Epic Systems, a lethal health record monopolist

Epic Systems makes the dominant electronic health record (EHR) system in America; if you're a doctor, chances are you are required to use it, and for every hour a doctor spends with a patient, they have to spend two hours doing clinically useless bureaucratic data-entry on an Epic EHR.
How could a product so manifestly unfit for purpose be the absolute market leader? Simple: as Robert Kuttner describes in an excellent feature in The American Prospect, Epic may be a clinical disaster, but it's a profit-generating miracle:

At the core of Epic's value proposition is "upcoding," a form of billing fraud that is beloved of hospital administrators, including the "nonprofit" hospitals that generate vast fortunes that are somehow not characterized as profits. Here's a particularly egregious form of upcoding: back in 2020, the Poudre Valley Hospital in Ft Collins, CO locked all its doors except the ER entrance. Every patient entering the hospital, including those receiving absolutely routine care, was therefore processed as an "emergency."
In April 2020, Caitlin Wells Salerno – a pregnant biologist – drove to Poudre Valley with normal labor pains. She walked herself up to obstetrics, declining the offer of a wheelchair, stopping only to snap a cheeky selfie. Nevertheless, the hospital recorded her normal, uncomplicated birth as a Level 5 emergency – comparable to a major heart-attack – and whacked her with a $2755 bill for emergency care:

Upcoding has its origins in the Reagan revolution, when the market-worshipping cultists he'd put in charge of health care created the "Prospective Payment System," which paid a lump sum for care. The idea was to incentivize hospitals to provide efficient care, since they could keep the difference between whatever they spent getting you better and the set PPS amount that Medicare would reimburse them. Hospitals responded by inventing upcoding: a patient with controlled, long-term coronary disease who showed up with a broken leg would get coded for the coronary condition and the cast, and the hospital would pocket both lump sums:

The reason hospital administrators love Epic, and pay gigantic sums for systemwide software licenses, is directly connected to the two hours that doctors spent filling in Epic forms for every hour they spend treating patients. Epic collects all that extra information in order to identify potential sources of plausible upcodes, which allows hospitals to bill patients, insurers, and Medicare through the nose for routine care. Epic can automatically recode "diabetes with no complications" from a Hierarchical Condition Category code 19 (worth $894.40) as "diabetes with kidney failure," code 18 and 136, which gooses the reimbursement to $1273.60.
Epic snitches on doctors to their bosses, giving them a dashboard to track doctors' compliance with upcoding suggestions. One of Kuttner's doctor sources says her supervisor contacts her with questions like, "That appointment was a 2. Don’t you think it might be a 3?"
Robert Kuttner is the perfect journalist to unravel the Epic scam. As a journalist who wrote for The New England Journal of Medicine, he's got an insider's knowledge of the health industry, and plenty of sources among health professionals. As he tells it, Epic is a cultlike, insular company that employs 12.500 people in its hometown of Verona, WI.
The EHR industry's origins start with a GW Bush-era law called the HITECH Act, which was later folded into Obama's Recovery Act in 2009. Obama provided $27b to hospitals that installed EHR systems. These systems had to more than track patient outcomes – they also provided the data for pay-for-performance incentives. EHRs were already trying to do something very complicated – track health outcomes – but now they were also meant to underpin a cockamamie "incentives" program that was supposed to provide a carrot to the health industry so it would stop killing people and ripping off Medicare. EHRs devolved into obscenely complex spaghetti systems that doctors and nurses loathed on sight.
But there was one group that loved EHRs: hospital administrators and the private companies offering Medicare Advantage plans (which also benefited from upcoding patients in order to soak Uncle Sucker):

The purpose of a system is what it does. Epic's industry-dominating EHR is great at price-gouging, but it sucks as a clinical tool – it takes 18 keystrokes just to enter a prescription:

Doctors need to see patients, but their bosses demand that they satisfy Epic's endless red tape. Doctors now routinely stay late after work and show up hours early, just to do paperwork. It's not enough. According to another one of Kuttner's sources, doctors routinely copy-and-paste earlier entries into the current one, a practice that generates rampant errors. Some just make up random numbers to fulfill Epic's nonsensical requirements: the same source told Kuttner that when prompted to enter a pain score for his TB patients, he just enters "zero."
Don't worry, Epic has a solution: AI. They've rolled out an "ambient listening" tool that attempts to transcribe everything the doctor and patient say during an exam and then bash it into a visit report. Not only is this prone to the customary mistakes that make AI unsuited to high-stakes, error-sensitive applications, it also represents a profound misunderstanding of the purpose of clinical notes.
The very exercise of organizing your thoughts and reflections about an event – such as a medical exam – into a coherent report makes you apply rigor and perspective to events that otherwise arrive as a series of fleeting impressions and reactions. That's why blogging is such an effective practice:

The answer to doctors not having time to reflect and organize good notes is to give them more time – not more AI. As another doctor told Kuttner: "Ambient listening is a solution to a self-created problem of requiring too much data entry by clinicians."
EHRs are one of those especially hellish public-private partnerships. Health care doctrine from Reagan to Obama insisted that the system just needed to be exposed to market forces and incentives. EHRs are designed to allow hospitals to win as many of these incentives as possible. Epic's clinical care modules do this by bombarding doctors with low-quality diagnostic suggestions with "little to do with a patient’s actual condition and risks," leading to "alert fatigue," so doctors miss the important alerts in the storm of nonsense elbow-jostling:

Clinicians who actually want to improve the quality of care in their facilities end up recording data manually and keying it into spreadsheets, because they can't get Epic to give them the data they need. Meanwhile, an army of high-priced consultants stand ready to give clinicians advise on getting Epic to do what they need, but can't seem to deliver.
Ironically, one of the benefits that Epic touts is its interoperability: hospitals that buy Epic systems can interconnect those with other Epic systems, and there's a large ecosystem of aftermarket add-ons that work with Epic. But Epic is a product, not a protocol, so its much-touted interop exists entirely on its terms, and at its sufferance. If Epic chooses, a doctor using its products can send files to a doctor using a rival product. But Epic can also veto that activity – and its veto extends to deciding whether a hospital can export their patient records to a competing service and get off Epic altogether.
One major selling point for Epic is its capacity to export "anonymized" data for medical research. Very large patient data-sets like Epic's are reasonably believed to contain many potential medical insights, so medical researchers are very excited at the prospect of interrogating that data.
But Epic's approach – anonymizing files containing the most sensitive information imaginable, about millions of people, and then releasing them to third parties – is a nightmare. "De-identified" data-sets are notoriously vulnerable to "re-identification" and the threat of re-identification only increases every time there's another release or breach, which can used to reveal the identities of people in anonymized records. For example, if you have a database of all the prescribing at a given hospital – a numeric identifier representing the patient, and the time and date when they saw a doctor and got a scrip. At any time in the future, a big location-data breach – say, from Uber or a transit system – can show you which people went back and forth to the hospital at the times that line up with those doctor's appointments, unmasking the person who got abortion meds, cancer meds, psychiatric meds or other sensitive prescriptions.
The fact that anonymized data can – will! – be re-identified doesn't mean we have to give up on the prospect of gleaning insight from medical records. In the UK, the eminent doctor Ben Goldacre and colleagues built an incredible effective, privacy-preserving "trusted research environment" (TRE) to operate on millions of NHS records across a decentralized system of hospitals and trusts without ever moving the data off their own servers:

The TRE is an open source, transparent server that accepts complex research questions in the form of database queries. These queries are posted to a public server for peer-review and revision, and when they're ready, the TRE sends them to each of the databases where the records are held. Those databases transmit responses to the TRE, which then publishes them. This has been unimaginably successful: the prototype of the TRE launched during the lockdown generated sixty papers in Nature in a matter of months.
Monopolies are inefficient, and Epic's outmoded and dangerous approach to research, along with the roadblocks it puts in the way of clinical excellence, epitomizes the problems with monopoly. America's health care industry is a dumpster fire from top to bottom – from Medicare Advantage to hospital cartels – and allowing Epic to dominate the EHR market has somehow, incredibly, made that system even worse.
Naturally, Kuttner finishes out his article with some antitrust analysis, sketching out how the Sherman Act could be brought to bear on Epic. Something has to be done. Epic's software is one of the many reasons that MDs are leaving the medical profession in droves.
Epic epitomizes the long-standing class war between doctors who want to take care of their patients and hospital executives who want to make a buck off of those patients.

Okay all my thoughts because some people have been saying that not supporting this change is not supporting artist and creators and as an artist fuck that.
1. Audiences owe you nothing. You have to convince them to engage with your creation not the other way around. This is something both the nonprofit theatre I work with recognizes and huge companies realize. It's just part of life. There are so many talented people in the world making amazing art, videos, music, writings, and on and on, and there's only so much time in the day. I'm not saying you shouldn't know your worth, just that being flippant about how little you care about those who can't pay isn't a good move. On that note...
2. PR is everything. If you haven't made a visible effort to push patreon, channel memberships or other avenues of making money, don't be suprised that your creation that was previously accessible to those without extra cash and to those who can't support foreign subscriptions due either to conversions or because it simply doesn't work, being made private isn't popular. There's a big leap from "We want to have more artistic control" to "We can't afford to make our content accessible to most of our audience," and people are smart enough to see this. You either have to make budget cuts or give into sponsors. This isn't unique to Watcher, it's part of literally every production from broadway, to Hollywood, to YouTube. Unless you can fund it yourself or get viewers to pay(which given how many are already strapped for cash...) that's life.
Not to mention they simply do not have enough followers to make the switch to a paid only site(dropping the first epsiode only on YouTube isn't going to draw people in, they're just going to say "oh why start if I'm not going to see the rest" and not watch) especially not one that is buggy and a security risk. Even if the switch had been supported its not going to end well. The only reason services like nebula and dropout work is because of the large amount of series and creators and the fact those creators still are partly on YouTube so new people are drawn in.
3. As for the price, 6 dollars a month is a not a good starting price for only their content and that's as someone who pays for nebula. I'd be paying the same amount for a fraction of the access to others work. Actually it'd be twice as much. And before someone says "it's only a coffee-" that's for you. Not everyone has your lifestyle. And with every other patreon and subscription service that says the same thing, it all adds up and I simply don't think 60 dollars for 48 videos a year on a subscription basis where you don't get to keep the videos if your situation changes, some of which don't appeal to every viewer is a good move. If you were able to buy physical copies of your favorite series they've made that'd be different, but that's not what this is.
4. I do believe that the employees deserve a livable wage. I also did not hire them. It is not on the viewers that they hired more people than they could afford to. They can charge that much if they want to to try and balance this out. They also shouldn't be suprised if not many can or will sign up. They also don't have to be based in L.A. L.A has ridiculous costs associated with it, and quite honestly it doesn't really add much to the content. I'm not saying they need to move to the middle of nowhere Kansas. Simply that living and basing your studio in a super expensive city and then being suprised money is tight is just weird.
5. Something that occurs to me is that they might get more views if their playlists were better set up. Only some series are given playlists. It'd be easier to find all of the series and binge them if they didn't just show off their more popular shows. Honestly the only draw the streaming site has to me is that the series are actually labeled well.
Do I think the weird ass energy towards Steven is necessary? No. He's not the only one at the company and they're all adults. I actually liked grocery run and homemade, and like to see them back. The parascoial attachment to Ryan and Shane is annoying in people's criticisms, but that doesn't make them completely wrong. If you're going to brand yourself as the anti capalist underdogs you can't get away with being dismissive of your poorer fans. The dissonance is what is causing this backlash and makes you look like hypocrites. I definitely think Steven is turning into the fall guy which is fucked up, his statement and the fact dish granted is one of those shows that make people uncomfortable about wealth flexs doesn't help matters.

In discussing the 6th house, Howard Sasportas emphasizes, “Our true vocation is to be ourselves, no more, no less. And the consequences for not respecting the truths of our nature are stress, frustration, and disease.”
ᯓᡣ𐭩 This quote highlights why comparing your routines to others can be so harmful. You have to work with your energy; forcing yourself into routines that don’t align with it can lead to frustration and, ultimately, burnout.
ᯓᡣ𐭩 As I mentioned in another post, “The 6th house might be the best tool for setting boundaries because it aligns with the Virgo-Pisces axis. Your structured routines, daily interactions, and habits (Virgo/6th house) directly impact your mental health, sleep, and subconscious mind (Pisces/12th house) and vice versa. You can’t care for your mental health (Pisces) without analyzing or expressing your feelings (Virgo), and you can’t verbalize how you feel without actually experiencing those emotions (Pisces). It’s all about balance. For instance, neglecting self-care (Virgo/6th house) could lead to consequences like hospitalization (Pisces/12th house).”
ᯓᡣ𐭩 The planets and signs in the 6th House show how your daily routine can take an ugly turn when energy is not directed in your best interests. Some examples of how that energy has manifested from friends and family:
ᯓᡣ𐭩 Leo (Mars) in the 6th House: When she neglects nurturing her daily routines, she feels insecure about her image (Leo) and drained of her energy (Mars). For her, showing up to work looking her best (Leo) is essential, especially as a teacher, where every day is a performance. On days when she rolls out of bed without spending time on her looks, she doesn’t feel she’s giving her best. For someone else, like a Pisces placement, going with the flow might be less stressful, but for her, it’s different. She feels judged by her coworkers (Mars in the 6th can bring that feeling of scrutiny), so she toned down her bold outfits and unique hair (Leo), but this, in turn, made her feel less driven and engaged (Mars) in her DAILY LIFE and job (6h).
ᯓᡣ𐭩 Aquarius (Moon) in the 6th House: If she doesn’t take time for herself, she gets drained very quickly. Aquarius Moons need to prioritize rest and personal space to recharge. When she neglects to nurture her daily routine, she feels overwhelmed and frustrated (moon) with the collective (aqua). She was working at a nonprofit working with refugees and asylums, and she was very invested in her work to the point where she wasn’t taking any sick days or mental health days, and it took an immense toll on her. Keeping some emotional distance is suitable for Aquarius' energy because it helps them solve problems objectively (aqua energy) and help others without getting too stressed out. The Moon controls our emotions and our need for comfort. When Aquarius is in the 6th House about daily work and service, the emotionally demanding nature of daily routines can clash with their objectivity. If they don’t take time for routine breaks and emotional self-care, this can make them feel compassion fatigue.
ᯓᡣ𐭩 Aries (Jupiter) in the 6th House: She thrives on motivation and needs to feel inspired by her work to stay engaged. If a job doesn’t light that fire, she’ll move on quickly in true Aries fashion. With Jupiter here, she often jumps from one position to the next, seeking purpose and expansion. When she’s not compensated fairly or feels her insights aren’t valued, she becomes drained and unmotivated (Aries) in her daily routines (6H). Jupiter in Aries in the 6th House brings a lot of energy and optimism to work, but she needs to feel that her role has room for growth and respects her drive to stand out. The 6th House represents daily routines and service, and Aries energy wants freedom to take action. Jupiter, ruling growth and wisdom, makes her want to feel like her work is both challenging and meaningful. Without these elements, she quickly becomes restless, feeling stuck and undervalued.

BUT, when things are going wrong you will know because you will be feeling the OPPOSITE of that energy or the shadow side of it.
ᡣ • . • 𐭩 ♡ You don't need to have a planet in your 6h to decipher this for yourself, it just adds another layer of investigating if you do (Look at the sign and house of the planet that rules your 6th house to get a better sense of it. For example, if your 6th house is in Taurus and Venus rules your 9th house, you may find that learning new things or exploring spirituality makes your daily life better, while ignoring these things may make you feel bored or uninspired).
But anyways, back to the 6h, based on my friends charts, the shadow side looked like:
Leo or Sun in the 6th: The shadow side might show up as insecurity or feeling judged. You need to feel like you're being seen and appreciated for who you are and what you have to offer.
Aquarius or Saturn in the 6th: The shadow side can look like over-investment, leading to emotional burnout. You need to feel like your work is full-filling and impactful but also without it taking a toll on your physical and mental health AND ALSO that it does not negatively shape your feelings for the causes you are passionate about.
Aries or Mars in the 6th: The shadow side may involve impatience, frustration, or a restless need for change. You need to feel like a beast! Like you are THAT GIRL!!! (its about drive its about power we stay hungry we devour). but fr, you need to feel like your work has purpose and the energy you are exerting has MEANING with visible results.
Like I said if you don't have planets in the 6h that's okay. Look at the energy of the sign alone first, for example:
Capricorn in the 6th house (can apply to saturn in the 6h too): you have a strong desire for structure and consistency in your daily life. The shadow might be feeling stressed out because of too much work or not enough free time.
Gemini in the 6th house (can also apply to mercury in the 6h): You need mental stimulation and a variety of tasks in your daily life. On the other hand, with the shadow side your energy could be spread out or you might feel like you have too many commitments and need to relax.
Taurus in the 6th House (can also apply to venus in the 6h): you like stable, comfortable, and valuable routines. The shadow side can show up as not wanting to change, being set in your ways with habits, or sticking to old habits that don’t do you just because they feel comfortable.
Cancer in the 6th House (can also be applicable to moon in the 6h): You approach daily tasks with care and intuition and usually like working in a place that makes you feel supported. The shadow side could be an emotional attachment to routines or a weariness from always wanting to help others without setting limits.
Virgo in the 6th House (could be applicable to mercury in the 6h too): You naturally keep things in order and pay close attention to the little things when you do daily tasks. Perfectionism, overthinking, or being too hard on yourself if things aren’t done right could be signs of the shadow side.

“WHAT WE MOURN FOR THE DEAD IS THE LOSS OF THEIR HOPES.”
I never thought I’d make this post. Any time I imagined a One Direction member dying, I pictured myself weathered and grey. This was an eventuality that wasn’t supposed to be actualized until the boys and I had lived full lives. To have to come to terms with Liam’s death—his perpetual absence moving forward—in my mid twenties feels absurd. I wrote a long thing the day after I found out, so I’ve already gotten some thoughts out. I’m going to try and keep this short. I likely won’t succeed.
Liam was kind. If he’s remembered for anything, I hope it’s that. I know he helped out with food banks in London during lockdown because there were photos of him packing boxes, but I didn’t know until now how much money he gave them. £80,000 without any publicity. And it wasn’t a one-time donation. He kept working with various orgs to help food insecure people. In the week leading up to that unfortunate Wednesday, he gave away thousands to fundraisers—primarily set up to help people with severe illnesses. He’d been part of Soccer Aid for years. He was involved with anti-bullying campaigns. He worked with Rays of Sunshine to make hundreds of sick children happy. Over the years, he also donated to nonprofits that help children in Gaza and other places. The T-shirt he designed for Choose Love has garnered nearly £200,000; Choose Love has been working with the Palestine Children’s Relief Fund and Medical Aid for Palestinians to provide desperately needed aid in Gaza. Liam understood the value of his wealth, and what his social responsibility was. He did his part to make this world better.
All that without taking into account everything Liam did for us. The youtube videos he started during quarantine because it was a way to distract people, give them something to look forward to. His comedic timing was something special. The discord server where he talked to fans and highlighted their creative endeavors. His livestreams, the endless culture-defining tweets he made. I still see people laughing about his tweets. We all remember Mrs. Horan, yes? I mean, go all the way back to TwitCams. Just google the phrase and one of the first videos you get will be Liam’s. From day one, he took it upon himself to make sure the fans were happy. That we felt seen, heard. And he kept One Direction alive for us, on occasion at a great personal cost. He performed deep cuts we’d never seen sung live, he was always so enthusiastic about everyone else’s projects, he never shied away from talking about the band—because it made us happy. He knew what the band meant to us, the blend of hope and nostalgia many of us clung to, and he held on with us. For us. The masses ridiculed him for his clinginess, and he didn’t let go—for us. I’m sure he knew there are those of us for whom the name One Direction still means everything. And how right he was. Look at the global charts for the past two weeks. We’ve made history again. Because of Liam. He had been the glue holding a lot of the fandom together, whether people realized it or not. He brought us all together again in the most heartbreaking of ways.
One Direction came into my life at a time when I was becoming lonelier by the day. I had moved to a new country two years prior, and I didn’t yet have many friends because I knew only enough English to get by at school. Outside of school, I had no friends. They were all back home in the place I’d left. All I had was my two siblings—and when you’re 13 years old, your 14 yr old sister is hardly the person you want to spend all your time with. I didn’t have space for me, to do and to be something that was just mine.
Then I found 1d through a girl at school and they became that something for me. I bettered my English by watching them talk. I found this community because of them, and I have learned so much from being a part of it. So many wonderful people have touched my life because of them over the years, some I’ve fallen out of touch with and some I hung out with just this month. They—and, by extension, Liam—have made me wealthy in friendship.

Rafa; You have no idea how much you’ve helped build my confidence as a writer. Lyab is a thing of the past now, but those hours you spent fleshing out the details of that fic are priceless to me. I’d never written anything so ambitious before. And, frankly, I don’t think I would’ve attempted a novel if I hadn’t written a 100k fic—which I couldn’t have done without your encouragement. I still can’t believe Liam is gone. I was at the grocery store and it hit me that it’s real, and I thought, no, there’s no way. It feels so fucking weird having this invisible hole in my life that’s never going to go away. But I’ll always be grateful for everything Liam brought into my life. I know I’ll grow old with a whole bunch of you in my life—I’ve already spent a decade with some of you in my life—and I wish Liam got to grow old and weathered with us all.
This is such an inadequate goodbye. I think I’ll keep coming up with things I wish I could tell Liam, or things I want to say to you all. There’s so much history here, so much to reminisce about. He took a piece of my adolescence with him. I’ll miss him forever. Too many of my memories are intertwined with him and I’ll miss him forever.

as a lot of attention and media coverage is focusing on the critical situation in palestine atm, i wanna make this post to bring some awareness to the devastating earthquakes that have hit western afghanistan (herat) recently. this past weekend (october 7, 2023) over 2000 ppl died due to the 6.3-magnitude and another earthquake with the same magnitude hit the area again today (october 11, 2023).
the ppl are in dire need of financial aid since a lot of those had been cut in recent years due to the taliban taking over again. the wfp regional director for asia and the pacific said this drastic drop in funding (wfp had 80% less money for afghanistan than last year!!!) is going to lead to a famine and the situation is looking hopeless; especially children and women are suffering these consequences.
here are some organizations that are working on the ground rn and are reliable! please share and consider donating, even if it's just the money u would've spent on takeout or an iced coffee today.

"Wolfe, a reporter with Mississippi Today, a nonprofit, online news outlet, won the Pulitzer for detailing a disturbing $77 million welfare fraud scandal in the nation's second-poorest state, a scandal headlined by Mississippi's most famous athlete, Brett Favre.
The reporting described how, with then-Gov. Phil Bryant in office, Favre and a handful of others scored millions of dollars that were supposed to go to welfare families but were instead used on projects that included a college volleyball facility and a concussion drug company.
Favre's involvement elevated the story into national news, providing fodder for talking heads from Fox News to ESPN. In no time, some people were going to sarcastic extremes over the story, such as shirts that went on sale saying, in all capital letters, "Brett Favre stole money from poor people. Go Bears."
Bryant and Favre both have said they had no idea the money was designated for welfare families.
It was against that backdrop last spring, a month shy of her 29th birthday, that Wolfe won the Pulitzer and celebrated with family, friends and colleagues at Hal & Mal's, a Jackson institution. It was a moment that should have capped the journey on a story Wolfe had been chasing for five years.
Instead, not long after the Pulitzers were announced, the former governor sued Mississippi Today for defamation, setting off a battle that not only soured Wolfe's and Mississippi Today's moment but, more troubling to Wolfe, turned the focus away from the scandal itself.
That's because not only has Bryant's lawsuit not gone away despite Mississippi Today's insistence that its reporting is truthful, but the former governor also recently asked a circuit court to hold Wolfe and the news organization in contempt of court. The governor wants all of Wolfe's notes. He wants her emails. He wants her confidential sources. And the judge has ordered, at the very least, that Wolfe and Co. show him what they've got so he can determine its relevance to the case.
Mississippi Today has called the order "unconstitutional" and appealed to the state supreme court. Either way, Wolfe and her boss, Adam Ganucheau, have said there's no way they're giving up confidential sources. They say they would rather defy the court and face possible jail or, probably more likely, see their news organization get hammered with substantial damages.
What was once a story about poverty, power and Brett Favre, has now become a battle involving the First Amendment."

The Surucuá community in the state of Pará is the first to receive an Amazonian Creative Laboratory, a compact mobile biofactory designed to help kick-start the Amazon’s bioeconomy.
Instead of simply harvesting forest-grown crops, traditional communities in the Amazon Rainforest can use the biofactories to process, package and sell bean-to-bar chocolate and similar products at premium prices.
Having a livelihood coming directly from the forest encourages communities to stay there and protect it rather than engaging in harmful economic activities in the Amazon.
The project is in its early stages, but it demonstrates what the Amazon’s bioeconomy could look like: an economic engine that experts estimate could generate at least $8 billion per year.
In a tent in the Surucuá community in the Brazilian Amazonian state of Pará, Jhanne Franco teaches 15 local adults how to make chocolate from scratch using small-scale machines instead of grinding the cacao beans by hand. As a chocolatier from another Amazonian state, Rondônia, Franco isn’t just an expert in cocoa production, but proof that the bean-to-bar concept can work in the Amazon Rainforest.
“[Here] is where we develop students’ ideas,” she says, gesturing to the classroom set up in a clearing in the world’s greatest rainforest. “I’m not here to give them a prescription. I want to teach them why things happen in chocolate making, so they can create their own recipes,” Franco tells Mongabay.
The training program is part of a concept developed by the nonprofit Amazônia 4.0 Institute, designed to protect the Amazon Rainforest. It was conceived in 2017 when two Brazilian scientists, brothers Carlos and Ismael Nobre, started thinking of ways to prevent the Amazon from reaching its impending “tipping point,” when deforestation turns the rainforest into a dry savanna.
Their solution is to build a decentralized bioeconomy rather than seeing the Amazon as a commodity provider for industries elsewhere. Investments would be made in sustainable, forest-grown crops such as cacao, cupuaçu and açaí, rather than cattle and soy, for which vast swaths of the forest have already been cleared. The profits would stay within local communities.
A study by the World Resources Institute (WRI) and the New Climate Economy, published in June 2023, analyzed 13 primary products from the Amazon, including cacao and cupuaçu, and concluded that even this small sample of products could grow the bioeconomy’s GDP by at least $8 billion per year.
To add value to these forest-grown raw materials requires some industrialization, leading to the creation of the Amazonian Creative Laboratories (LCA). These are compact, mobile and sustainable biofactories that incorporate industrial automation and artificial intelligence into the chocolate production process, allowing traditional communities to not only harvest crops, but also process, package and sell the finished products at premium prices.
The logic is simple: without an attractive income, people may be forced to sell or use their land for cattle ranching, soy plantations, or mining. On the other hand, if they can make a living from the forest, they have an incentive to stay there and protect it, becoming the Amazon’s guardians.
“The idea is to translate this biological and cultural wealth into economic activity that’s not exploitative or harmful,” Ismael Nobre tells Mongabay."

Three kids, a successful nonprofit, a loving doe for a wife. It was all so amazing. But in truth it was all very tiring too.
You and Wanda encountered a few firsts recently. Your daughter Natalie switched to bottle feeding and began trying to say her first words. It was amazing. You and your wife couldn’t be prouder or happier to say the least.
Your twin buck sons Billy and Tommy were enjoying kindergarten, alongside their best friend and wolf hybrid America who just joined their class. It was picturesque.
But you were missing special time with your doe. You missed, you yearned for the time you and her used to have together when you were younger. Not that you regret any of the amazing experiences parenthood had provided, but you wanted time with just your special doe. An idea formed in your mind and you approached your doe that evening with your amazing plan.
You approached your wife after dinner as she was cleaning the dishes. The boys were watching TV and your baby girl was dozing off in her little crib. It was all perfect.
You wrapped your arms around your mate and kissed her neck. She hummed in contentment.
“Detka” she moans.
“I want to have an affair. With you.” You quickly say.
Wanda giggles, “detka we’re married. What are you getting at?”
“We could get Natasha and Pietro to watch the kids,” you gently whisper in her ear. You begin caressing her thighs, sweetening the deal. “We can use fake names, get a hotel room. Just the two of us”
Your doe shutters at your touch. Her lips quiver at the mention of your plan.
“How soon?” She giggles.
“Friday?” You kiss her behind the ear.
“Friday” she responds with a blush. Your doe bites her lip as she goes back to her task. Her own mind finds itself racing with anticipation.
Friday had arrived. You got the reservation set and dropped the kids off with Natasha and Pietro. Your brother in law gave you a little wink as you turned to leave.
Wanda was already at the hotel. You made sure she had plenty of time to check in and get herself ready in however she wanted to. Honestly, the idea was so enticing and exciting for your bride. She even bought a couple little things for such an occasion. It made her giddy, a chance for the two of you to romance and woo one another.
You arrived at the hotel, a little swanky for your taste but Wanda really wanted to try it out. Turns out Friday night was a swanky event in the hotel’s restaurant, simply perfect timing.
You walked into the hotel in a nicely tailored suit, nothing too fancy but you knew your doe would love it.
You made your way thru the crowd trying to locate your bride as the jazz ensemble played softly.
And then you saw her. Wearing a red evening dress, makeup done, hair pinned up just right. Her antlers were shined up, gleaning like polished ivory. Her very mood portrayed that of a seductive fem-fatale from an old detective movie, your bride was just stunning. You almost couldn’t move, you were that stunned by her.
You walk up to her, trying to keep a certain level of charm on your face, “I must say, red really is your color, ma’am”
“I’m sorry,” she playfully says with a smile, “have we met?”
“I’m sure I would remember someone as beautiful as you” you respond. “Is there someone you’re waiting on?”
“No,” she stares at you seductively, “I’m here on my own accord, looking for some company”
“If it’s alright, I’d love to be some company for you,” you take the seat next to her.
“Most would be turned off by my antlers and tail” she lounges in the chair, not taking her eyes off you for a second.
“I find them quite attractive.”
“I could say the same about you.” She says, her voice dripping with the slight Sokovian accent that you loved so much. “So what brings you here tonight?”
“Maybe I’m looking for some company. Or maybe I’m here on assignment” you flirt with her.
“Oh?” She purrs. “Maybe I’m actually here to rob the rich donors scattered around here”
“International jewel thief? Funny I’m here hunting one” you retort. This little dance of words was enticing.
“Let’s save the cat and mouse for later” she grabs two drinks off a nearby tray, “let’s enjoy the moment and company”
The two of you take a sip of your drinks, however, your eyes remain locked on each other.
The band begins to play a more lively tune. “Care to dance, miss jewel thief?” You ask.
“I was hoping you’d ask,” she purrs as she gets up and sways towards you. Taking her hand, you guide Wanda out to the open dance floor. Your hand snakes around her waist and pulls her close. She lets out a little gasp.
Her hand snakes around your shoulder as the two of you begin to sway to the music.
To the best of the song, Wanda gently grinds her hips against yours. She knew exactly how to get to you.
“Spot any of your targets?” You whisper in her ear
“I spot one.” She replies with a mischievous smile, “I think I may have to get this one alone”
“Your room or mine?”
“Hmm…I don’t think your agency would cover a room here. Besides I want you all to myself” she guides her nails gently down your arm, the sensation was indescribable.
“I’ll cover the room service” you respond, earning a giggle from your mate.
She gently pulls you towards the exit of the lounge area. You follow her into the elevator and all the way up to your hotel room.
About an hour or so later, you and Wanda found yourselves lounging on the singular bed in your comfy set of PJs, the TV was playing a favorite movie of yours.
You had made love a couple times already and enjoyed each other’s company. She was the only company you ever wanted.
“I’m so glad we did this” your wife giggles.
“Oh I’m not letting you out of my sight,” you flirt with her, “can’t have you stealing some rich snob’s jewels.”
“You should’ve brought your handcuffs then” she gives you a wink.
The door knocked as you and Wanda got up, “room service” a voice called out.
You gladly answered and got your order of Chinese take out. Wanda really loved the fried rice and broccoli. The two of you took enjoying your evening with each other, just laughing and feeling like young mates again.
And then Wanda’s phone rang with a text from your pal Tony. The text read as followed: Wanda, why’d you take my watch off of me? Are you and Y/N coming back to the party?
You looked at the text and then at your mate. You had completely forgotten Tony was there too.
“Wanda?!” You asked with a little chuckle.
“I needed a reason for you to chase me?” She says with a little shrug.
Your mate, your doe, the love of your life. What would you ever do without her?

once again, we go back to THE ACTUAL LAW (17 U.S. Code § 107) which clearly states it that the factors considered when referring to copyright and fair use are as follows:
the purpose and character of the use is of a commercial nature or is for nonprofit educational purposes,
the nature of the copyrighted work,
the amount of the portion used in relation to the copyrighted work as a whole, and
the effect of the use upon the potential market for or value of the copyrighted work.
also note the fact the work is unpublished does not bar itself from a finding of fair use.
the fact is, it's entirely on a case-by-case basis, as a lot of this is subjective and completely depends on the judge presiding over the case. HOWEVER, fanfiction is very likely to count as "transformative", due to the nature OF fanfiction. there's a reason AO3 is still up and the entire site hasn't been removed for copyright infringement.
in the case of yaelokre, specifically the nsfw works, they're only taking the characters and some elements of the story, but they're not appropriating the entirety of the work, making profit off of it, detracting from the potential market value of the original work, or claiming it as their own, which is NECESSARY to prove it is an infringement of copyright.
regardless of all that, the fact remains it is shitty to try and strike down what fanfiction writers/fanartists do just because YOU PERSONALLY do not like what fans do with your characters. keath made their characters public, now they have to deal with the consequences of that, or remove their characters from public eye. very simple.
at this point, i hope people DON'T make fanfic/fanart for yaelokre lest they get a cease and desist, because who knows what keath/the people working with them will determine as "inappropriate, offensive, or misinfo".

Time and again, I find myself thinking about radium suppositories: specifically, I get to thinking about the day that the consensus shifted from "radium suppositories are great" to "stop putting radioisotopes up your ass."
The thing is, people really liked radium-based quack remedies. They drank radium-infused water, smeared radium cream on their faces and bodies, and yes, rammed radium suppositories up their assholes:

The fact that this made whatever ailed you sicker didn't deter the radium true believers: if you're getting sicker, then you must need more radium.
When I think about the debate over radium, I imagine that the people who understood that radium was really bad for you must have run up against critics who told them they were being unreasonable. "You can't tell people to stop using radium. Tell them to use suppositories with less radium. Tell them to use them less frequently. But you can't just tell people, 'stop putting radium up your asshole.' They won't take you seriously."
About 20 years ago, I started pitching various institutions that reviewed consumer tech policy on the idea that they should reject any product that had DRM. After all, DRM didn't just restrict how you used a gadget today, it provided a facility for nonconsensually, irreversibly field-updating that gadget to add new restrictions tomorrow. How could a reviewer in good conscience say, "Go ahead and buy this device if you need this feature," if they knew that at any time in the future, the gadget's maker could take that feature away and leave the buyer with no recourse?
Here's the warning I (half-seriously) suggested magazines run alongside such products:

No one took me up on my offer. Over and over again, magazine editors, managers of nonprofit review outlets, and indie gadget reviewers told me that it was unrealistic to publish a roundup of, say, this year's portable music players with the recommendation, "Just don't buy any of these. None of them are fit for purpose."
In other words: No one wanted to publish, "The correct amount of radium to stuff up your asshole is zero."
But the correct amount of rectal radium for you to administer is "none" and the correct car for you to buy today is none of the cars:

This isn't the first time the correct automotive recommendation was "don't buy any of these cars." Back before seatbelts came standard in cars, the correct car was "don't buy a car." Sometimes, the correct answer is "none of the above." Even if that makes you sound unserious, the alternative is that you counsel people to put radium up their asses in a bid to seem "reasonable."

The reality is that we're living at the end of a catastrophic experiment in deregulation and its handmaidens, corruption and regulatory capture, and there are lots of "normal" things that we just need to stop doing. Not do less of them – just stop.

When the Biden admin dropped its executive order on ethics just hours after the inauguration, they trumpeted that it "went further than any other towards slowing the revolving door and limiting conflicts of interest while in office":

Congress hasn't updated consumer privacy law since 1988, when it took the bold step of…banning video-store clerks from telling the newspapers which VHS cassettes you took home. Since then, a coalition of commercial surveillance companies and the cops and spies who treat their data-lakes as massive, off-the-books anaerobic lagoons of warrantless surveillance data has prevented the passage of any new privacy protections for Americans.

From the perspective of the radium pitchmen, the most shocking thing about the past four years has been antitrust enforcers – like Lina Khan, Rohit Chopra, and Jonathan Kanter – who refused to bargain about how much radium we needed to stick up our butts. Fearless of being branded as "unserious" and "unreasonable," they seriously, reasonably said the right amount is none, actually.
None. Which is why they're so mad at Khan and co. Which is why they're so bent on getting Kamala Harris to fire Khan – despite the fact that this would burn precious political capital in the senate.
