Former Candidate David Herrera Threatens to "Light Up" East Brunswick Mayor and Council
Herrera will appear in Middlesex County Superior Court on June 9, 2023.
EAST BRUNSWICK, NJ - On February 15, 2023, the residents of Cosgrove Court in East Brunswick were alarmed by the sudden appearance of numerous law enforcement vehicles that closed off the street as police conducted a search at the home of David Herrera, 32. The East Brunswick Police Department was responding to a report from the Federal Bureau of Investigation (FBI) that Herrera had threatened to "light up" Mayor Brad Cohen and the East Brunswick Township Council, an explicit threat to sitting members of elected local government. "Light up" is US Army slang that initially referred to artillery attacks at night when illuminating rounds were fired to expose the target before destroying it with high explosives.
Herrera had been fired on January 31, 2023 from his position as manager of El Toro Loco in South Plainfield. In a communication with TAPinto, restaurant owners said, "As Mr. Herrera is currently the host of a weekly political Podcast program titled "ReviveAmerica" where he expresses several controversial/radical views, El Toro Loco would like to completely disassociate with Herrera." In past political presentations and on his Facebook profile, Herrera represented himself as the owner of the South Plainfield eatery. In fact, he was the manager.
While still at work, Herrera made the threat against the mayor and council to a co-worker, intimating that the "election had been stolen from him," according to an official police report. Herrera was referring to his second loss in a local election for Town Council. He had run as a Republican candidate in 2022 and 2021, losing both times by a fair margin after running acrimonious campaigns characterized by personal attacks on his opponents. Herrera lost by a margin of nearly 1,700 votes. In 2022, he shared the ballot with Neal Shah who is now running for New Jersey State Senator against incumbent Democrat Patrick Diegnan.
Deeming the threat reported by the co-worker as credible, as it included many specific details about the election run, members of the East Brunswick Detective Bureau went to Herrera's Cosgrove Street address initially to speak with him. The threat also included valid information about Herrera's gun ownership, indicating an ability to act on the threat. While on the porch of Herrera's home, detectives spotted two 25-round high-capacity rifle magazines capable of holding ammunition for an AK-47 on a table on the porch. In New Jersey, these magazines are not legal to own.
Herrera shares the home with his mother Denise Medford, who lost a bid for East Brunswick Board of Education in 2021.
As no one was home at the address, the EBPD confiscated the magazines from the porch. After receiving a warrant from a Superior Court judge, the EBPD and officers from the Middlesex County Prosecutor's Office performed a search at Herrera's home. The search resulted in the confiscation of 15 additional magazines containing 25 rounds each from the home, says the official arrest report. In New Jersey, magazine capacity is limited to ten rounds.
Later on February 15, David Herrera was arrested by the East Brunswick Police Department and charged with the Possession of 17 large-capacity ammunition magazines in violation of New Jersey 2C:39-3J Prohibited Weapons/Devices - Large Capacity Ammunition. He was processed and released on his own recognizance according to information received by TAPinto East Brunswick from Lt. Jason Fama, Records
Herrera had a "Pre-Indictment Conference" with Middlesex County Superior Court Judge Sheree V. Pitchford on April 17.
He is currently scheduled for Post-Indictment Arraignment on June 9 before Judge Pitchford.

On this day: April 9th, 1865 Lee surrenders at Appomattox Court House ending the American Civil War...
April 1865 saw the fall of the Confederate capital city, Richmond and the Jefferson Davis administration was on the run as fugitives, vowing to fight on. Meanwhile, commander of the Confederate Army of Northern Virginia Robert E. Lee and his ragtag army were in a fighting retreat through central Virginia being pursued by the Union Army under the command of Ulysses S Grant.
Lee’s determination were in the early days of April ultimately broken by the combination of exhaustion, dwindling supplies and food, continual desertion rates and the capture of prisoners. Realizing his army was virtually surrounded and being wasted through attrition. A strategy the Confederacy could ill afford ever since the war’s start. General Grant had been the first land based general in the Union who seemed to realize this overall strategy and had this implemented in a number of his campaigns, including capturing Vicksburg, Mississippi in July 1863 and the Georgia Campaign undertaken by his subordinate, William Tecumseh Sherman in late 1864. Each of these campaigns not only inflicted casualties on the Confederacy, they bled them of their man power on multiple fronts, it more importantly placed a stranglehold on supply lines and total destruction of their military infrastructure, reducing their capacity to even make war.
Finally, Grant’s continual and repeated attacks in Virginia with attacks toward Richmond and later the drawn out Petersburg Campaign which saw the use of trench warfare, later popularized in World War I drained Lee of men, despite Lee’s many tactical victories and high Union casualties, the industrial capacity of the Union, better supplies, superior numbers of men and Grant’s tenacity, unlike his predecessors proved too much by April 9th, 1865.
Suffering from a migraine headache on the 8th and into the 9th, Grant received the long awaited letter from General Lee, he would be willing to meet to discuss the terms of surrender. Grant would recall in later memoirs that his migraine lifted upon receipt of this news. The chosen site of surrender was at the house of one Wilmer McLean in a township called Appomattox Court House. McLean had been a wholesale grocer whose home near Manassas Junction had been the site of the Battle of the First Bull Run four years earlier in summer of 1861, the first major land battle of the war. His home had been used as Confederate headquarters during that battle and had seen Union artillery fire upon it and land a cannonball in the kitchen fireplace. McLean had moved away from Manassas after that battle to the relative safety of Appomattox, now in a twist of fate, his home was being commandeered again, this time to end the war.
Grant replied to Lee to meet later that same day. Lee arrived first, supposedly in a somber-subdued mood, maintaining his famously reserved but genteel personality. He was described as being impeccably dressed for the occasion in his gray uniform and polished saber at his side. Lee awaited Grant’s arrival and by all accounts Grant showed up shoddy appearances in comparison. His uniform was covered in mud as were his boots, well worn and tattered was his coat with only the shoulder straps indicative of his rank and no sidearm as a weapon.
Grant and Lee had met briefly during the Mexican-American War nearly two decades before but had not seen each other since. They briefly exchanged their recollections of that meeting, after which Grant found it hard to discuss the terms of surrender, it was Lee who reminded him of the reason for their meeting. Lee asked what terms could he and his army expect. Grant said the officers and men would all be pardoned and the officers allowed to return home with their arms and horses so that they could plow their farm fields, the only condition asked of them was to never again take up arms in opposition to the United States. Additionally, Grant allowed food rations from the Union army to be siphoned off to their now former opponents. Lee was accepting of the terms and remarked that these would be good first steps toward healing the nation’s many wounds. At 4pm having concluded the terms of surrender, Lee and Grant left the McLean family parlor. The announcement of the surrender stirred an emotional throng of cheers from Grant’s officers and other men to which Grant immediately silenced them stating “The Confederates were now our countrymen, and we did not want to exult over their downfall.” Together, Lee and Grant reviewed the Confederate army and then received other officers on their respective staffs on the front porch of the McLean household including James Longstreet and George Pickett, some of Lee’s main subordinates and corps commanders. Longstreet had been good friends in the years prior to the Civil War with Grant, supposedly having been part of Grant’s wedding party though this is unconfirmed. Pickett had lead the failed very much romanticized charge of Confederate troops under Longstreet on the third day of the Battle of Gettysburg in 1863. Meanwhile, Union officer George Armstrong Custer of later fame in the fatal Battle of the Little Bighorn against Lakota and Cheyenne tribesmen in 1876 took along with other officers souvenirs including furniture from the McLean home as commemorations of the surrender.
Lee was supposedly saluted by Grant and his men as he departed first back to his army. Lee gave a farewell address to his men the following day April 10th. Meanwhile, on the 12th, the men of the Army of Virginia marched out for the last time, this time with the Union army lining the roads on their way out as they were to be mustered out and returned to their homes. Though there is much debate, there is a persistent rumor that the Union troops providing the honor guard also saluted the Confederates as they marched out.
After fours years, the American Civil War, the bloodiest in American history was effectively over, though in the coming five days, President Abraham Lincoln would be assassinated by John Wilkes Booth, famed actor and Confederate sympathizer at Ford’s Theater in Washington DC and their would be continued pockets of resistance and small scale skirmishes in the coming months, the war itself was essentially ended by the very gracious meeting between Lee and Grant at Appomattox on the 9th of April, 1865. Paving the way for the nation to bind its wounds, contemplate on how to enact Reconstruction and to deal with a society that had just ended centuries of chattel slavery on its shores and now had to deal with the social, economic and political ramifications of that achievement...

Howard Levitt writes: “Workplace rumours run amok can create a toxic environment for employees. For employers who mishandle them — or worse, propagate them — the consequences can be severe, too. … According to the ruling in a lawsuit filed by [Melanie] McGraw, the [Dundalk Fire D]epartment’s chief administrative officer, David Milliner, believed that she was affecting morale and conducted a so-called investigation. But he did so without even contacting, let alone interviewing, McGraw herself. For that matter, she was left unaware that her dismissal was even being contemplated.”
“Ontario Superior Court Justice Roger Chown, relying on the Supreme Court of Canada‘s decision in Matthews v Ocean, … found that an employer’s failure to allow an employee to respond to allegations of misconduct, even when fired without cause, can be a factor in determining whether ‘moral damages’ should be awarded. … ‘The defendants acted on unfounded, sexist allegations relating to conduct from years prior, without properly ascertaining the truth and without even asking her about the allegations. Mr. Milliner conducted an amateurish investigation. He conflated gossip with facts. Without justification, he accepted the allegations and assumed the worst of the fire department’s only two paid staff. He failed to recognize the patent gender-based discrimination directed (at Ms. McGraw),’ the judge wrote. On top of six months salary for wrongful dismissal (a modest amount given her position and income), she was awarded an additional $75,000 for moral damages, $35,000 more for gender-based discrimination and an additional $20,000 for defamation for the comments made by Milliner to city council.”

Judge weaponized NJ State Police, Middlesex County Sheriff’s, & Prosecutor’s Office, Ocean County Prosecutor's, & Court
“Judge Alberto Rivas Is A Serious Danger To The Public” Marchisotto said.
Jackson, New Jersey (June 01, 2021) – Judge Alberto Rivas, Middlesex County, is a serious public safety concern, and immediate safety hazard / risk to the public that needs to be properly addressed by federal law enforcement (FBI), and department of homeland security (DHS).
A judge that can weaponize the New Jersey State Police, Middlesex County Sheriff’s Office, Middlesex County Prosecutor’s Office, Ocean County Prosecutor’s Office, and the Superior Court of New Jersey, to interfere with to disturb a federally regulated activity; U.S. District Court of New Jersey federal lawsuit personally filed against him; MARCHISOTTO v. On January 3, 2020, Judge Alberto Rivas, also weaponized, and used Middlesex County Prosecutor’s Office Detective Paul Kelley, to file false threat complaints to the Jackson Township Police, and Monmouth County Psychiatric Emergency Response Team, who quickly realized there was no threat, and the complaint they received required no action.
“In all my years working in law enforcement I have never seen anyone, especially a judge abuse their office, and position in that manner to weaponize law enforcement. This is disturbing because something is very bad, and off here that needs someone to promptly, and properly investigate this on the federal level, because I believe there is other bad stuff that will also be uncovered that has nothing to do with me” Marchisotto said.
“There is something very off here, and what kind of connection does NJSP Detective Mudduser Malik have to Judge Alberto Rivas, or possibly the judge’s son who works in laws enforcement for the South Brunswick Police Department” Marchisotto said.
Then you have a newly promoted NJ State Police Captain Ronald Micucci who works for Central Intelligence, and there is a very serious, and major breach of security for the safety of the people of the State of New Jersey, and elsewhere.
“This Captain easily allowed Judge Alberto Rivas to weaponize his office, and that is a serious breach of safety to the public” Marchisotto said.
“A judge who can falsely weaponize law enforcement for his own crimes is very disturbing, GOD only know what else this criminal has done. I am also very curious to know what he did for Mudduser Malik in return, who is the president of the NJ Officers Muslim Society” Marchisotto said.

Michigan is full of incredible fire departments, which leaves a lot of aspiring firefighters asking how to become a firefighter in Michigan.
The state of Michigan is one of great contrast with all the different natural landscapes, small communities and major cities. It is also one that has struggled in recent years with funding and support in areas of public service.
The people of Michigan need the best personnel in their fire, police and medical services for the best responses. So, how can you make sure that you are a part of the fire service in Michigan?
How to Become a Firefighter in Michigan
18 years old in most departments
Physically and mentally fit for the job
High school diploma or GED
Valid state driver’s license
Resident in the area
EMT training highly recommended
Most departments in Michigan don’t want too much from their applicants in the early stages. If you are the right age with proof of residency then you should move onto the screening process with no issues.
You can expect multiple firefighter interviews, criminal checks, drug testing and physical exams. Those that are deemed mentally and physically fit and that pass all the right exams have a chance at employment.
Below, I want to talk about what new recruits can expect in different areas of Michigan. I also want to talk about some of the fire academies and departments that you can find in the state.
Firefighting in Michigan
Michigan is dominated by the lake with which it shares its name and the rest Great Lakes network more broadly. Water is an important part of the landscape and economy with visitors drawn to the lake shores and the inland lakes.
But, these bodies of water pose many risks to life. Firefighters often have to carry out rescue missions to help those in difficulties on boats or struggling in the water. In the worst cases, dive teams by also have to retrieve bodies.
This is a tough line of work and it takes the right sort of person to handle it. Not only do you need the fitness and skill to work in the deep waters, especially in dark conditions, but you also need the mental strength to handle the fatalities. Regular training is a must here to prepare for everything that the water has to offer.
There is also a large number of forests and state parts in Michigan, with 78 state parks in total. This is where you need a whole other skill set to be a Michigan firefighter.
Firefighters here need to be able to handle the equipment necessary for wildfires and maybe even rope rescue on some of the highest points. Specially trained volunteer firefighters in these areas are just as important as all those in the cities that can get more of the glory.

There are different stages to the program. The first looks at some of the basics with the aim of preparing students for their Firefighter 1 and 2 certifications.
Then there is the Associate degree course in either fire administration or fire suppression. The choice may depend on your preference for elective courses across the two years. An alternative option here is to work towards a Bachelor of Science Degree over a 4-year program. Lake Superior State University offers one such course where you can graduate as a Fire Science Generalist.
The idea here is that students can build on their skills and knowledge year after year to help them understand the finer details of the job. There is all the essential knowledge on fire suppression, prevention and equipment.
But, there are also modules on planning for emergencies, dealing with different crews and investigating fires. This can prepare students for a role in management higher up in a Michigan fire department.

Detroit is the largest city in the state and actually one of the largest in the whole country in terms of its population. However, it is also a city which has had its fair share of problems in terms of its funding and the general economy.
The fire department here has a lot to deal with in regard to the number of residents, some of the old industrial buildings, the infrastructure and the new rise in tourism. That is why there are 46 stations dotted across the city for the best access to all of their districts.

The final area that I want to talk about here is a more rural area of Lake City and Township. This area is surrounded by natural resources that are vital for industry and tourism. This includes the lakes and rivers but also the forests and agricultural land.
This means a lot of different fire risks and the need for diverse skills in rescue and medical aid. The jurisdiction of this department is 38 square miles to cover all this land and the residences within. They have divisions in wildland fire management, urban interface fire suppression and also severe weather spotting. A career here is sure to be varied and highly rewarding. Job Prospects for Firefighters in Michigan
As of 2018, Michigan had 6,640 firefighters, which equated to 1:54 per 1000 jobs. The majority of these post could be found in the growing towns and cities.
The average annual wage for firefighters in Michigan is $45,440, which is about average for the country and the region.
The employment figures in neighboring Indiana and Ohio appear to be better but we have to remember that Ohio has the 4th highest rate in the country with 19,210 and 3.55 per 1000 jobs. The wage is comparable for the area as Indiana firefighters only made around $4000 more a year on average.

DNR divisions work cooperatively with partners to battle summer storm damage in the western U.P.
Successive storms cause significant damage at Porcupine Mountains, Emily Lake
There are numerous occasions when Michigan Department of Natural Resources divisions work together to perform a good number of tasks, but this cooperation is often unknown to the general public.
Recently, in the Upper Peninsula, an especially great deal of cooperation was in evidence between several DNR divisions, as well as outside entities, called to respond to the impacts of two vicious storm systems that struck the western part of the region over a 10-day period.
“Spectacular work was done by our DNR staff and outside crews who worked to put our parks back together after the damage caused by Mother Nature,” said Ron Olson, chief of the DNR Parks and Recreation Division. “We appreciated the patience of the public and the public valued the quick response to this emergency.”
On the night of July 11, 2016, a tremendous storm – some analysts would later say it was the worst in 1,000 years – moved east from the Saxon Harbor area of Iron County, Wisconsin toward Porcupine Mountains Wilderness State Park.
The storm dumped up to 11 inches of rain, in just four hours, causing flooding that washed out a campground and much of the marina at Saxon Harbor, damaging dozens of boats, sweeping camping vehicles into Oronto Creek, and turning Lake Superior into muddy, brown slurry.
Montreal (Wisconsin) Fire Department assistant chief Mitch Koski died responding to the emergency. His vehicle was washed into the harbor where he drowned.
Roadways were eaten away, flooded over and shut down. Trees toppled from along the riverbank and were washed, with boats and other debris, miles out into Lake Superior.
As the storm continued east, across the state line into Michigan, the rainfall eased, but the storm still packed plenty of punch.
The National Weather Service confirmed an EF1 tornado struck three miles south of Bessemer. Damage included a roof that was torn from an old ice rink and dumped into the rim of Sunday Lake.
Elsewhere in Gogebic County, flash flooding cut away more roadways and felled more trees. The swollen waters of Oman Creek rendered the DNR’s boating access site near the stream’s mouth a deserted island.
Heavy, concrete barriers (called beach prisms) set along the creek to trap sand were dragged into the stream by the raging floodwaters. In the days ahead, the U.S. Coast Guard would report a debris field slowly floating east in Lake Superior, presenting a potential hazard to boaters and swimmers.
Gov. Rick Snyder toured the area. He declared a state of disaster for Gogebic County July 15, making available all state resources to local efforts to repair damage. Snyder also activated the Michigan National Guard.
Not far to the east of Oman Creek, in the Presque Isle River area at Porcupine Mountains Wilderness State Park, flash flooding undercut the banks along a tiny rivulet, dropping numerous trees into a ravine.
The erosion would force permanent closure of one site on the Presque Isle Campground loop. A trail leading from the campground to Lake Superior was shut down temporarily until toppled trees and mud could be removed.
In 90 minutes, 6-8 inches of rain fell here.
Throughout the western section of Michigan’s largest state park, small creeks rose well beyond their banks, repeating dramatic scenes similar to those evidenced at the Presque Isle campground.
Backcountry trails and cabins were closed. Bridges were damaged or washed out. A cabin alongside Speaker’s Creek had to be moved after floodwaters carved off sections of the sandy streambank.
Park staff feared continued erosion would undermine the foundation of the cabin.
“We had three major maintenance crews, along with our interior crew, working on moving Speaker’s Cabin,” said Porcupine Mountains-Lake Gogebic state parks unit manager Jeff Gaertner. “
In response to the damage, which occurred during the height of the summer camping season, the DNR put an incident management team in place to organize cleanup in the aftermath of the crippling storm.
“There was DNR staff from six divisions involved in this,” said Doug Rich, western U.P. district supervisor for the DNR’s Parks and Recreation Division. “Everyone pitched in and did a fantastic job.”
Those DNR divisions responding to the incident included Parks and Recreation, Forest Resources, Law Enforcement, Executive, Marketing and Outreach and Finance and Operations.
The Ontonagon County Sheriff’s Office provided equipment and inmates from the state’s Ojibway Correctional Facility in Marenisco assisted crews.
DNR personnel from the Forest Resources Division set up an incident command center at the state park. Many of the staff involved in the response was working outside the center.
With chainsaws over their shoulders and hardhats on their heads, crews headed into the forest to begin the massive task of clearing trees, repairing boardwalks and reducing trail hazards.
“Because of the remoteness of trails at the park, crews had to be transported to some areas by boat,” said Don Mankee, district supervisor of the west U.P. for the DNR’s Forest Resources Division. “With the dense piles of intertwined fallen trees, crews averaged 100 feet of trail clearing in six hours.”
Prison crews of eight men and a supervisor helped DNR Forest Resource Division workers clear the trails. As a result, a great deal of progress was made. Backcountry cabins and campsites that had been closed were reopened two days ahead of schedule.
Ten days after the violent storm hit the west end of the park, a complex of thunderstorms slashed through the eastern half.
The National Weather Service office in Negaunee Township confirmed pockets of significant tree damage from Ontonagon east toward Baraga. The roof of a yurt was blown off at Union Bay.
Straight-line winds clocked at 90 mph were recorded at the Emily Lake State Forest Campground, situated south of Twin Lakes State Park in Houghton County.
Those strong winds pushed trees onto power lines, knocking out utility service for more than 20,000 customers, including several of the state parks in the western Upper Peninsula – Twin Lakes and the Porcupine Mountains included.
At Emily Lake, falling trees slashed through the shells of two travel campers at the park. Campers escaped miraculously, without injury. Four of the nine campsites were occupied during the heavy thunderstorms.
Because of the extensive number of fallen trees, DNR staff called in a professional sawyer crew from J.M. Longyear LLC of Marquette to clear safety hazards at the campground, including leaning trees and dangling overhead branches.
“After the loggers have gone through with their heavy equipment, almost all of the sites have at least some damage,” Rich Pirhonen, ranger at Twin Lakes State Park, said at the time. “Some need backhoe work, stumping, brush removal, grading and leveling et cetera.”
Along with the campground, loggers also cleaned up roughly 15 acres around the boating access site area and along Pike Lake Road.
“This type of cooperation is something DNR divisions are well-equipped to deliver,” said Bill O’Neill, chief of the DNR’s Forest Resources Division. “When something like this happens, we are able to pull together, along with local crews and representatives, to produce and effective response.”
In August, a similar cooperative effort was required of the DNR for damage from a violent thunderstorm in the northern Lower Peninsula. The areas hardest hit there included Keith J. Charters Traverse City State Park, VASA Pathway and state forest campgrounds and trails along M-72, from Grand Traverse to Crawford counties.
