Swati Maliwal Case: New Charge Added Against Bibhav Kumar
The Delhi Police has added the IPC section for "disappearing evidence and giving false information" against Chief Minister Arvind Kejriwal's aide Bibhav Kumar in AAP MP Swati Maliwal's assault case, an official said on Monday.
Kumar is accused of assaulting Maliwal at the chief minister's official residence on May 13.
The official said Section 201 (causing disappearance of evidence of offence, or giving false information to screen offender) of the Indian Penal Code (IPC) was added in the case.
Section 201 carries a provision for imprisonment of one-sixth of the punishment awarded for the biggest offence in the crime, he added.
The FIR against Kumar was registered on May 16 under provisions of the IPC such as those related to criminal intimidation, assault or criminal force on a woman with the intent to disrobe, and attempt to commit culpable homicide.
Maliwal, a former chief of the Delhi Commission for Women, alleged that Kumar attacked her with full force, slapped and kicked her when she had gone to meet Kejriwal.
According to a senior police officer, Kumar's mobile phone was found to have been formatted when he was arrested from Kejriwal's residence on May 18.
He was in Mumbai before returning to Delhi.
The police took Kumar to Mumbai twice. He is suspected to have formatted his mobile phone in Mumbai but did not disclose the place where he formatted it or the person with whom he shared the data, the officer said.
During his police custody, Kumar did not cooperate in the investigation, he added.
Another police officer said three CCTV DVRs (digital video recorders) were collected from Kejriwal's residence -- two from cameras installed at the entrance and one outside the drawing room.
The DVRs were sent to the forensic science laboratory as it was suspected that these were tampered with. The reports were awaited, he said.
Kumar was arrested on May 18 and is currently lodged in Tihar jail.

Swati Maliwal assault case: Arvind Kejriwal's aide Bibhav Kumar moves High Court against arrest
Chief Minister Arvind Kejriwal's close aide Bibhav Kumar on Wednesday moved the Delhi High Court challenging his arrest in connection with the alleged assault on AAP MP Swati Maliwal at the CM's residence earlier this month. As reported by PTI, in his petition, Bibhav Kumar sought a direction to declare his arrest as illegal and to acknowledge that it constitutes a serious violation of the provisions outlined in Section 41A of the Code of Criminal Procedure. He argues that his arrest runs counter to the mandates of the law. He also sought “appropriate compensation" for his “illegal"arrest and initiation of departmental action against the erring officials who were involved in the decision making of his arrest. On Monday, Kumar's bail plea was dismissed by a sessions court here, which said there appeared no “pre-meditation" by Maliwal in lodging the FIR and that her allegations could not be “swiped away", PTI reported.

Kejriwal’s bail hearing, Swati Maliwal breaks down in the court
On Monday, Aam Aadmi Party (AAP) MP Swati Maliwal during a hearing in Delhi's Tis Hazari court broke down vehemently when the defense counsel presented his statement in the bail hearing of Delhi chief minister Arvind Kejriwal's aide Bibhav Kumar. Both the Aam Aadmi Leaders were arrested for allegedly assaulting Maliwal.
Senior advocate N Hariharan the defence counsel of Kumar told the court that Swati Maliwal trespassed and entered CM Kejriwal’s house while she was having no appointment. He stated that during this time, Bibhav was not present inside the house.
“Can anyone enter in this manner…This is the official residence of the chief minister. She did not have an appointment for the meeting, nor did she send any message regarding her arrival. Kumar was not present at that time. She was stopped by the security personnel but proceeded to sit in the waiting room and asked the security to talk to Kumar,” the defense counsel said in his statement.
The defense counsel further said that there was “no grievous injury” on the AAP MP.
“Kindly look at the place where the alleged incident took place where many people were present…How can such an incident take place at this place (CM's residence)? There is no grievous injury on the vital part, so where is the question of culpable homicide not amounting to murder? The injuries can be self-inflicted,” he added.
As per the defense counsel, the allegations from Maliwal aren’t strong enough and “do not make out a case of intention to disrobe her”.

"The last few days have been very difficult for me,” says AAP MP Swati Maliwal
The Delhi police has filed an FIR against Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar in the assault case of Aam Aadmi Party MP Swati Maliwal. This action was taken after the police recorded Swati’s statement.
Swati Maliwal, talking about her experience in her first-ever public statement after the alleged assault on her on May 13 at CM Kejriwal's residence said "The last few days have been very difficult."
Swati Maliwal on Thursday, wrote on X, "What happened to me was very bad. I have given my statement to the police on the incident that happened to me. I hope that appropriate action will be taken." She also mentioned that the last few days have been very difficult for her. "The last few days have been very difficult for me. I thank those who prayed for me. Those who tried to do character assassination said that she was doing it on the instructions of the other party, may God keep them happy too. An important election is going on in the country, Swati Maliwal is not important, the issues of the country are important,” she added.
Aam Aadmi Party MP also wrote a note to the BJP asking them to not politicize the issue. "There is a special request to BJP people to not do politics on this incident," she wrote.
On Thursday, Delhi Police recorded Maliwal’s statement at her residence. The entire recording took around 2 hours during which the AAP MP gave a detailed explanation of the incident that took place at the CM’s residence.
