by Parliament as money bill, says SC.

Justice Ashok Bhushan reads his separate judgment but clarifies that he broadly agrees with majority verdict by CJI Dipak Misra, Justices A K Sikri and A M Khanwilkar. This means Justice Chandrachud is the lone dissent as SC upholds Aadhaar validity by 4:1.Justice Ashok Bhushan goes with majority verdict on Aadhaar. It's 4:1 verdict in favour of Aadhaar. Justice Chandrachud accepts every argument raised by petitioners challenging validity of Aadhaar and runs a judicial razor mercilessly through Aadhaar Act virtually declaring it unconstitutional in toto. It is very difficult to live in contemporary India without Aadhaar as all schemes have been linked with Aadhaar, Justice Chandrachud says while declaring Aadhaar scheme unconstitutional. Justice Chandrachud says Aadhaar violates privacy rights as it could possibly lead to profiling of persons and voters.There is a risk of surveillance of people on the basis of data collected under Aadhaar scheme and the data could be misused, says Justice Chandrachud. Aadhaar scheme does not provide robust mechanism to get consent of citizens before collecting their demographic and biometric data, says Justice D Y Chandrachud .Justice Chandrachud says Aadhaar has serious problems about exclusion and right to benefits cannot be made to depend on authentication of Aadhaar.Aadhaar Law is unconstitutional on the very ground that it was passed as Money Bill, says Justice Chandrachud. Aadhaar Act cannot be treated as Money Bill. Passing a bill as Money Bill which is not a money bill is a fraud on constitution, says Justice Chandrachud.

Rahul Gandhi said on twitter :- I am thanked the Supreme Court for its verdict on the Aadhaar Act on Wednesday, saying it was an instrument of empowerment for his party, but a "tool of oppression and surveillance" for the BJP.  "For Congress, Aadhaar was an instrument of empowerment and For the BJP, Aadhaar is a tool of oppression and surveillance.  Thank you Supreme Court for supporting the Congress vision and protecting India,"

सुप्रीम कोर्ट ने बैंक खातों को आधार से लिंक कराने की डेडलाइन बढ़ाई, पढ़ें क्‍या है नई तारीख

सुप्रीम कोर्ट में पांच जजों की संविधान पीठ ने आधार को विभिन्न सरकारी योजनाओं और कल्याणकारी योजनाओं से अनिवार्य रूप से जोड़ने के केंद्र के फैसले पर अंतरिम रोक लगाने की मांग वाली याचिकाओं पर फैसला सुनाया है. पांच जजों की पीठ ने बैंक खातों और मोबाइल नंबर को लिंक कराने की डेडलाइन को बढ़ाकर 31 मार्च तक कर दिया है. कोर्ट ने सभ��� योजनाओं के लिए डेडलाइन बढ़ा दी है. बैंक खातों को आधार से लिंक कराने की डेडलाइन को 31 मार्च तक बढ़ा दी है लेकिन नए बैंक खातों के लिए आधार देना होगा और आधार ना हो तो एनरोलमेंट देना होगा. सुप्रीम कोर्ट ने यह अंतरिम आदेश दिया है और आधार की वैधता पर 17 जनवरी से सुनवाई करेगा. गुरुवार को चीफ जस्टिस दीपक मिश्रा, जस्टिस ए के सीकरी, जस्टिस ए एम खानविलकर, जस्टिस डीवाई चंद्रचूड और जस्टिस अशोक भूषण के संविधान पीठ ने अटॉर्नी जनरल के के वेणुगोपाल और याचिकाकर्ताओं की ओर से पेश वकीलों की दलीलें सुनने के बाद फैसला सुरक्षित रख लिया था. सुनवाई के दौरान अटॉर्नी जनरल ने कोर्ट को बताया कि बैंक खातों समेत सभी योजनाओं के लिए सरकार ने डेडलाइन को 31 मार्च करने का फैसला लिया है लेकिन नए बैंक खाते के लिए आधार जरूरी है. मोबाइल नंबर से आधार लिंक करने की डेडलाइन कोर्ट के आदेश से ही 6 फरवरी, 2018 है जिसे कोर्ट आदेश जारी कर बढ़ा सकता है. वहीं याचिकाकर्ताओं की ओर से पेश श्याम दीवान ने कहा कि सुप्रीम कोर्ट ने आदेश दिए थे कि आधार को अनिवार्य नहीं बनाया जाएगा और ये पीडीएस, एलपीजी, मनरेगा, पेंशन आदि 6 योजनाओं में लागू किया जाएगा लेकिन सरकार ने कोर्ट के आदेश के बावजूद 139 योजनाओं में इसे अनिवार्य कर दिया. Adhaarcard Update: ऑनलाइन ही अपडेट करिए अपने आधार कार्ड डिटेल नाम, मोबाइल नंबर और ईमेल

Adhaarcard Update: आधार कार्ड  धीरे-धीरे सभी महत्वपूर्ण जगह अनिवार्य हो गया है। अब तो इनकम टैक्स रिटर्न फाइल करने के लिए पैन कार्ड को आधार कार्ड नंबर से लिंक करना ज़रूरी हो गया है। लेकिन कई बार देखने को मिला है कि इंसानी गलती के कारण आधार कार्ड में त्रुटि हो जाती है। कई बार नाम गलत होता है तो कई बार कार्ड पर आपके जन्म की तारीख कुछ और लिखी होती है। ऐसे में आप आधार कार्ड में सुधार करना चाहेंगे। कई बार आपका मोबाइल नंबर, घर का पता और ईमेल एड्रेस भी बदल जाता है। इस स्थिति में भी आप पर आधार कार्ड अपडेट करने का दबाव होगा। अच्छी बात यह है कि यूआईडीएआई की वेबसाइट पर ही आधार कार्ड अपडेट करने की सुविधा है।

आधार की वेबसाइट पर इन जानकारी को अपडेट करने के लिए तीन किस्म की सुविधा का ज़िक्र है। आप चाहें तो आधार कार्ड को ऑनलाइन अपडेट कर सकते हैं। आधार कार्ड को पोस्ट और इनरोल सेंटर पर जाकर भी अपडेट कराया जा सकता है। ऑनलाइन आधार अपडेट के लिए बनाई गई वेबसाइट को आधार सेल्फ सर्विस अपडेट पोर्टल के नाम से जाना जाता है। आपकी सुविधा के लिए हम आपको आधार कार्ड की जानकारी को ऑनलाइन अपडेट के बारे में बताएंगे।

साफ कर दें कि आधार कार्ड को ऑनलाइन अपडेट करने के लिए आपके पास वो मोबाइल नंबर होना ज़रूरी है जिसे अपने आधार नंबर के साथ रजिस्टर किया था। क्योंकि अपडेट की प्रक्रिया के दौरान मोबाइल नंबर पर ओटीपी भेजा जाएगा। अगर आपके पास वो मोबाइल नंबर नहीं है तो आधार इनरोलमेंट सेंटर जाकर उसे अपडेट करवा लें। इसके बाद ही आप ऑनलाइन अपने आधार कार्ड को अपडेट कर सकेंगे। साफ कर दें कि भारतीय नागिरक अपने नाम, पता, जेंडर (लिंग), जन्म तारीख, मोबाइल नंबर और ईमेल एड्रेस को ही ऑनलाइन अपडेट कर सकते हैं। किसी अन्य बदलाव के लिए आपको आधार इनरोलमेंट/ अपडेट सेंटर जाना होगा।

1. सबसे पहले सेल्फ सर्विस अपडेट पोर्टल पर जाएं। 2. यहां अपना आधार नंबर लिखें। 3. इसके बाद आपको रजिस्टर किए हुए मोबाइल नंबर पर वन टाइम पासवर्ड मिलेगा। 4. इसके बाद ओटीपी डालकर अपडेट पोर्टल पर जाएं।

आधार डेटा अपडेट रिक्वेस्ट

1. इसके बाद आप उस विकल्प को चुनें जिसे अपडेट/सुधारना चाहते हैं। 2. अच्छी बात यह है कि आप सारे विकल्प को अपडेट कर सकेंगे। उम्मीद है कि ऐसी परिस्थिति नहीं आएगी। 3. विकल्प चुनने के बाद आधार अपडेट फॉर्म आपके सामने आ जाएगा। यहां पर आप अपनी ज़रूरत के हिसाब से जानकारी में बदलाव कर दें। यहां पर नाम और पते की जानकारी अंग्रेजी के साथ हिंदी में भी अपडेट होगी। 4.आपने जो नई जानकारी दी है, उसकी दोबारा जांच कर लें। क्योंकि आप एक बार फिर इस वेबसाइट पर नहीं लौटना चाहेंगे। जांच पूरी हो जाने के बाद सब्मिट अपडेट रिक्वेस्ट पर क्लिक कर दें।

आधार अपडेट डॉक्यूमेंट अपलोड

1. अब आपने जिस बदलाव के लिए आवेदन दिया है। उससे संबंधित कागज़ात भी देने होंगे। बता दें कि ईमेल आईडी, मोबाइल नंबर और जेंडर (लिंग) में बदलाव करने के लिए किसी कागज़ात की ज़रूरत नहीं पड़ेगी। लेकिन नाम, जन्म तिथि और पते में बदलाव के लिए आपको इससे संबंधित डॉक्यूमेंट देने होंगे। 2. नाम में बदलाव के लिए आपको प्रूफ ऑफ आइडेंटिटी (पहचान पत्र) देनी होगी। पहचान पत्र के लिए ये डॉक्यूमेंट मान्य हैं- पासपोर्ट, पैन कार्ड, राशन/ पीडीएस फोटो कार्ड, वोटर आईडी और ड्राइविंग लाइसेंस। बता दें कि इसकी सूची और लंबी है। सारे मान्य कागज़ात के बारे में यहां क्लिक करके जानें। 3. जन्मतिथि बदलने के लिए आपको जन्म प्रमाणपत्र, सेकेंडरी बोर्ड पासिंग सर्टिफिकेट या पासपोर्ट की एक फोटो कॉपी देनी होगी। 4. पते में बदलाव के लिए प्रूफ ऑफ एड्रेस देना पड़ेगा। ये डॉक्यूमेंट मान्य हैं- पासपोर्ट, बैंक स्टेटमेंट, बैंक पासबुक, पोस्ट ऑफिस अकाउंट पासबुक, राशन कार्ड और वोटर कार्ड। इसकी सूची भी बेहद ही लंबी है। इसके बारे में यहां क्लिक करके जानें। 5. डॉक्यूमेंट अपलोड करते वक्त दो-तीन बातों का ध्यान रखें। आपको प्रूफ में दिए जाने वाले डॉक्यूमेंट की सेल्फ अटेस्टेड फोटो कॉपी अपलोड करनी होगी। और एक ही डॉक्यूमेंट का इस्तेमाल दो बदलाव के लिए नहीं करें। इसके लिए अलग-अलग डॉक्यूमेंट देना ज़्यादा सही होगा।

बीपीओ सर्विस प्रोवाइडर सेलेक्ट करें

1. ज़रूरी कागज़ात अपलोड करने के बाद बीपीओ सर्विस प्रोवाइडर में से उचित विकल्प को चुनें। 2. अब रिक्वेस्ट सब्मिट कर दें 3. इसके बाद आपको अपडेट रिक्वेस्ट नंबर मिलेगा। इसे संभाल कर कहीं लिख लें। आप चाहें तो अपडेट रिक्वेस्ट की एकनॉलेजमेंट कॉपी को डाउनलोड या प्रिंट कर सकते हैं।

बता दें कि यूआईडीएआई की वेबसाइट पर साफ लिखा है कि आधार डेटा में अपडेट के लिए आवेदन देने मात्र से जानकारी अपडेट नहीं होगी। आपके द्वारा दी गई नई जानकारी को वैरिफाई करने के बाद ही इसे अपडेट किया जाएगा।

उम्मीद है कि अब आसानी से अपने आधार कार्ड को ऑनलाइन अपडेट कर पाएंगे।

Shocker: Hackers already accessed Adhaar database and selling it for a few hundred rupees It was only last November that the UIDAI asserted that “Aadhaar data is fully safe and secure and there has been no data leak or breach at UIDAI.” On January 3, The Tribune, a national english daily “purchased” a service being offered by anonymous sellers over WhatsApp that provided unrestricted access to details for any of the more than 1 billion Aadhaar numbers created in India thus far. It took just Rs 500, paid through Paytm, and 10 minutes in which an “agent” of the group running the racket created a “gateway” for this correspondent and gave a login ID and password. Lo and behold, you could enter any Aadhaar number in the portal, and instantly get all particulars that an individual may have submitted to the UIDAI (Unique Identification Authority of India), including name, address, postal code (PIN), photo, phone number and email. What is more, the team paid another Rs 300, for which the agent provided “software” that could facilitate the printing of the Aadhaar card after entering the Aadhaar number of any individual.
